PLANNING COMMISSION RESOLUTION 1399 A RESOLUTION GRANTING ZONE VARIANCE 88-002 TO CONVERT AN EXISTING AUTOMOBILE SERVICE STATION INTO A GARAGE WHICH IS A NON-CONFORMING USE ON C-2 ZONED PROPERTY AT 66 EAST FOOTHILL BOULEVARD. WHEREAS, on November 21, 1988, an application was filed by Juan Antonio Bigon to convert an existing automobile service station into a garage by removing the underground fuel storage tanks and the service pumps, Planning Department Case No. V 88-002, on property commonly known as 66 East Foothill Boulevard, more particularly described as follows: South 53.1 feet of the north 78.1 feet of Lot 1 of C.B. Clapp's Subdivision, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 31, Page 30 of Miscellaneous Records in the Office of the County Recorder of said County, except the east 10 feet of said lot. . WHEREAS, a public hearing was held on December 13, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, lHEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That there are exceptional ar extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity, because compliance with the State requirements would make the retention of the current gas station use economically unfeasible and to cease all service station! garage uses would deprive the property owner! operator of his lively hood. 2. That the granting of such variance will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vidnity in which the property is located, because the repair use will remain essentially the same as presently exists. . 1399 1 . 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the other property in the same zone and vicinity, because there are service stations in the area which are engaged in similar garage activities, the only difference being that they also provide gasoline service. 4. That the granting of such variance will not adversely affect the comprehensive General Plan, because the existing use will not be significantly different from the existing service station use. Section 3. That for the foregoing reasons this Commission grants a Zone Variance to convert the existing automobile service station into a garage upon the following conditions: 1. That the site improvements shall be in compliance with the plans on file in the subject case. 2. Conditions as outlined below from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works: a. On-site drainage shall be directed towards the existing catch basins. . b. Reconstruct the existing driveway apron per City standard to reflect the proposed changes as shown on the proposed site plan. c. Remove A.c. sidewalk and construct P.CC full parkway width sidewalk along First Avenue as per City standard. d. Remove and replace deficient or damaged curb, gutter" sidewalk and driveway apron along Foothill Boulevard. e. Construct full curb and gutter per City standard for that portion of removed driveway apron along First Avenue. f. All public works improvements shall be completed to the satisfaction of the Director of Public Works prior to final acceptance by the Building and Safety Department. g. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where distributed. This work will be the responsibility of the permittee and shall be at the permittee's expense. 3. The underground fuel tanks and the service pumps shall be removed in accordance with all applicable regulations and to the satisfaction of the Fire Chief. 4. That fire safety shall be provided to the satisfaction of the Fire Department. . 1399 -2- 5. That a landscaped plan and irrigation plan shall be submitted to the Planning Department for its review and approval. 6. That all work on vehicles shall be done inside the building. 7. All of the employee vehicles and the vehicles to be serviced by the facility shall be parked on the premises. 8. That the parking lot shall be striped in accordance with the Municipal Code Section 9269.8. 9. That V 88-002 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of December 13, 1988 and the following vote: AYES: Commissioners Hedlund, Szany, Clark, Papay, NOES: None ABSENT: Amato Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. NICHOLSON, ASSOCIATE PL~ER RESOLUTION 1399, GRANTING ZONE VARIANCE 88-002 66 EAST FOOTIffiLL BOULEVARD SUBJECT: The Planning Commission at its January 10, 1989 meeting, voted 4 to 0 with one member absent to adopt Resolution 1399, granting Zone Variance 88-002 to convert an existing service station into a garage, which is a non-conforming use on C-2 zoned property, at 66 East Foothill Boulevard. . Any City Council Member, at their own discretion and without the filing of any fee, can appeal the decision of the Planning Commission within five (5) working days after the date of said decision or at the next City Council meeting, whichever is later. Said appeal must be made by January 17, 1989 Attached for your information are Resolution 1399 and the staff report. .
