WHEREAS, on March 16, 1986, an application was filed by George W. Wiegand, Jr, of West co Land, Inc. for a two-story house with a 7'-0' first floor westerly rear yard setback and a 33'-0' second floor westerly rear yard setback, Planning Department Case No, MC 88-028, on property commonly known as 152 Winnie Way, more particularly described as follows: Lot 3, Tract 45635 in the City of Arcadia, County of Los Angeles, State of CalifornIa as per Map recorded In Map Book 1104, Pages 85 and 86 in the County Recorder's office. WHEREAS, a public hearing was held on May 10, 1988, at whIch time all interested persons were given full opportunIty to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITV OF ARCADIA HEREBV RESOLVES AS FOLLOWS: SECTION 1. That the factual data submItted by the PlannIng Department In the attached report I s true and correct. SECTION 2, This Commission finds: 1. That the granting of MC 68-028 will be detrimental to the public health or welfare, or injurious to the property or Improvements In such 20ne or vicinity, 2, That the requested modifications would have an adverse impact on the adjoining property to the west. 3, That the subject property is adequate in area for a house to be designed In compliance with the ArcadIa MunicIpal Code, 4, That approval of MC 88-026 will not secure an appropriate improvement. (9252,2,6), . B) 33'-0. second floor westerly rear yard setback in lieu of the required 35'-0. (9252,2,8), SITE INFORMATION LOT AREA: 11,328 net square feet (0,21 acre) FRONT AGE: 114,61 feet along terminus of Winnie Way EXISTING LAND USE &. ZONING: The subject site (1615-1625 S, Second Ave.) is currently being cleared for the development of the cul-de-sac and five new houses; the zoning is R-l 7,500. GENERAL PLAN DESIGNATION: SF-6, Single-family residential (6 d,u.lacre), SURROUNDING LAND USE & ZONING: . The surrounding properties are all developed with single family residences, The area is zoned R-l 7,500, . BACKGROUND The Modification Committee (Amato, Kinnahan and Woolard) after discussing this matter at a public hearing on April 26, 1988, acted to refer request number MC 88-028 to the Planning Commission, The Committee's opinion is that this is a rather extensive request as well as being a self-imposed situation since the subdivider that designed the lot is the applicant. Commissioner Amato stated that he preferred to have the whole Commission consider this item. Findings Of Public Hearing MC 88-026 The subject property is at the end of an approved but not yet constructed cul-de-sac, The configuration of the subject lot results in it having two rear property lines, both of which require a 25' setback to the first floor and a 35' setback to the second floor, The applicant's request calls for the longer, westerly, rear line to be treated more as a si de property line, o Mr, and Mrs, Jerry Johnson of 1625 Lee Ave. appeared at the hearing on behalf of Hr, and Mrs. Kau of 1632 Lee Ave., the property adjacent to the subject rear line, Mrs, Johnson stated that the property at 1632 Lee Ave, has a very narrow rear yard and that the proposed 7' setback is inadequate, Also, a letter of opposition was submitted by Mr, Roger Johnson of 140 E. Camino Real Ave. PLANNING COHMISSION'S FINDINGS Ap.oroval If the Planning Commission intends to take action to approve this request, the Commission should find that approval of MC 66-026 would secure an appropriate improvement, prevent an unreasonable hardship, or promote uniformity of development, and move to approve this request and direct Staff to prepare the appropriate resolution. Denial If the Planning Commission intends to take action to deny this request, the Commission should find that approval of MC 86-026 would not secure an appropriate improvement, nor prevent an unreasonable hardship, nor promote uniformity of development, and move to deny this request and direct Staff to prepare the appropriate resolution. .
