HomeMy WebLinkAbout1384 . PLANNING COMMISSION RESOLUTION 1384 A RESOLUTION GRANTING CONDmONAL USE PERMIT 88-019 TO OPERATE A RESTAURANT AT 536-600 WEST LAS TUNAS DRIVE. WHEREAS, on July 8, 1988 an application was filed by Mr. Terry Kuo to operate a restaurant, Planning Department Case No. C.U.P. 88-019, on property commonly known as 536-600 West Las Tunas Drive, more particularly described as follows: SEE EXlllBIT "A" WHEREAS, a public hearing was held on August 9,1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. . Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parkin~ loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional . Use Permit to operate a restaurant upon the following conditions: 1384 -1- . . . 1. That the following conditions from the Department of Public shall be complied with to the satisfaction of the Director of Public works: A. Submit grading and drainage plan prepared by a registered civil engineer subject to he approval of the Director of Public Works. B. Driveway on Baldwin Avenue shall be located so as not to conflict with mature parkway trees. C. Close existing driveways not to be used and reconstruct curb, gutter and sidewalk to match existing. D. Remove and replace deficient or damaged curb, gutter or sidewalk. E. Construct P.c.c. driveway apron according to Arcadia Standard Drawing No. 5-11. F. All public works improvements shall be completed to the satisfaction of Director of Public Works prior to final acceptance by Building and Safety Department and prior to occupancy. G. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the permittee and shall be at the permittee's expense. 2. Fire protection shall be provided to the satisfaction of the Fire Department. This may include a central station fire alarm system per NFPA standards #71 and fire sprinklers. 3. Water service shall conform to the Uniform Plumbing Code and new water service shall be installed by the Arcadia Water Division upon the request and payment of fees by the developer. 4. All walls shall be decorative block or finished with stucco. This shall be subject to the approval of the Planning Department. 5. Trash enclosure shall consist of solid metal gates. Color to match the building. 6. That a covenant holding the lots as one parcel shall be recorded prior to the issuance of building permits. Said covenant shall be subject to the approval of the City Attorney and Planning Department. 7. Pinal landscape plan shall be subject to the approval of the Planning Department. 1384 -2- . . . 8. Architectural Design Review applications will be required for all signs. Can or box signs shall be prohibited. Any free-standing sign shall have a pedestal or base, or if supported by a pole, a decorative cover shall be provided to give the appearance of a pedestal or base. 9. All landscape areas shall be surrounded by a 6 inch high continuous concrete curbing. 10. Deliveries of wares, merchandise, crates, bottles and similar items to the site occupied by the restaurant and mixed use commercial building shall be prohibited between the hours of 7:00 p.m. and 7:00 a.m. 11. Approval of CUP 88-019 does not approve the other uses shown on the applicants' plans. Said uses were only used as examples. 12. CUP 88-019 remains subject to the imposition of business hour requirements if reports and complaints warrant the consideration of such a condition. No such condition shall be applied until a noticed public hearing has been conducted. The Planning Commission retains continuing jurisdiction concerning business hours. 13. The subject site shall be maintained as per the plans on file in the Planning Department. 14. That c.u.P. 88-019 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 15. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 9, 1988 and the following vote: A YES: Commissioners Amato, Oark, Hedlund, Szany, Papay NOES: None ABSENT: None 1384 -3- . . . Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. The Captain's Broiler Restaurant, built in 1957, is presently located at 600 West Las Tunas Drive. The restaurant contains approximately 4,800 square feet with a 576 square foot outdoor storage area. The property at 536-554 West Las Tunas is presently used as a parking lot. CUP 88-19 August 9, 1988 Page 1 . . . On July 13, 1982 the Planning Commission approved CUP 82-9 for a 21,128 square foot two-story office at 536 and 554 West Las Tunas Drive. This project was never completed. On July 26, 1988 the Modification Committee approved MC 88-62 a request for a two- story mixed use commercial building at 536-600 West Las Tunas with the following modifica tions: A. Zero easterly side yard setback in lieu of 29'-0" where building will abut a residentially zoned (PR-l) property which will be used for parking. (9263.2.3.b: 10'-0" min. and angle of 45 degrees). B. Windows and open corridor along east elevation of building which will abut a residentially zoned (PR-l) property. Nearest residentially developed property from east side of building will be 75'-0" away (9263.2.6). C. 113 parking spaces in lieu of 114 (9269.5). The first floor of the building will consist of 7,974 square feet of retail space and the second floor will contain 6,090 square feet of general office space. Code sections 9263.2.3.b and 9263.2.6 were established to limit the impacts a commercial development will have upon a residential use. In this case there is no adjacent residential use since the residentially zoned lot (PR-l) will be used for parking. The 75 foot width of the PR-l zoned lot along with the proposed landscaping will provide adequate separation and screening from the nearest residential use which is a pre-school. PROPOSAL Building The applicant is proposing to clear the site and construct the above described 14,064 square foot mixed use commercial building (MC 88-62) and a 5,000 square foot restaurant. The user of the restaurant has not been determined at this time. The height of most of the restaurant will be approximately 17'-0" while the front part of the building will be 26'-0" (3 stories 40'-0" max.) Both buildings will be of the same architectural style. Exterior treatment will consist of peach color stucco with a paprika metal roof and brown (sienna) metal trim. Awnings will be used along the east elevation of the restaurant. Each building will have their own trash enclosure and loading space. The restaurant will have a 142'-0" front yard setback and a 75'-0" rear yard setback. The main entrance to the restaurant will face Las Tunas Drive. CUP 88-19 August 9, 1988 Page 2 . Parking Staff believes the parking layout is well designed. Parking spaces can be found around each building and the design will encourage patrons to use the lot instead of parking on the street, which is important since Las Tunas Drive is residential to the east of the site. There will be 92 standard size spaces and 21 compact spaces (22 max.). Steppingstones will be used to cross the landscaped area between parking spaces 28-49 and the mixed commercial building. Wheel stops will hardly be used on the site since most of the spaces abut a landscaped area where the concrete curbing has been extended to replace the wheel stops. Two 25'-0" wide driveways will provide access to the site. Stamped concrete will be placed at the entrance of each driveway and throughout the project. Landscaping . The C-2 zone requires 5% (2,253 sq. ft.) of the parking lot to be landscaped which does not include required landscaping along the street and between the parking lot and residential lots. A total of 9,266 square feet of landscaping will be provided or 14% of the lot. There will be 3,320 sq. ft. (7.4%) within the parking lot, 3,285 sq. ft. along the property lines and 2,661 sq. ft. under the car overhangs. A minimum of 23 trees will be planted on the site, 16 trees will be 24" box and the remainder will be 15 gallon. Fifteen gallon shrubs will be used along with 24" box trees to buffer the parking lot from the the R-l zoned lots. Signs All signs will be need a separate Architectural Design Review application. As part of MC 88-62 two conditions of approval were placed on signs: 1. Can or box signs shall be prohibited. 2. Any free-standing sign shall have a pedestal or base, or if supported by a pole, a decorative cover shall be provided to give the appearance of a pedestal or base. ANALYSIS . A restaurant is a permitted use in the C-2 zone with an approved conditional use permit. The proposal either meets or exceeds all code requirements except for the modifications granted by MC 88-62 which were found to be minor. CUP 88-19 August 9,1988 Page 3 . . . The new restaurant is similar in size to the existing restaurant which will be demolished. The project would be consistent with the Zoning Ordinance and General Plan. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ARCffiTECTURAL DESIGN REVIEW Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. Staff believes that the applicant's proposal complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. The design elements (materials, colors, covered corridors and awnings) of the building provide the necessary visual break up of the walls. The design and materials used for the project will be harmonious with the surrounding developments. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 88-19 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with the satisfaction of the Director of Public Works. 2. Fire protection shall be provided to the satisfaction of the Fire Department. This may include a central station fire alarm system per NFP A standards #71 and fire sprinklers. 3. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
