PLANNING COMMISSION RESOLUTION 1395 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-027 FOR THE SALE OF LIQUOR FOR OFF-PREMISE CONSUMPTION WITHIN 150 FEET OF RESIDENTIALLY ZONED PROPERTY AT 57 EAST FOOTHILL BOULEVARD. WHEREAS, on October 27, 1988 an application was filed by Hank H, Yacoub for the sale of liquor for off-premise consumption within 150 feet of residentially zoned property. The applicant proposes to operate a gift shop which will include the sale of liquor packed in gift boxes, Planning Department Case No. C.U.P. 88-027, on property commonly known as 57 East Foothill Boulevard, more particularly described as foIlows: Lot II, Block 2, Tract 4129, in the City of Arcadia, County of Los Angeles, State of California as per Map recorded in Book 75, Pages 48 and 49 of Maps, in the Office of said County Recorder . WHEREAS, a public hearing was held on November 22, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said with the land and uses in the neighborhood, 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6, That the use applied for will not have a substantial adverse impact on the environment. . I 1395 . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the sale of liquor for off-premise cons,umption upon the following conditions: 1 . Fire protection shall be provided to the satisfaction of the Fire Department. 2. Water service shall conform to the Uniform Plumbing Code and any new water service shall be installed by the Arcadia Water Division upon the request and payment of fees by the developer, 3. All liquor sold shall be gift wrapped or packaged. 4. Architectural Design Review applications will be required for all signs. 5. The sale of liquor shall be limited to 20% of the floor area used for retail sales and display. This shall be subject to the approval of the Planning Department. 6. For purposes of this conditional use permit liquor shall be defined and limited to beer, wine and champagne. 7. That C.U.P. 88-027 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 8. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 22, 1988 and the following vote: AYES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. . o 2 1395 . The Planning Department is recommending approval subject to the conditions outlined in the report. . GENERAL INFORMATION . APPLICANT: Hank H. Yacoub LOCATION: 57 East Foothill Blvd. REQUEST: Conditional use permit for the sale of liquor for off-premise consumption within 150 feet of residentially zoned property, The applicant proposes to operate a gift shop which will include the sale of liquor packed in gift boxes. 5,979 square feet (.14 acre) 50 feet on Foothill Blvd, LOT AREA: FRONTAGE: EXISTING LAND USE & ZONING: Commercial building; zoned C-2 CUP 88-27 November 22, 1988 Page 1 \ o . . . . SURROUNDING LAND USE & ZONING: North: Apartment building and single-family dwellings; zoned R-3 and R-l Commercial offices and gas station; zoned C-2 Mixed commercial; zoned C-2 Mixed commercial; zoned C-2 South: East: West: GENERAL PLAN DESIGNATION: Commercial PROPOSAL AND ANALYSIS The applicant is proposing to operate a 1,020 square foot gift shop which will include the sale of liquor (champagne and wines) packed in gift boxes. A conditional use permit is required for any retail business selling liquor for off-premise consumption located less than 150 feet from residentially zoned property, The gift shop is part of a 3,400 square foot commercial building (see site plan). Surrounding the subject site are commercially zoned properties except to the north where the nearest lot is zoned R-3 and is developed with an apartment building, Beyond said R-3 zoned lot are R-l zoned lots. Separating the subject site from the residentially zoned properties is a 20 foot wide alley. The City adopted the requirement for a conditional use permit due to the potential problems that could be caused by the sale of liquor for off-premise consumption adjacent to residential properties, Some of the detrimental aspects considered were noise, littering, loitering and criminal activity which would not be consistent with a residential community. The Planning Department feels that the sale of liquor packed in gift boxes would not create the detrimental aspects usually associated with liquor sales. It is unlikely that the liquor purchased at the gift shop would be consumed on or near the site. Any new signs or changes to the building's facade will need a Architectural Design Review application. The proposal would be consistent with the Zoning Ordinance and General Plan, Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, CUP 88-27 November 22, 1988 Page 2 \ o . . . . minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 88-27 subject to the following conditions: 1.
