A RESOLUTION DENYING CONDITIONAL USE PERMIT
88-025 FOR OUTDOOR STORAGE ON AN INDUSTRIAL
SITE CONTAINING 3,210 SQ. FT. ON LOT 1600 OF CHICAGO
PARK TRACT,
WHEREAS, on October 3,1988 an application was filed by Don Rohrer for
outdoor storage and a modification to permit an industrial site of 3,210 sq. ft. in lieu of
15,000 sq, ft., Planning Department Case No. C.U,P. 88-025, on Lot 1600 of Chicago Park
Tract, more particularly described as follows:
Lot 1600 of Chicago Park Tract, in the City of Arcadia, County
of Los Angeles, State of California, as per map recorded in Book
30, Page 100 of Miscellaneous Records, in the office of said County

WHEREAS, a public hearing was held on October 25,1988, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOL YES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2, This Commission finds:
1. That approval of this conditional use permit would be detrimental, and
injurious to the property and surrounding improvements in such zone and vicinity.
2, That the size of the site substantially reduces the possibility of the site ever
being developed when the outdoor storage is discontinued.
Section 3. That for the foregoing reasons this Commission denies Conditional
Use Permit 88-025 for outdoor storage and a modification to permit an industrial site of
3,210 sq. ft. in lieu of 15,000 sq, ft. on Lot 1600 of Chicago Park Tract.
Section 4, The decision, findings and conditions contained in this Resolution
reflect the Commission's action of October 25, 1988 and the following vote:
A YES: Commissioners Amato, Hedlund, Szany, Papay
NOES: None
ABSENT: Commissioner Clark

Section 5, The Secretary shaH certify to the adoption of this Resolution and shall
cause a copy to be forwarded to the City Council of the City of Arcadia,

. GENERAL PLAN DESIGNATION:
Industrial
PROPOSAL AND ANALYSIS
The applicant is proposing to use a single lot (25' x 128.4') for outdoor storage of truck
cranes, trucks and equipment, Improvements will include paving the site, 7 foot high
wrought iron gates at the entrance, a 7 foot high cinder block wall will surround the lot
and a 5 foot by 10 foot landscaped front yard, Access to the site will be from a 20 foot
wide driveway on Goldring Road,
To the north and east of the subject site are industrial buildings and their parking lots,
West of the site are vacant lots,
The M-l zone requires every industrial site to have a lot area of not less than 15,000
square feet. The City Council may approve an industrial development of a lot of less
than 15,000 square feet where a hardship by reason of surrounding development,
location or configuration is clearly demonstrated (9266,2.3), If the Planning
Commission approves CUP 88-025, City Council approval will also be required due to
the substandard lot size,

The owner of the subject lot does not own any of the adjacent lots, The applicant
wishes to purchase only the single lot.
Outdoor storage is a permitted use in the M-l zone with an approved conditional use
permit,
The proposal would not be consistent with the zoning for the area due to the
substandard lot size. It is the Planning Department's opinion that the granting of this
conditional use permit would be detrimental to the surrounding improvements and
would set a harmful precedent for the area, Approval of this proposal would reduce
the potential for the subject site to be incorporated into any future development with
the lots to the west. If the lots to the west were to develop without incorporating this
25 foot wide lot, its potential for development with a structure, parking etc, would be
almost impossible due to code requirements,
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance,
Therefore, a Negative Declaration has been prepared for this project,

. ARCHITECTURAL DESIGN REVIEW
Concurrent with the consideration of this conditional use permit, the Planning
Commission may approve, conditionally approve or deny the applicant's design
concept plans,
Staff believes that the applicant's proposal complies with the intent of the design
criteria set forth in the City's Architectural Design Review Regulations,
The design and materials used for the project will be harmonious with the
surrounding developments,
A separate Architectural Design Review application will be required for any signs,
RECOMMENDATION
The Planning Department recommends denial of CUP 88-025,
However, should the Planning Commission consider approval CUP 88-025, the
Planning Department recommends the following conditions:

1.
Conditions as outlined in the attached report from the Department of
Public Works shall be complied with to the satisfaction of the Director of
Public Works,
2.
Fire protection shall be maintained to the satisfaction of the Arcadia Fire
and Building Departments,
3,
Any change in water service shall be installed by the Arcadia Water
Division at the applicant's expense,
4.
The walls along the east, west and south property lines shall consist of
split face block on the outside faces. Color of the split face block shall be
subject to the approval of the Planning Department.
5,
Final landscape plan shall be subject to the approval of the Planning
Department. One 24" box tree will be required within the front 10'-0",
6.
Approval of CUP 88-025 shall be subject to the applicant receiving
approval from the City Council for a substandard lot size of 3,210 square
feet in lieu of 15,000 square feet.

The subject site shall be maintained as per the plans on file in the
Planning Department,

That CUP 88-025 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
9, Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or
revocation,
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve Conditional Use Permit
88-025, the Commission should move to approve ~d file the Negative Declaration and
find that the project will not have a significant effect on the environment and direct staff
to prepare the appropriate resolution incorporating the specific findings and conditions
of approval set forth in the staff report, or as modified by the Commission,
