PLANNING COMMISSION RESOLUTION 1376 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-014 TO EXPAND THE EXISTING RESTAURANT TO ALLOW OUTDOOR DINING IN THE PATIO AREA AND RELATED PARKING AND LANDSCAPING MODIFICATIONS AT 200 EAST FOOTHILL BOULEY ARD. WHEREAS, on May 19, 1988 an application was filed by Lee Hammond and Gary Barringer to expand the existing restaurant to allow outdoor dining in the patio area and related parking and landscaping modifications, Planning Department Case NO. C.U.P. 88-014, on property commonly known as 200 E. Foothill Boulevard, more particularly described as follows: Lots 14, 15 and 16, Block "F", of Tract No. 7723 , in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 93, Page 41 of said Maps in the office of said County Recorder. . . WHEREAS, a public hearing was held on June 14, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THERFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 1376 - 1 - . 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Pennit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to expand the existing restaurant to allow outdoor dining in the patio area and related parking and landscaping modifications upon the following conditions: 1 . That two trees shall be provided in the landscaped areas located in the easterly parking lot. Said trees shall be planted prior to utilization of the patio area for dining. 2. That a landscape plan shall be submitted for review and approval by the Planning Department for the parkway area adjacent to the easterly parking lot. Said area shall be landscaped prior to utilization of the patio area for dining. 3. That fire safety shall be provided to the satisfaction of the Fire Department and that the applicants shall secure written approval from the Fire Department prior to utilization of the patio area for dining. 4. A covenant in a fonn and content approved by the City Attorney shall be filed prior to utilization of the patio area for dining, which provides that the owners shall maintain the easterly parking area for the restaurant use. 5. That C.U.P. 88-014 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 6. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. . . 1376 -2- Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 14, 1988 and the following vote: AYES: Commissioners Clark, Hedlund, Papay, Szany NOPS: None ABSENT: Commissioner Amato Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. BUTLER, SENIOR PLANNER CASE NO,: C.U.P. 88- 014 SUMMARY The applicants are requesting a conditional use permit to allow outdoor dining for 16 persons in the patio area at Paco's Restaurant located at 200 East Foothill Boulevard. The Planning Department is recommending approval subject to the conditions outlined in this report. GENERAL INFORMATION APPLICANT: . WCATION: REQUEST: WT AREA: FRONTAGE: Lee Hammond and Gary Barringer 200 East Foothill Boulevard Conditional use permit to expand the existing restaurant to allow outdoor dining in the patio area and related parking and landscaping modifications. 13,979 sq. ft. 132+ feet on Foothill Boulevard and 105+ feet on Second Avenue EXISTING LAND USE & ZONING: The site is developed with Paco's Restaurant; zoned C-2 SURROUNDING LAND USE & ZONING: North: South: East: West: . Developed with Ralph's shopping center; zoned C-2 &D Developed with single-family dwellings; zoned R-l Developed with a single-family dwelling and commercial uses; zoned C-2 Developed with mixed commercial uses; zoned C-2 CUP 88-014 June 14, 1988 Page 1 . GENERAL PLAN DESIGNATION: General Commercial BACKGROUND The existing restaurant has been located on the site since 1949. In April, 1980. the Planning Commission approved conditional use permit 80-4 to expand and remodel the existing restaurant (La Pinata). This remodel Included enlarging the restaurant by adding 492 sq. ft. of office and storage space. enlarging the women's restroom. extending the patio cover over the existing patio area to allow for outside dining and improving the property to the east with a parking lot. This project was never commenced and the C.U.P. expired. The current property owners bought the property In May. 1986 and opened Paco's Restaurant, In April, 1987. the owners constructed a parking lot on the property to the east of the restaurant. . PROPOSAL AND ANALYSIS The existing restaurant contains 3.217 square feet and has seating for 96 people. The applicants are proposing to utilize the outdoor patio area (481 square feet) for dining with seating for 16 people. Based upon code requirements 38 parking spaces would be required for the restaurant. There are 24 on-site parking spaces. The easterly parking area complies with code In terms of landscape area, however. there are no trees In planter areas. The original plans Indicated one tree In each of the planter areas. The Foothill parkway area adjacent to this parking area is not well maintained and should be replanted. The westerly parking area does not comply with the follOwing code requirements: 1. 5% of the interior parking area shall be landscaped. and . CUP 88-014 June 14. 1988 Page 2 . 2. A 5'-0" landscape buffer Is required between the parking area and the street (Second Avenue) It Is stafi's opinion that although the parking does not comply with code. the additional seating In the patio area will not Increase the parking demand on the site. Also. although on-street parking cannot be utilized In conSidering the number of parking spaces provided for a project. there is a significant amount of on-street parking along both Second Avenue and Foothill Boulevard. Although the landscaping in the westerly parking lot does not comply with code. If the applicants are required to provide said landscaping. a minimum of two parking spaces would be eliminated. Pursuant to the provisions of the California Environmental Quality Act. the Planning Department has prepared an initial study for the proposed project. Said Initial study did not disclose any substantial or potentially substantial adverse change In any of the physical conditions within the area affected by the project Including land. air. water. minerals. flora. fauna. ambient noise and objects of historical or aesthetic significance. Therefore. a Negative Declaration has been prepared for this project. SPECIAL INFORMATION . The Fire Department has reviewed the Plans and has the following recommendations: (1) there must be a clear exit path from the existing Indoor dining area through the outside dining area. (2) any outdoor space heating must be State Fire Marshal approved and (3) awnings must be fabricated from flame retardant material. RECOMMENDATION The Planning Department recommends approval of C.U.P. 88-014 subject to the following conditions: 1. That two trees shall be provided In the landscaped areas located In the easterly parking lot. Said trees shall be planted prior to utilization of the patio area for dining. 2. Approval If the Planning Commission intends to take action to approve this project. the Commission should move to approve and file the Negative Declaration and find that the project will not have a signtflcant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .
