PLANNING COMMISSION RESOLUTION NO. 1360
A RESOLUTION GRANTING CONDITIONAL USE PERMIT 87-23 TO
EXPAND THE ENROLLMENT OF THE EXISTING SCHOOL FROM
200 TO 400 STUDENTS AT 758 WEST ANOAKIA LANE.
WHEREAS, on November 30, 1987 an application was filed by Anoakiu School
to expand the enrollment of the existing school from 200 to 400 students,
Planning Department Case No. C.U.P. 87-23, on property commonly known as 758 W.
Anoakia Lane, more particulary described as follows:
Portions of Rancho Santa Anita, Portion of Lot 3
Tract 948, in the City of Arcadia, County of
Los Angeles, State of California, as per map
recorded in Book 17, Page 21, of maps in
the office of said County Recorder.
WHEREAS, a publiC hearings were held on January 26, and February 9, 1988,
at which time all interested persons were given full opportunity to be heard and
to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY
RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls; fences, parking, loadin!l,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.

6. That the use applied for will not have a substantial adverse impact
~ on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to expand the enrollment of the existing school from 200
to 400 students upon the following conditions:
1. Conditions as outlined in the attached report dated Januarj' 22,
1988 from the Fire Department shall be complied with to the satisfaction of the
Fire Chief by March 1, 1988.
2. A plan shall be submitted to the Public Works Department showing
how traffic congestion would be minimized. Said plan shall be subject to the
approval of the Director of Public Works.
3. All landscaped areas between the property line wa.lls and the public
right-of-ways (Foothill Blvd., Baldwin Avenue and Anoakia Lane) shall be
maintained. Landscaping may be lawn, ground cover, shrubs or trees. Th'ls shall
be subject to the review and approval of the Planning Department.
4. The existing dirt parking lots shall be permitted if dust 'Is
controlled and fire lanes are not blocked. If this is not possible, the
applicant should either cover the parking lots with gravel or pave said lots.
~ This shall be SUbject to the approval of the Planning Department.
5. The combi ned enrollment of the nursery, ki ndergarten and el ementary
schools (grades 1 to 8) shall not exceed 400 students.
6. No new buildings shall be constructed west of the Arcadia Wash
(storm drain easement).
7. Elementary school classes (grades 1 to 8) shall be conducted east
of the Arcadia Wash (storm drain easement).
8. Ingress or egress shall be prohibited either vehicular or
pedestrian from any driveway, gate or opening onto Anoakia Lane.
9. That screen planting consisting of shrubs and/or trees shall be
maintained along the westerly property line in order to absorb any objectionable
noises emanating from the school or the parking lot.
10. That the westerly 50' of the subject property shall be a buffer
zone and shall not be used for parking, outdoor activities, picnicking or any
other purpose.

11. The nursery school shall maintain a minimum of 75 square feet of.
outdoor play area and 35 square feet of indoor area for each child.
12. No expansion of existing uses, services or buildings shall be
permitted unless a conditional use permit is filed and approved for the proposed
expansion.
13. The Building Division shall inspect the property and identify
buildings which are unreinforced masonry and buildings which are suspected to be
unreinforced masonry. A report shall be sent to the applicant and proper'ty owner
and within 45 days after receipt of said report, the applicant or property owner
shall provide to the City of Arcadia Building Division a seismic evaluation
report (testing guidelines per City of Los Angeles Building Code Chapter B8
Earthquake Hazard Reduction in Existing Buildings) prepared by a civil or
structural engineer or architect licensed by the State of California for any
unreinforced masonry building which is used or proposed to be used for classrooms
or other use by students. Said seismic evaluation report shall be subject to the
approval of the Chief Building Official. The use or occupancy by students of any
building identified in said report to consist of unreinforced masonry
construction which does not meet the requirements of Chapter 88 shall imlmldiately
be terminated. Said buildings shall be posted as being unsafe for occupancy.
14. Before an unreinforced masonry building can be used by students it
shall be modified an/or strengthened to meet the requirements of Chapter 88.
15. The vacant building at the northwest corner of the lots shall only
be used as a single-family dwelling as defined by Arcadia Municipal Code Sections
9220.20, 9220.21 and 9220.25. A minimum 4'-0" high fence shall surround said
building by February 24, 1988. Said fence shall be located at least 25'-0" from
any wall of the building. If it is shown to the satisfaction of the Chief
Building Official that the building does not consist of unreinforced masonry or
if the building is repaired or demolished, the fence may be removed.
16. The pool house shall be surrounded by a minimum 4'-0" high fence by
February 24, 1988. Location of said fence shall be subject to the approval of
the Planning Department. If it is shown to the satisfaction of the Chief
Building Official that the pool house does not consist of unreinforced masonry or
if the pool house is repaired or demolished, the fence may be removed.

17. The pool fence shall be repaired in compliance with the City's
~ building code by February 17, 1988.
18. The pond shall be fenced or drained by February 17, 1988. If a
fence is used it shall be 4'-0" in height and subject to the City's building
code.
19. That the pergola identifed as P3 on the revised site plan d,ated
February 4, 1988, shall be demolished, repaired or fenced off by February 17,
1988.
20. That the pergola identified at PIon the revised site plan dated
February 4, 1988 shall be repaired, demolished or fenced off by March 15, 1988.
21. By March IS, 1988 the applicant shall provide scaled and
dimensioned floor plans of each building on the site which is being used or
proposed to be used by the students. Each floor plan shall identify the proposed
use and occupancy.
22. The Fire Department and Building Division shall evaluate each
building on the site to determine its use and occupancy. The applic.ant shall
repair, vacate, demolish or bring said buildings into a use and occupancy in
compliance with the Building Division and Fire Department. Said work shall be
~ completed within 30 days after receipt of a correction notice from the Fire
Department or Building D1vs1on.
23. If a building code variance is approved by the City Council, the
use of temporary trailers shall be permitted. The use and location of said
trailers shall be subject to the approval of the City Council. Said trailers
shall not be used for more than one year.
24. The subject site shall be maintained as per the plans on file in
the Planning Department.
25. That C.U.P. 87-23 shall not take effect until the owner'and
applicant have executed a form available at the Planning Department indic.ating
awareness and acceptance of the conditions of approval.
26. Noncompliance with the provisions and conditions ~f this
Conditional Use Permit shall constitute grounds for the immediate suspension or
revocation of said Permit.

Section 4. The decision, findings and conditions contained in this
~ Resolution reflect the Commission's action of-February 9, 1988 and the following
vote:

ABSTAIN: Commissioner Hedlund

and shall cause a copy to be forwarded to the City Council of the City of
