HomeMy WebLinkAbout1385 . PLANNING COMMISSION RESOLUTION 1385 A RESOLUTION GRANTING CONDmONAL USE PERMIT 88-020 TO EXPAND AN EXISTING AUTOMOBILE GARAGE AT 333 NORTH FIRST AVENUE. WHEREAS, on July 12, 1988 an application was filed by Mr. Robert A. Ruiz to expand an existing automobile garage, Planning Department Case No. C.U.P. 88-020, on property commonly known as 333 North First Avenue, more particularly described as follows: Lot 18 in Block 80 of Arcadia Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 15, Pages 89-90 of maps, in the office of the said County Recorder. WHEREAS, a public hearing was held on August 9, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF . ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. . 1385 -1- . . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to expand an existing automobile garage upon the following conditions: 1. That the following conditions from the Department of Public shall be complied with to the satisfaction of the Director of Public works: A. Submit grading and drainage plan prepared by a registered civil engineer subject to he approval of the Director of Public Works. B. Plant parkway trees at locations determined by the Director of Public Works per City of Arcadia Standard 5-13. C. Construct P.C.C. sidewalk, as per City Standard. D. Gravity drainage outlets, and driveway aprons shall be constructed to conform to Drawing 5-11. E. Construct P.c.c. driveway apron according to Arcadia Standard Drawing No. 5-11. F. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense. 2. Fire protection and building occupancy shall be maintained to the satisfaction of the Fire and Building Departments. 3. Any change in water service shall be installed by the Arcadia Water Division at the applicant's expense. 4. All work for the automotive garage shall be done inside the building. 5. Auto body painting and auto body work shall be prohibited. 6. No vehicles shall be parked on the premises which are offered for sale, lease or rent. 7. The gate along La Porte Street shall remain open during business hours to permit access by patrons into the parking lot. 8. All signs shall be subject to a separate Architectural Design Review. A can wall sign will not be permitted. 9. Approval of CUP 88-020 shall be subject to the applicant receiving Design Review approval from the Arcadia Redevelopment Agency. 1385 -2- . . . 10. Modifications shall be granted for the following: A. Zero front yard setback in lieu of 10'-0" for existing building (9266.2.2). B. Stucco finish to masonry walls would be acceptable in lieu of decorative block. Colors to match building. 13. Masonry wall with wrought iron along La Porte Street shall consist of decorative block. Stucco finish to masonry wall would be acceptable in lieu of decorative block. Colors to match building. 14. The subject site shall be maintained as per the plans on file in the Planning Department. 15. That C.u.P. 88-020 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 16. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 9, 1988 and the following vote: A YES: Commissioners Amato, Oark, Hedlund, Szany, Papay NOES: None ABSENT: None 1385 -3- . . . Ruiz to expand the existing automobile garage at 333 North First Avenue. The Planning Department is recommending approval subject to the conditions outlined in the report. GENERAL INFORMATION APPLICANT: Robert A. Ruiz LOCATION: 333 North First Avenue REQUEST: Conditional Use Permit to expand an existing automobile garage with the following modifications: A. Zero front yard setback in lieu of 10'-0" for existing building (9266.2.2). B. Reduction of a portion of the required landscaping between the parking lot and La Porte Street. Also, deletion of the 3% landscaping within the parking lot (9269.13.B). LOT AREA: Approximately 7,050 square feet (.16 acre) FRONTAGE: 50 feet on First Avenue 141.69 feet on La Porte Street EXISTING LAND USE & ZONING: Automotive garage; zoned M-l . . . SURROUNDING LAND USE & ZONING: North: South: East: West: Industrial; zoned M-l Commercial and industrial; zoned M-l Automotive garages; zoned M-l Industrial; zoned M-l GENERAL PLAN DESIGNATION: Industrial HISTORY Building permits show that in 1958 a store building and a dwelling were built on the subject site. Since 1978 Howard's Tire and Battery has been in business in the front half of the building and a residential dwelling was located in the rear half. The applicant has discontinued using the dwelling. Presently, there is no landscaping, striped parking lot or trash enclosure. On January 13, 1987 the Planning Commission voted 7 to 0 to approve CUP 86-17, a request to operate an automotive garage at 333 North First Avenue. The applicant had proposed to expand the garage into the area which the dwelling occupied, eliminating a nonconforming use. A portion of the roof was to have been raised from 9'-0" to 14'-0" to make servicing vehicles easier. Other remodeling would have included paving the City parkway, planting street trees and on-site landscaping to buffer the parking lot, relocating a telephone pole guy wire to allow for a new driveway, paving and striping the parking lot, building a block wall with wrought iron fencing along La Porte Street, providing for a trash enclosure and adding a new mansard roof. Modifications were granted for an existing zero front yard setback in lieu of 10'-0" and a partial reduction of landscaping along La Porte Street. On April 28, 1987 the Planning Commission voted 6 to 0 with one member absent to approve CUP 87-7, a request to construct a new two-story 2,896 square foot automotive garage at the subject site. A modification was granted for a portion of the garage to have a zero street side yard setback along La Porte Street in lieu of 10'-0". PROPOSAL AND ANALYSIS The applicant's plot plan is basically the same as proposed for CUP 86-17. Instead of keeping the rear portion of the building and converting it into part of the garage, this part of the building will be demolished and a new building built at approximately the same location. Also, the exterior facade of the building has been changed from concrete block with a mansard roof to a wood framed building with a stucco exterior. c.u.p, 88-020 8/9/88 Page 2 . . . When comparing CUP 86-17 with CUP 88-020, the site improvements are basically the same. These improvements will include paving the City parkway, planting street trees and on-site landscaping, a new driveway, paving and striping the lot, building a block wall with wrought iron along La Porte Street and providing a trash enclosure. It is the Planning Department's opinion that the proposal can be accommodated on the lot as long as the business does not include auto body painting or auto body work. These activities require vehicles to be stored on the premises for longer periods of time, which would eliminate on-site parking spaces for employees and patrons. A garage that does auto body painting or auto body work should have a separate parking lot used exclusively for the storage of vehicles. The subject site is not large enough to accommodate painting or body work. Staff has no objection to the dispensing of tires, batteries, oil and accessories; tuning of motors, wheel and brake adjustment and other repairs and services. An automotive garage is a permitted use in the M-l zone with an approved conditional use permit. Approval of this conditional use permit would allow for a substantial upgrading of the property. The proposal would be consistent with the zoning and general plan for the area. Since this proposal is within the boundaries of the Arcadia Redevelopment Agency, Design Review will also be required before the Redevelopment Agency before issuance of any building permits. One letter in opposition has been received (copy attached). Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ARCHITECTURAL DESIGN REVIEW Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. Staff believes that the applicant's proposal complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. The design elements (materials and colors) of the building provide the necessary visual break up of the walls. The design and materials used for the project will be harmonious with the surrounding developments. C.u.P.88-020 8/9/88 Page 3 . . . A separate Architectural Design Review application will be required for any signs. Staff is not in favor of the proposed orange (paprika) color to be used for the wall signs. The color of the sign should be one of the colors used on the building. Blue (deep pool), dark brown (sequoia) or bone white should be used for any sign. Also, a can wall sign will not be acceptable. RECOMMENDATION The Planning Department recommends approval of CUP 88-020 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. Fire protection and building occupancy shall be maintained to the satisfaction of the Arcadia Fire and Building Departments. 3. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve Conditional Use Permit 88-020, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny Conditional Use Permit 88-020, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supporting findings. .
