PLANNING COMMISSION RESOLUTION NO, 1375 A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88-013 TO OPERATE AN EATING ESTABLISHMENT AT 54 WEST LAS TUNAS DRIVE, WHEREAS, on MAV 2, 1988, an application was filed by Juan and Hilda Alvarez to operate on eoting estoblishment, Plonning Deportment Cose No, C,U.P, 88-013, on property commonly known as 54 West Las Tunas Drive, more particularly described as follows: SEE EXHIBIT. A. WHEREAS, a public hearing wos held on May 24, 1988, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE cln OF ARCADIA HEREBV RESOL VES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attoched report is true ond correct. SECTION 2, ThiS Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2, That the use applied for at the location indicated is properly one for which 0 Conditional Use Permit is authorized, 3, That the site for the proposed use is adequate in size and shape to accommodote soid use, and 011 yords, spoces, wolls, fences, porking, looding, londscoping and other features are adequate to adjust said use with the land and uses in the nei ghborhood, 4, That the site abuts streets and highways adequate in width and pavement type to corry the kind of traffic generoted by the proposed use, 5, That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, 6, That the use applied for will not have a substantial adverse impoct on the environment. SECTION 3, That for the foregOing reasons this Commission grants a Conditional Use Permit to operate an eating establishment upon the following conditions: 1. Seating shall be limited to a maximum of eight (8) persons. 2. A modification shall be granted for 58 porking spoces in lieu of 124 spaces, This shall only be for the use approved by C,U,P, 88-013, and not constitute a general reduction in parking for the total site, -1- 1375 . . . 3, Fire protection and building occupancy shall be maintained to the satisfaction of the Arcadia Fire Department. 4, Any change in water service shall be installed by the Arcadia Water Division at the applicant's expense, 5, Signs for the proposed business shall be subject to Architectural Design Review, 6. The subject site shall be maintained as per the plans on file in the Planning Department. 7, That C,U,P, 88-013 shall not tal<e effect until the owner and applicant have executed a form ayailable at the Planning Department indicating awareness and acceptance of the conditions of approval. 8. Noncompliance with the proyisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or reyocation, 9, That the eating establishment shall not open for business prior to 4:00 p,m, on any day. SECTION 4. May 24, 1988 TO: ARCADIA cln PLANNING COMMISSION FROM: PLANNING DEPARTMENT James M, Kasama, Assistant Planner CASE NO,: C,U,P, 88-013 SUMMARY This Conditional Use Permit application was filed by Juan and Hilda Alvarez to operate a pizza parlor with seating for eight (8) persons at 54 West Las Tunas Drive, The Planning Department is recommending approval subject to the conditions listed in this report. SITE INFORMATION TOT AL SITE AREA: Approximately 39,204 square feet (0.90 acre) FRONT AGE: 377 feet along Las Tunas Driye 369 feet along Live Oale Avenue EXISTING LAND USE &. ZONING: Two commerci61 ret6il buildings tot6ling 12,552 SQU6re feet. The zoning is C-M (Commerci61 - Manuf6cturing) SURROUNDING LAND USE &. ZONING: North: Offices, restaurant, &. a retail center, zoned c-o &. C-2 South: Light industrial &. commercial uses, zoned C-M East: Retal1 center, zoned C-2 West: Eating establishment, zoned C-M GENERAL PLAN DESIGNATION: C - Commercial . . . PROPOSAL AND ANAL VS1S The applicant is requesting a conditional use permit and parking modification to oper- ate an eating establishment (pizza parlor) with seating for eight (8) persons. By adding tables and chairs to the business, it changes from a retail activity to an eating establishment which requires a conditional use permit and additional parking. The eating establishment will contain 1,682 square feet and is part of a 12,552 square foot retail center with 58 parking spaces. The parking modification will be for 58 spaces in lieu of 124. In developing this center, Modification M-84-77 was granted on July 10, 1984 to per- mit 58 parking spaces in lieu of 63 spaces. It was determined that the property was unique since it was like an "island" with frontage on both las Tunas Driye and live Oale Ayenue, and with only one abutting commercial lot. This lot therefore has more then the normel street parking eyeileble to it. Other uses in this reteil center ere es follows: TlJoe of Use Realty Office Art Meteriel Shop Video Tapes Shop Dry Cleaners Vacant Space Proposed Eating Establishment Eating Establishment (Burger Palace) Clothing Shop Eating Establishment (Donut lady) Total Sa. Footage 2,576 1,300 1,300 1,100 1,100 1.682 (8 seats) 1,682 (12 seats) 906 906 (12 seats>. 12,552 Since 1982 there have been 14 conditional use permits granted for similar types of uses throughout the City and as of this date we have not had any complaints, nor has staff observed any parking space problems caused by the operation of these small eating establishments. This application Is the third of its kind for this center. On October 26, 1966 the Planning Commission granted C.U.P. 66-10 to permit opera- tion of the 906 square foot, 12 seet, eeting establishment (Donut ledy) with e modifi- cation for 58 parking spaces in lieu of 77 spaces. The parking modification was only for the use approved by C.U.P. 86-10 and was not a general reduction in parking for the entire center. C.U.P. 88-013 5/24/88 Page 2 . On June 23, 1987, C.U.P. 87-11 was epproyed for e 1,682 square foot, 12 seet, 8eting establishment (Burger Pel ace) with a modification for 58 parking spaces in lieu of 102 spaces. This modification was only for the use approved by C.U.P. 67-11. By restricting the seating within these eating establishments the Planning Depart- ment feels the parking requirement of 5 spaces per 1,000 square feet is adequate. The limited seating is not detrimental to the site or surrounding properties, and is a convenience for the customers. In this particular case, the applicant has requested seating for only eight (8) persons which further reduces the possibility of this eating establishment being the cause of a parking problem at this center. Staff has conducted site inspections during the Subject center's peal< activity period of 11:30 a.m. to 1:30 p.m. During the inspections, less than 50:1: of the on-site parking was occupied. Also, initial site inspections conducted at about 5:00 p.m. showed even less parking to be occupied. . Pursuant to the provistons of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse Change in any of the Physical conditions within the area affected by the project inclUding lane:l, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Neglltiye Declaration has been prepllred for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. BB-O 13 SUbject to the following conditions: 1. Sellting Shllll be limited to II mllximum of eight (8) persons. A modification Shall be granted for 56 parking spaces in lieu of 124 spaces. This shall only be for the use approved by C.U.P. 66-013, and not constitute a general reduction in parking for the total site. 2. . 3. Fire protection and bulldlng occupancy shall be maintained to the satisfaction of the Arcadia Fire Department. 4. FINDINGS AND MOTIONS Aooroyal If the Planning Commission intends to take action to approve Conditional Use Permtt No. 88-013, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approyal set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny Conditional Use Permit No. 88-013, the Commission should move to deny and direct staff to prepare IIn appropri- ete resolution incorporating the Commission's decision and supporting findings.
