WHEREAS, on April 13, 1968, an application was filed by Long G, Chen to operate a game machine arcade, Planning Department Case No, C,U,P, 68-009, on property commonly I<nown as 22-24 East Duarte Road, more particularly described as follows: Lot 4, Tract 13252 in the City of Arcadia, County of Los Angeles, 5tote of Colifornio os recorded in Baal< 345, Pages 6-8, of Maps in the office of the recorder of said County, WHEREAS, a public hearing was held on May 24, 1988, at which time all interested persons were given full opportunity to be heard and to present eYldence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE cln OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2, This Commission finds: 1. That the subject location for the game machine arcade is inappropriate because of its proximity to the neighboring residential properties on Christina Street. 2, That the additional activity, traffic and noise which the proposed arcade would generate would be detrimental to the neighboring residential properties, 3, That the site for the proposed use is inappropriately designed to accommodate said use and other features necessary to adjust said use with the land and uses in the neighborhood, SECTION 3, That for the foregoing reasons this Commission denies the application for Conditional Use Permit 88-009, SECTION 4, The decision, findings and conditions contained in this Resolution reflect the Commission's action of May 24, 1988 and the following vote: AVES: NOES: ABSENT: Commissioners Amato, Clark, Hedlund and Szany None Commissioner Papay . . . The Plan- ning Department is recommending approval subject to the conditions listed in this report. . SITE INFORMATION 1'OTAL SITE AREA: Approximately 54,400 sQuare feet (1.25 acres) FRONT AGE: 328,95 feet along East Duarte Road EXISTING LAND USE & ZONING: Two commercial retail buildings totaling 15,755 sQuare feet. The front portion of the site is zoned C-2, and the rear portion is zoned PR-\ , SURROUNDING LAND USE & ZONING: North: CommercIal and nonconforming residential, zoned C-2&H South: Multiple family residential, zoned R-3 East: Auto repair and health club, zoned C-2 and PR-\ West: Gas station, zoned C-2 GENERAL PLAN DESIGNATION: C - Commercial . . . . PROPOSAL AND ANALYSIS The appl1cant is requesting a conditional use permit and parking and landscaping modifications to operate a game machine arcade with 31 game machines, Game machine arcades are a permitted use in the C-2 zone with an approved conditional use permit. The game arcade will occupy 2,220 SQUllre feet of II 14,460 SQUllre foot strip retai I building, Parkin9 and lllndsclloing There are currently 93 parking spaces on the entire site, The freestanding donut ShOp at the east end of the site has 26 parking spaces with 480 sQ. ft. of landscaping allo- cated to it by C.U.P, 76-3, The remaining 67 spaces which are aVlIilable for the strip retail building are substllndllrd in design, striping IInd IlIndscllping. The modifications will be for 65 spaces, as they exist, in lieu of 73 (2 spaces directly behind the IIrcade should be set aside for bicycle parking) llnd no landscllping in lieu of 1,330 SQ. ft. (5:1: of the parking area). Hours of ODerat ion The IIpplicllnt hilS not specified the hours of operlltion. For the two gllme mllchine ofcades approved in the past (C.U,P, 82-5 &. c.u.p, 82-6) the Planning Commission allowed operation during the following hours: SundllY through ThursdllY 11 :00 lI,m. to 10:00 p,m. FridllY IInd Saturday 11:00 a,m, to 12:00 midnight Also, the following rules and regulations were required to be clearly posted and enforced at all times: - No smoking, eating or drinking, - No loitering, - No gambling, - No reselling of tokens (if used to operate machines), - No person under 18 years of age permitted 1 n or around the premises when school is in session, Pursuant to the proylslons of the California EnYironmental Quality Act, the Planning Department has prepared an Initial study for the proposed project. Said Initial stUdy did not disclose any substantial or potentially substllntiallldyerse change in IIny of the physiclII conditions within the llrellllffected by the project including land, air, water, minerals, flora, fauna, ambient noise llnd objects of historical or aesthetic significllnce, Therefore, II NegatlYe Declllrlltion hilS been prepared for this project. C,U,P, 88-009 5/24/68 Page 2 . . . RECOMMENDATION The Planning Department recommends approyal of Conditional Use Permit No, 66-009 subject to the following conditions: 1. That a maximum number of 31 game machines shall be within the premises at any time, 2, The hours of operation shall be limited as follows: Sunday through Thursday 11 :00 a.m, to 10:00 p,m, Friday and Saturday 11 :00 a,m, to 12:00 midnight 3. Modifications shall be granted for 65 parking spaces in lieu of 73 spaces and for no landscaping in lieu of 1330 sQ, ft. These shall only be for the use aDproyed by C,U,P, 88-009, and shall not constitute general reductions for the total site, 4, Fire protection and building occupancy shall be maintained to the satisfaction of the Arcadia Fire Department. This shall include but not be limited to the following: A. Installation of a central station fire alarm system, B, A maximum occupancy of 150 persons at any time, C, Installation of lighted exit signs oyer all doors, and 0, Rear exit doors to swing outward, 5, That the following rules and regulations be Clearly posted and enforced at all ti mes: A, No smoking, ellting or drinking, B. No loitering, C. No gambling, 0, No reselling of tokens (if used to operate mllchines), E, No person under 18 years of age permitted in or around the premises when school is in session, 6, That lit least one adult attendant (minimum 21 years of age) shall be on duty during all hours of operation, 7, Thllt the front window llrell fllcing DUllrte ROlld Shllll hllye II totlllly unobstruct- ed yiew and that Ilny window coyerings shall be subject to reYiew and approyal by the City, C,U,P, B8-009 5/24/68 Page 3 . . . 8, That any machines shall be set back a minimum of four (4) feet from the front window (this requires that machines -1-4 & 17-19 be relocated), The location or number of machines shall not supersede any Arcadia Municipal Codes, 9, Thot if security bors ore installed, they sholl be inside the building ond ore subject to review and approval by the City, and such installation shall require that the bUilding be fully fire sprinklered, 10, That flood lights shall be located in the rear parking lot. These shall be subject to the review and approval by the City. Lighting shall conform to Arcadia Municipal Code Section 9263,6,1. 11. Thot no bicycles shall be permitted to remain in front of the building, All bicy- cles sholl be located at the rear of the building. 12, Plans for the location and installation of permanent bike racks shall be sub- mitted to the PI13nning Department for review and approyal prior to installa- tion, If upon inspection of the premises, the Planning Department determines that additlonal bike racks are necessary, such shaIJ be provided immediately upon approyal of revised plans, 13, The subject premises and site shaIJ be maintained as per the plans on file in the Planning Department. 14, That an Entertainment Permit be obtained from the Business License Reyiew Board, If the Entertainment Permit is denied or revoked, C.U.P, 88-009 shaIJ become null and void. 15. That C.U.P, BB-009 shall become null and void if any transfer is made of the rights of this Conditional Use Permit by outright transfer, operation of low, forfeiture or any other means whatsoever, unless the applicants herein first 6pply for and are granted permission to make such transfer by the Planning Commission. Should such permission be requested, the Planning Commission may impose additional conditions of approyalas it deems necessary which shaIJ be aUhered to by the transferee, or may deny such transfer, 16, Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation, 17, That C.U,P, 88-009 shaIJ not take effect until the owner and applicant have executed 8 form ayailable at the Planning Department indicating awareness and 6cceptance of the conditions of approval. FINDINGS AND MOTIONS ADDroVlll If the Planning Commission intends to take action to approye Conditional Use Permit No, 88-009, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the Commission's deci- sion, specific findings, and the conditions of approval as set forth in the staff report, or as modified by the Commission, Deniol If the Planning Commission intends to take action to deny Conditional Use Permit No. 68-009, the Commission should moye to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supporting findings.
