HomeMy WebLinkAbout1377 .,. . - PLANNING COMMISSION RESOLUTION 1377 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88- 012 TO OPERATE A RESTAURANT AT 181 COLORADO PLACE. WHEREAS, on May 2, 1988 an application was filed by Ray F. Sibille to operate a restaurant, Planning Department Case NO. C.D.P. 88-012, on property commonly known as 181 Colorado Place, more particularly described as follows: SEE EXlllBIT "A" WHEREAS, a public hearing was held on June 14, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THERFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: I. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 1377 - 1 - . . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit operate a restaurant subject to the following conditions: I. Except for gratuity, valet parking shall be provided free to all patrons during all business hours. Signs shall be posted informing the public of free valet parking. The signs' number, location, size, color and print shall be subject to the approval of the Planning Department. Also, a tandem parking plan for the valet parking shall be submitted to the Planning Department for review and approval. 2. If ftee valet parking is not possible per condition number 1, the applicant shall provide 12 additional parking spaces per A.M.C. Section 9269.6. Before any parking spaces are used on a site other than 181 Colorado Place a revision to Conditional Use Permit 88-012 shall be filed to include the additional site. The appropriate plans, fees and application shall be filed. Note that either the free valet parking or the covenant per A.M.C, Section 9269.6.6 shall be completed prior to the opening of the restaurant. 3. The following conditions from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. A. B. c D. E Remove nonconforming curb, gutter and drive apron on Colorado Place adjacent to San Juan Drive. Construct P.C.C. curb, gutter and driveway apron according to Arcadia Standard Drawing No. S-I1. Plant parkway trees at locations determined by the Director of Public Works per City of Arcadia Standard S-13. Remove and replace deficient or damaged curb, gutter or sidewalk. All survey monuments, centerline ties and survey reference points shall be protected in place or re- established where disturbed. This work will be the 1377 -2- . . . responsibility of the permittee and shall be at the permittee's expense. 4. Fire protection shall be provided to the satisfaction of the Fire Department. This shall include upgrading the fire hydrant, a supervised central station fire alarm system and an automatic fire suppression system in the kitchen over cooking surfaces. Hydrant upgrade and fire alarm system may be omitted if building is fully fire sprinkled. 5. Water service shall conform to the Uniform Plumbing Code and new water service shall be installed by the Arcadia Water Division upon the request and payment of fees by the developer. 6. Design Review approval shall be obtained from the Arcadia Redevelopment Agency prior to issuance of any building permits. 7. Any new walls or fences shall be of decorative block or finished with stucco. This shall be subject to the approval of the Planning Department. 8. The entrance canopy along San Juan Drive shall be eliminated unless approval can be obtained from the Public Works Department. 9. Final site plan shall be subject to the approval of the Planning Department. All wheel stops of parking spaces adjacent to a landscaped area shall be eliminated and said landscaped area extended with 6" high continuous concrete curbing, parking spaces I through 5 shall be shortened to provide additional landscaping and paving materials that are textured and color shall be used at the entrance of each driveway and throughout the parking lot. 10. Final landscape plan shall be subject to the approval of the Planning Department. I 1 . Architectural Design Review applications will be required for the entrance canopy and all signs. 12. Hours of operation for the restaurant and cocktail lounge shall be limited to I I :00 a.m. to 12:00 midnight. 13. That a modification be granted for 9 compact spaces in lieu fo 7 maximum. 1377 - 3- . . . 14. The subject site shall be maintained as per the plans on file in the Planning Department. 15. That C.U.P. 88-012 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 16. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. Section 4. The decision, findings and conditions contained III this Resolution reflect the Commission's action of June 14, 1988 and the following vote: AYES: Commissioners Clark, Hedlund, Papay, Szany NOES: None ABSENT: Commissioner Amato Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Commercial BACKGROUND The restaurant was contructed in 1953 prior to the requirement of a conditional use permit, which made it a nonconforming use. In 1975 a variance (V -75- 3) was granted permitting the restaurant to use a portion of the Santa Anita Race Track parking lot. Since the restaurant has been closed for more than 90 days, a restaurant cannot reopen without an approved conditional use permit. The cessation from the active participation in a nonconforming use for a period in excess of 90 days constitutes the abandonment of such nonconforming use (AM.C. Se<:tion 9248). PROPOSAL AND ANALYSIS The applicant is proposing to reopen the restaurant which will also contain a cocktai1lounge. No additional square footage will be constructed. The exterior will be remodeled with additonal canyon stone at the entrance, new . stucco finish, repainting and a new white rock roof. Except along the south side of the building, a new concrete walkway with used brick pavers will provide access into the restaurant from the parking lot. A new trash enclosure will also be built. . The parking lot has been redesigned to prOVide for 38 parking spaces in lieu of 50 spaces required. Since residential properties are within 60 feet of the sUbject. site, staff believes that the site should comply with the required parking to mjnjmj~ the impact upon the residential streets. It is staff's understanding that the applicant has had dis<:ussions with the California Thoroughbred Breeders Association about using their parking lot at 201 Colorado Place which would be acceptable under AM.C. Section 9269.6, but woud require the recordation of a covenant requiring the use of such parking spaces as long as the restaurant is in business. .. C.UP.88-012 6/14/88 Page 2 " . Before the parking lot at 201 Colorado Place or any other location is used to provide additional off -street parking for the restaurant, a revision to CUP a8-0 12 would be required (new hearing before the Pl~nning Commission). A decision on the use of 201 Colorado Place for additional parking cannot take place at tonight's meeting t>e<:ause public bearing notices were not mailed to property owners within 300 feet of 201 Colorado Place informing them of the proposal. If the applicant wishes to pursue this alternative, the Commission can continue the public hearing to July 12, 1988 so that proper noticing can take place. Another alternative would be for the restaurant to provide free valet parking during all business hours. This would permit tandem parking and better utilization of the parking lot The valet parking should be at no cost to the patron, except for gratuity, so that patrons wanting to avoid paying to park are not forced into the residential streets. UtiliZing valet parking should allow the parking area to accomodate the 50 vehicles required. The P1~nning Department feels the request to 9 compact spaces in lieu of 7 maximum is minor. . Since this proposal is within the boundries'of the Arcadia Redevelopment Agency, Design Review will also be required before the Redevelopement Agency for the remodeling of the building and site improvements. Note that the plan requires several corrections. The entrance canopy along san Juan Drive is within the public right-of-way, all Wheel stops of parking spaces (1-29) adjacent to a landscaped area shall be eliminated and said landscaped area extended, parking spaces 1 through 5 shall be shortened to provide additional landscaping and paving materials that are textured and colored shall be used at the entrance of each driveway and throughout the parking lot. Also, separate Architectural Design Review applications will be required for the canopy and all signs. Pursuant to the provisions of the California Environmental Quality Act. the Pl~nning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse clIl1nge in any of the physical conditions within the area affected by the project including land, air, water, minerals, nora, fauna. ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration bas been prepared for this project. . C.UP.88-0l2 6/14/88 Page 3 ~ AR.CHlTECTURAL..DESIGN REVIEW . Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or deny the applicant's design concept plans. Staff believes that the applicant's proposal complies with the intent of the design criteria set forth in the City's Architectural Design Review Regulations. The design elements (materials and colors) of the building provide the necessary visual break up of the walls. The design and materials used for the project will be harmonious with the surrounding developments. RECO~ATlON The Planning Department recommends approval of Conditional Use Permit 88-012 subject to the following conditions: . 1. FINDINGS AND MOTIONS ADprOVal If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report or as modified by the Commission. . Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. . The existing parkway widths are twelve (12) feet on Colorado Place and twelve {12} feet on San Juan Drive. 2. The subject property is served by a sewer 1 ine that is tributary to a deficient City trunk sewer line. However, based on past charges paid by the property owner and considering the future charges that will be paid, in time these payments will provide the property's share of the costs necessary for taking care of downstream sewer line deficiencies. This department has reviewed the subject CUP and reconunends the following conditions of approval: 1. Remove nonconforming curb, gutter and drive apron on Colorado Place adjacent to San Juan Drive. 2. Construct P.C.C. curb, gutter and driveway apron according to Arcadia Standard Drawing No. S-ll. 3.
