PLANNING COMMISSION RESOLUTION 1387 A RESOLUTION GRANTING CONDmONAL USE PERMIT 88-021 TO EXPAND THE EXISTING SERVICE STATION AND CONVERT ONE EXISTING BAY INTO A DRIVE-TI-IROUGH CAR WASH AND REMODEL THE EXISTING SALES AREA INTO A MINI-FOODMART AT 916 SOUTH SANTA ANITA AVENUE. WHEREAS, on July 13, 1988 an application was filed by Shell Oil to expand the existing service station and convert one existing bay into a drive-through car wash and remodel the existing sales area into a mini-foodmart, Planning Department Case No. c.u.P. 88-021, on property commonly known as 916 South Santa Anita Avenue, more particularly described as follows: Lot 2 of Tract 101, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 5775, Page 15 of Maps, in the office of said County Recorder. . WHEREAS, a public hearing was held on August 23, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . 1387 -1- . S. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the en vironmen t. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to expand the existing service station and convert one existing bay into a drive-through car wash and remodel the existing sales area into a mini-foodmart, upon the following conditions: 1. That all parking shall comply with the parking code requirements, i.e., striping, size, wheel stops, backout area, etc. 2. That the yellow portion of the building shall be painted a color consistent with a color of other recently remodeled Shell stations, i.e., gray tone, off-white, etc.. Said color to be submitted to the Planning Department for its review and approval prior to painting. 3. That the storage bin shall be removed from the site. 4. That the trash bin shall be stored within the trash area. 5. That planter areas shall be cleared of weeds and shall be properly maintained. 6. That any exterior alterations to the building and all signs shall be submitted for Architectural Design Review prior to commencement of any work. 7. That there shall be no outside display of goods and products, including tires, oil dispensing, etc. 8. That the service station shall comply with Sections 9275.4.7 of the Arcadia Municipal Code which include in part: A. The service station shall be equipped with a pump emergency shut off switch located at the cashier's station. B. All retail sales shall be limited to beverages, food, dairy and tobacco products that are bottled, canned, packaged. or sealed. The display, sale or storage of books, periodicals, magazines, health and beauty aids, household soaps and cleaners and alcoholic beverage is prohibited. C. No food, snack or beverage shall be prepared, cooked, heated or warmed on the premises. The room used to display, sell or store the merchandise shall not contain any cooking facilities, i.e., oven, microwave or heating utensil. . . 1387 -2- . 9. There shall be no storage, sale and display or advertisement for sale or lease of motor vehicles, trucks or trailers on the subject site. 10. All repair work shall be done inside the service bays. 11. That fire safety, including a fire hydrant, shall be installed to the satisfaction of the Fire Department. 12. That c.u.P. 88-021 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 13. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 23, 1988 and the following vote: A YES: Commissioners Amato, Clark, Hedlund, Szany, Papay NOES: None ABSENT: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. BUTLER, SENIOR PLANNER CASE NO.: c.u.P. 88-021 FROM: SUMMARY Shell Oil Company is proposing to remodel the existing service station at 916 South Santa Anita Avenue by adding a 264 sq. ft. addition, converting an existing bay into a drive-through car wash and remodeling the existing sales area into a mini- foodmart. The Planning Department is recommending approval subject to the conditions in this report. . GENERAL INFORMATION APPLICANT: Shell Oil Company LOCATION: 916 South Santa Anita Avenue, the northeast comer of Santa Anita Avenue and Duarte Road REQUEST: Conditional use permit to expand the existing service station and convert one existing bay into a drive-through car wash and remodel the existing sales into a mini-foodmart LOT AREA: 20,367 square feet FRONTAGE: 142+ feet on Duarte Road 151+ feet on Santa Anita Avenue EXISTING LAND USE &: ZONING: Developed with a three-bay service station; zoned C-2 . SURROUNDING LAND USE & ZONING: East: Developed with an egg distributor; zoned C-2 Developed with a service station and mixed commercial uses; zoned C-2 Developed with a tire store and mixed commercial uses; zoned C-2 Developed with a mixed retail center; zoned C-2 North: South: West: GENERAL PLAN DESIGNATION: Commercial PROPOSAL The applicants are proposing to add 264 sq. ft. to the existing 1,665 sq. ft. service station and convert one of the three bays into a drive-through car wash and remodel the sales area into a mini-foodmart. . Currently there is a portable storage bin (no permits on file) on the east side of the service station. The 264 sq. ft. addition will replace the storage bin and provide more room within the interior of the station for an office and storage area. The existing sales area will be remodeled into a 210 sq. ft. mini-foodmart. The operator of the station has indicated that Shell Oil Company may do some minor exterior upgrading of the building. If there are any changes, said changes must be approved through the Architectural Design Review process, Also, all new signs must be approved through the ADR process. Although plans show an existing trash enclosure adjacent to the new addition, the trash bin is not stored within this area. All the fuel dispensing islands are located along Santa Anita Avenue. The island along Duarte Road is used for air and water dispensing only. There are three service bays. The southerly bay is to be converted into a drive- through car wash. Cars will enter the car wash from the rear of the building and exit to the front. Portions of the building have been recently painted a bright yellow (the Shell logo color), . CUP 88-021 August 23, 1988 Page 2 . Parking and Landscaping There are no marked parking spaces on the site. The applicant is proposing to provide eleven parking spaces 10 of the spaces are 9' x 19' and one parallel parking space is 10' x 20'. Code requires 45 degree and 90 degree spaces to be 9' x 20'; parallel parking stalls must be 10' x 24'. Based upon the lot size and available parking area, all parking can be designed to comply with code. No additional landscaping is proposed on the site. The existing planters all have shrubs and some flowers, however, they are in need of minor maintenance. ANALYSIS It is staff's opinion that the proposed changes to the station would be an appropriate improvement to the site. The location of the drive-through car wash should not interfere with on-site circulation and will not impact on-site parking. Staff would recommend that as part of the remodeling that the building be painted a less striking color similar to other recently remodeled shell stations, i.e., gray tones, off-white, etc. approved by the Planning Department. . All parking shall comply with the City's requirements relating to size, striping, etc. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. SPECIAL INFORMATION The Public Works Department has reviewed the application and has no comments. The Fire Department has indicated that a fire hydrant shall be required along the east property line. RECOMMENDATION The Planning Department recommends approval of C.U.P. 88-021 subject to the following conditions: . 1. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
