' \ A RESOLUTION OF THE CITY PLANNI<<GlJ l~:' '-./ \...' .J U I COMMISSION OF THE CITY OF ARCADllAi'"'_:..,~__-------- CALIFORNIA, GRANTING A CONDITIO~-'- USE PERMIT UPON SPECIFIED CONDITIONS FOR THE RECONSTRUCTION OF A SERVICE STATION FACILITY ON PROPERTY LOCATED AT 25 EAST FOOTHILL BOULEVARD IN SAID CITY. , WHEREAS, there was filed with this Commission on the 25th day of January, 1966, the application of Shell Oil Company for a con- ditional use permit for the reconstruction of the service station - facility on property known as 25 East Foothill Boulevard in the City of Arcadia, County of Los Angeles, State of California, more speci- fically described as follows: Lots 11 and 12 of Block 1 of Tract No. 4129, per map recorded in Book 75, pages 48 and 49, of Maps, in the office of the County Recorder of said County; and, WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 8th day of February, 1966, which hearing was duly continued to February 23, 1966, at which times all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. TJlat subject property is presently developed with three commercial buildings, one of which, the existing service Ii station building, is proposed to be removed and a new building erected. That subject property is commercially zoned, adjacent to other com- mercial property and has adequate ingress and egress. That the pro- posed development and landscaping would represent an improvement which could benefit the community and surrounding properties and is appro- priate for the location, That the granting of such permit will not -1- 580 v t ~ . . ~ be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. That the use is properly one for which a conditional use is authorized. That the site is adequate in size and shape to accommodate said use and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighbor- hood. That the site abuts Foothill Boulevard and Santa Anita Avenue which are adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such con- ditional use permit will not adversely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons, this Commission hereby grants a conditional use permit for the reconstruction of a ~ service station facility on the above-described property in accordance with the revised plot plan submitted by applicant and upon compliance with all regulations of Division 5 of Part 7 of Chapter 2 of Article IX of the Arcadia Municipal Code, except such portions of Title 4 thereof as may be waived by the City Council, upon the following con- ditions: 1. That the two signs incorporated into the extended build- ing wall shall not project above the roof line. 2. That a revised preliminary plot plan shall be submitted to and approved by the Planning Department. 3. That grading and drainage plans showing driveway aprons, sidewalks, curbs, gutters and nuisance drainage structures, shall be . submitted to and approved by the Department of Public Works. 4. That final working drawings shall be in substantial compliance with the approved preliminary drainage plan and revised plot plan. -2- 580 ... . .t . . ~ SECTION 3. This Commission further recommends to the Arcadia City Council that the thirty (30) square feet of raised planting area located along the building facade fronting on Foothill Boulevard as required by Paragraph 4 of Section 9275.4.11 of the Arcadia Municipal Code be waived for the reason that the design of the building leaves a limited area for such planting. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy hereof to be forwarded to the City Council of the City of Arcadia, I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 23rd day of February, 1966, by the following vote: - AYES: Commissioners Golisch, Hanson, Norton, Parker and Kuyper NOES: None ABSENT: Commissioners Ferguson and Lauber Chairman ATTEST: Secretary -. . - , -3- 580 . . . . . P. 66-3 APPLlCA nON: The application was filed by Shell Oil Company for the purpose of obtaining a Conditional Use Permit to reconstruct a service station at the northwest corner of Foothill Boulevard and Oakwood Avenue. PRESENT ZONING AND LAND USE The subject property is presently developed with three commercial buildings. The existing service stotion building is proposed to be removed and a new building erected on the property. The other commercial buildings are proposed to remain unchanged. These buildings ore on the northerly 34.58 feet of the subject property and are not under the control of the Shell Oil Company. The service station lease covers only the southerly 100 feet by 110..84 feet of the total property, The northerly two buildings are used for a picture framing shop and storage. Attached is an illustration of the surrounding zoning, The subject property is in Zone C-2 os is 011 the Foothill Boulevard frontage in this vicinity. There is also C-2 zoning to the north of the property to a depth of 90 feet. The commercial property on the north and west is vacant. The properties north of the commercial zoning ore zoned R-] and ore developed with single-family residences, PROPOSED DEVELOPMENT The proposed service station reconstruction would comply with the regulations except for the following: 1. Sigl'ls ~Total sign area permitted is 221 square feet, 550 square feet is proposed. b. One free stonding sign with 0 maximum area of 100 square feet not to exceed 25 feet in height is permitted. Two free standing signs are proposed. One sign is 51 feet in height and has 0 total areo of 408 square feel. The other sign would generally comply with the regulations but specific dimensions are not proposed. This sign would also revolve which is not permitted. - 1 - ~~ . . . . I . c. u. P. 66-3 Feb. 23, 1966 Page 2 c. Signs are not permitted to extel1d above the roof lines. Three signs above above the roof line are proposed. One would be mounted above the pump islond canopy ond two would be mounted on masonry wall extension above the building roof line. These signs are 12 square feet, 5 square feet, and 5 square feet, respectively. d, Attraction boards ore not permitted by regulations. One "A" frame poster sign is proposed at the southeast corner of the lot. 2. Landscaping. o. A 5 foot planting strip is required along the east property line - none is indicated. b. A 3 foot planting strip along the north property line to the building setback is required. None is indicated. c. 30 square feet of planting along the building facade, fronting on Foothill Boulevard is required. None is indicated. 3. A screen wall is required around the restroom entrances. A planting strip is indicated. 4. A five foot masonry wall is required around the trash area. A four foot wall is indicated. ANALYSIS On the subject property there are two separate uses, The service station occupies the southerly 100 feet of the property, the picture framing shop the northerly 34.58 feet. Although both uses ore on the some property, it is difficult to treat the site as a sil1gle unit. Shell Oil Company wishes to improve the part of the property under their control. It does not seem entirely fair to recommend action that would penalize their effort to upgrade the part of the property they lease. The development of the northerly portion of the property is included in order that the Commission may review the entire site. The two buildings on the northern section of the property cover approximately 65% of that part. With the limited ingress, egress and floor space, the amount of parking would not meet code requirements for this portion. The use is 0 low volume operation and at present there appears to be no parking problem. - 2 - . . . c. u, P. 66-3 Feb. 23, 1966 Page 3. The property leased by the Shell Oil Company is presently developed with a service station and is located on a major street. It is commercially zoned, odjacent to other commercial property and has adequate ingress and egress. The proposed development and landscaping would represent an improvement which could benefit the cammunity if developed to the new service station standards. The development is appropriate for the location and would not be injurious to the properties or improvements in the vicinity and would not be adverse to the comprehensive general plan. RECOMMENDA TlON . The Planning Deportment would recommend approval of the plot plan, subject to the compliance with regulations in the Code.
