A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT A HOUSEHOLD PET CLINIC IN ZONE C-l ON PROPERTY LOCATED AT SECOND AVENUE AND FOOTHILL BOULEVARD IN SAID CITY. WHEREAS, there was filed with this Conunission on the 29th day of March, 1966, the application of M. D. Schmutz, D.V.M., as Lessee, for a zone variance to permit the operation of a household tt pet clinic in Zone C-l on property located in the proposed Highlander Shopping Center at the northwest corner of Second Avenue and Foothill Boulevard in the City of Arcadia, County of Los Angeles, State of California, more specifically described as follows: Lot 9, Tract No. 23972, per map recorded in Book 748, pages 63, 64 and 65, of Maps, in the office of the County Recorder of said County; and, WHEREAS, after due notice as required by the Zoning Ordi- nance of said City, a public hearing was duly held on the matter by and before this Conunission on the 12th day of April, 1966, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That veterinary hospitals or clinics are per- . mitted in Zone C-2, subject to the issuance of a conditional use per- mit, but not in Zone C-l. That the proposed use of the property con- stitutes an exceptional circumstance or condition applicable to the intended use of the property that does not apply generally to the property or class of use in the same zone or vicinity. The granting of said variance upon the conditions hereinafter recommended will not -1- 584 .. . . . be materially detrimental to the public health or welfare or injurious to the property or improvements in said zone or vicinity, and is nec- essary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity as stated in the application and the granting of such variance will not adversely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons this Commission recommends to the City Council that a variance be granted to permit the use of a household pet clinic in Zone C-l on the above-described property upon the following conditions: 1. That overnight boarding of animals shall not be per- mitted, . 2. That the variance be granted for a period of one year only; that prior to the expiration of one year the City Planning Com- mission review the past operation of the pet clinic and r'eport its findings and recommendations to the City Council; and that the City Council reserve the right to extend the variance from year to year, after similar review and report, and to modify the conditions and to add new conditions thereto as found to be necessary, all without the necessity of further notice or hearings in the manner. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 12th day of April, 1966, by the following vote: AYES: Commissioners Ferguson, Golisch, Hanson, Lauber, Norton, Parker and Kuyper . D. Schmutz -2714 E. Huntington Drive, Duarte, Calif Small shop west of the proposed Sav-On-Drug Store in the Highlander Shopping Center at the northwest corner of Second Avenue and Footh i II Bou I evard The ordinance only makes provision for veterinary offices in Zone C-2. The appl icant proposes 0 Household Pet Clinic for in-and-out emergency and sickness core on on appointment basis. No boarding or grooming of animals is proposed, except under an emergency where sedation is used. The building will be accoustically engineered. Request: lhe Shopping Center which was recently approved is under construction. The major tenants ore the Sav-On Drug Store and the Food Fair Market. The shops in between these two major tenants will be leased to C-l uses. The property is in Zone C-1 and D, If the buildings were proposed for normal medical office use they would automatically be permitted in Zone C-l. However, because animals are involved, the ordinance requires a variance. Veterinary hospitals or clinics ore permitted in Zone C-2, subject to the issuance of 0 Conditional Use Permit. The staff thinks the ordinance is primarily concerned with the boarding and keeping animals, and not the day-to-day treatment as most household pets today seem to require. The location in 0 neighborhood shopping center would make this use convenient for those who use and need the facility.
