A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-016
TO EXPAND THE SEATING AT AN EXISTING EATING
ESTABLISHMENT FROM 12 TO 32 PERSONS AT 46 WEST LAS
TIJNAS DRIVE.
WHEREAS, on June 6, 1988 an application was filed by Poseidon
Foods, Inc. dba Burger Palace to expand the seating at the existing eating
establishment from 12 to 32 persons, Planning Department Case No. C.U.P.
88-016, on property commonly described as 46 West Las Tunas Drive,
more particularly described as follows:

WHEREAS, a public hearing was held on July 26, 1988, at which time
all interested persons were given full opportunity to be heard and to
present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOL YES AS FOLLOWS:
Section I. That the factual data submitted by the Planning
Department in the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is proper use
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape
to accommodate said use. All yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the
land and uses in the neighborhood.

4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed lIse.
5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse
impact on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to expand the seating at the existing eating
establishment from 12 to 32 persons, upon the following conditions:
1. Seating shall be limited to a maximum of thirty-two (32)
persons.
2. Fire protection and building occupancy shall be maintained to
the satisfaction of the Fire Department.
3. Any change in water service shall be installed by the Arcadia
Water Division at the applicant's expense.
4. The subject site shall be maintained as per the plans on file in
the Planning Department.
5. That C.U.P. 88-016 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.
6. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for the immediate
suspension or revocation of said permit.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of July 26, 1988 and the
following vote:

SUMMARY
This Conditional Use Permit application was filed Poseidon Foods, Inc. (DBA Burger
Palace) to expand the existing eating establishment so that seating could be increased
from 12 to 32 persons at 46 West Las Tunas Drive.

. GENERAL PLAN DESIGNATION:

BACKGROUND
In developing this commercial center, Modification M-84-77 was granted on July 10,
1984 to permit 58 parking spaces in lieu of 63 spaces. It was determined that the
property was unique since it was like an "island" with frontage on both Las Tunas
Drive and Live Oak Avenue, and with only one abutting commercial lot. This lot
therefore has more than the normal street parking available to it. Uses in this retail
center are as follows:

On October 28,1986 the Planning Commission granted c.u.P. 86-10 to permit opera-
tion of the 906 square foot, 12 seat, eating establishment (Donut Lady) with a modifi-
cation for 58 parking spaces in lieu of 77 spaces. The parking modification was only
for the use approved by c.u.P. 86-10 and was not a general reduction in parking for
the entire center.
On June 23,1987 c.u.P. 87-11 was approved for a 1,682 square foot, 12 seat, eating
establishment (Burger Palace) with a modification for 58 parking spaces in lieu of
102 spaces. This modification was only for the use approved by C.U.P. 87-11.
On May 24, 1988 C.U.P. 88-013 was approved for a 1,682 square foot, 8 seat, eating
establishment (pizza) with a modification for 58 parking spaces in lieu of 124. This
modification was only for the use approved by C.u.P. 88-013.
A site inspection by the Planning Department found seating for 32 persons at 46 W.
Las Tunas (Burger Palace). On May 11, 1988 the Planning Department informed the
applicant that they were in violation of C.U.P. 87-11.

PROPOSAL AND ANALYSIS
The applicant is requesting a conditional use permit to expand the existing eating
establishment so that seating could be increased from 12 to 32 persons. Seating for
12 persons was previously approved by C.U.P. 87-11, so increasing the tables and
chairs requires a conditional use permit. The eating establishment contains 1,682
square feet and is part of a 12,552 square foot retail center with 58 parking spaces.
Since 1982 there have been 15 conditional use permits approved for eating
establishment with limited seating. In most cases the Planning Department has
recommended that the maximum seating be limited to 12 persons. By restricting
the seating within these eating establishments the Planning Department feels the
parking requirement for a retail business of 5 spaces per 1,000 square feet is adequate.
The parking requirement for an eating establishment with no seating limitation,
other than those established by the Fire or Building Departments, would require 20
spaces per 1,000 square feet of gross floor area. It is the Planning Department's
opinion that seating for more than 12 persons no longer qualifies the eating
establishment to remain under the retail parking standard.

Note that a conditional use permit goes with the land and not the owner of the
business. Once approved the business can be sold to any type of eating
establishment. Only once has the City spelled out the type of food the business shall
sale (C.U.P. 86-13, donuts only). By limiting the seating to a low number the
business is more likely to have a local patronage. Increasing the seating makes the
business more suitable for chain type eating establishments.
When the eating establishment at 54 W. Las Tunas (pizza) opens there will be a total
seating for 32 persons on the site. Approval of this request would increase the total
seating to 52 persons for the site. Also, there is still one vacant store of 1,100 square
feet.
Pursuant to the provisions of the California Environmental Quality Act, the Plan-
ning Department has prepared an initial study for the proposed project. Said initial
study did not disclose any substantial or potentially substantial adverse change in
any of the physical conditions within the area affected by the project including land,
air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic
significance. Therefore, a Negative Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends denial of Conditional Use Permit 88-016.
If the Planning Commission approves Conditional Use Permit 88-016, the Planning
. Department recommends the following conditions of approval:

1.

FINDINGS AND MOTIONS
. Approval
If the Planning Commission intends to take action to approve Conditional Use Permit
88-016, the Commission should move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the environment and
direct staff to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report, or as modified by the Commission.
Denial
If the Planning Commission intends to take action to deny Conditional Use Permit
88-016, the Commission should move to deny and direct staff to prepare an
appropriate resolution incorporating the Commission's decision and supporting
findings.
