HomeMy WebLinkAbout1379 . . . PLANNING COMMISSION RESOLUTION NO. 1379 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-015 TO OPERATE AN EATING ESTABLISHMENT AT 156 WEST LAS TUNAS DRIVE. WHEREAS, on May 25, 1988, an application was filed by Ingeborg Hellwig to operate an eating establishment, Planning Department Case No. c.u.P. 88-015, on property commonly known as 156 West Las Tunas Drive, more particularly described as follows: SEE EXHIBIT "A" WHEREAS, a public hearing was held on June 28, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, lHEREFORE, lHE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit wi1l not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons this Commission grants a - 1 - 1379 . . . Conditional Use Permit to operate an eating establishment upon the following conditions: 1. Seating shall be limited to a maximum of twelve (12) persons. 2. A modification shall be granted for 70 parking spaces in lieu of 107 spaces. This shall only be for the use approved by C.U.P. 88-015, and not constitute a general reduction in parking for the total site. 3. A modification shall be granted for no on-site landscaping in lieu of 1,900 square feet. This shall only be for the use approved by c.u.P. 88-015, and not for any other new or changed uses on the site. 4. That the existing parkway landscape areas be planted, maintained and kept clear of litter and debris in accordance with AMC Sec. 9405. A landscape and irrigation plan for the southerly parkway shall be submitted to the Planning Department for review and approval prior to its being planted. 5. That the applicant's southerly sign be repaired, and that any new signs for the proposed business shall be subject to Architectural Design Review. 6. The subject site shall be maintained as per the plans on file in the Plan- ning Department. This includes, but is not limited to, the parking striping plan. The entire parking lot shall be striped in accordance with the AMC Sec. 9269.8 (Marking of Spaces) 7. That all the conditions of approval of C.u.P. 88-015 be complied with prior to the installation of the seating. 8. That C.U.P. 88-015 shall not take effect until the property owner and applicant have executed the form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 9. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 28, 1988 and the following vote: AYES: Commissioners Clark, Hedlund, Papay and Szany NOES: None ABSENT: Commissioner Amato SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. - 2- 1379 . . . Kasama, Assistant Planner CASE NO.: C.u.P. 88-015 SLtv1MARY This Conditional Use Permit and Modification application was filed by Ingeborg Hellwig to operate a delicatessen with seating for twelve (12) persons at 156 West Las Tunas Drive. The Planning Department is recommending approval sub- ject to the conditions listed in this report. ~ TOTAL SITE AREA: Approximately 63,000 square feet (1.45 acres) FRONTAGE: 146.16 feet along Las Tunas Drive 213.92 feet along Live Oak Avenue EXISTING lAND USE & ZONING: Three retail buildings totaling 15,371 sq. ft. and an auto repair center with three buildings totaling 795 sq. ft. The zoning is C-1 (Limited Commercial) SURROUNDING LAND USE & ZONING: North: S-F residences & Prof. offices, zoned R-1 & CoO South: Light industrial & commercial uses, zoned CoM East: LACFCD Wash & Auto repair center, zoned CoM West: Bowling alley, zoned C-1 GENERAL PLAN DESIGNATION: C - Commercial . . . PROPOSAL AND ANALYSIS The applicant is requesting a conditional use permit, and parking and landscaping modifications to operate an eating establishment (delicatessen) with tables and seating for twelve (12) persons. The applicant is currently operating a retail (food-to-go only) delicatessen. By adding tables and chairs to the business, it changes from a retail activity to an eating establishment which requires a con- ditional use permit. The change in use also requires that parking and landscaping be brought into compliance with current standards. The eating establishment will contain 1,640 square feet and is part of a 12,716 square foot retail building. This center is located on a through lot with frontage on both Las Tunas Drive and Live Oak Avenue, and has street parking available on both streets. Other uses in this retail center are as follows: Tyoe of Use Liquor Store Market Proposed Eating Establishment Vacant Space Spice Shop Tile Shop Muffler Shoo (3 bldQsJ Total Sa Footaoe 1,855 9,596 1,640 (12 seats) 1,480 400 400 795 16,166 There are presently 54 parking spaces on-site, and the proposal calls far new striping which will provide a new total of 70 spaces. The parking modification is for 70 spaces in lieu of 107. Since 1982 there have been 15 conditional use permits granted for similar types of uses throughout the City and as of this date we have not had any complaints, nor has staff observed any parking space problems caused by the operation of these small eating establishments, By restricting the seating within these eating establishments the Planning Department feels the retail parking requirement of 5 spaces per 1,000 square feet is adequate. The limited seating is not detrimental to the site or sur- rounding properties, and is a convenience for the customers. Staff has not C.U.P. 88-015 6/28/88 Page 2 . . . observed, nor been informed of any parking problem at this center, and it is not anticipated that the proposed eating establishment will generate an excessive parking demand. There is presently no landscaping on the site and the Code requires landscaping of 5 percent of the parking area. Requiring the installation of new landscape planters would be an overly burdensome condition for the minor change in use requested by the applicant. Therefore, the landscape modification is for no on- site landscaping in lieu of 1,900 square feet. There are, however, areas in the adjacent parkways for landscaping. The area in the northerly parkway is ade- quately landscaped and maintained. The southerly parkway is bare except for one bush. These parkway landscape areas are required by Code (AMC Sec. 9405) to be planted and maintained. Remedy of this situation should be a condition of approval. Pursuant to the provIsIons of the California Environmental Quality Act, the Plan- ning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions wit.hin the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. R~DATION The Planning Department recommends approval of Conditional Use Permit No. 88-015 subject to the following conditions: 1. Seating shall be limited to a maximum of twelve (12) persons. 2. A modification shall be granted for 70 parking spaces in lieu of 107 spaces. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve Conditional Use Permit No. 88-015, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission.
