RESOLUTION NO. 576 A RESOLUTION OF THE CITY PLANNING CO~~SSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A CONDITIONAL USE PER~UT FOR THE CONSTRUCTION AND ~ffiINTENANCE OF A SERVICE STATION ON THE SOUTHEAST COR~~R OF DUARTE ROAD AND FIRST AVENUE IN SAID CITY UPON SPECIFIED CO~IDITIONS. vrnEREAS, there was filed with this Commission on the 28th day of December, 1965, the application of Union Oil Company for a conditional use permit for the construction and maintenance of a ser- vice station on property located on the southeast corner of Duarte Road and First Avenue in the City of Arcadia, County of Los Angeles, . Sta.te of Ca.lifornia, more specifically described as follows: Lots 1 a,nd 2 of Tract No. 10532, per map recorded in Book 177, pages 21 and 22, of Maps in the office of the County Recorder of said County; and, WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 11th day of January, 1966, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AS FOLLOWS: SECTION 1. That subject property is located on a major street, is comnlercially zoned and is presently developed with a mix- . ture of nonconforming buildings. Tha,t the site is adjacent to other commercially zoned property and has adequate ingress and egress. That the proposed dev~lopment and landscaping would represent an improvement which would benefit the community and the surrounding properties. That the granting of such permit ,,rill not be detrimental to the public health or welfa.re or injurious to the property or im- provements in such zone or vicinity. That the site is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other fea,tures re- quired to adjust said use with the land and uses in the neighborhood. That the site abuts First Avenue and Dua,rte Road which are adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not adversely affect the comprehensive general plan. SECTION 2. Tha,t for the foregoing reasons, this Commission hereby grants a conditional use permit for the construction and ma,in- tenance of a service station on the above-described property upon the condition that the same be constructed and at all times maintained in accordance with the plot plan submitted by applica.nt and upon com- pliance with all regulations of Division 5 of Part 7 of Chapter 2 of Article IX of the Arcadia Municipal Code. SECTION 3. The Secretary shall certify to the adoption of this resolution. C.U.P, 65-10 APPLICA TlON The application was filed by the Union Oil Company for the purpose of obtaining a Conditional Use Permit to construct a service station at the southeast corner of Duarte Road and First Avenue. PRESENT ZONING AND LAND USE Attached is 0 mop of the surrounding zoning. The subject property is presently developed with four non-conforming buildings. One building is 0 four-unit apartment building. Two other buildings have been used for commercial purposes. One is 0 residential structure which has been used for a real estate office. The other was used for a flower and pet shop and does not conform to the building code requirements of fire zone No. I. The fourth building is 0 two-story accessory building which contains on additional unit. The property immediately to the east is developed with a beauty parlor in 0 non-conform- ing building and two residential structures to the rear. The balance of the uses between the Alpha Beta Shopping Center and the beauty shop are are one residential structure and two vacant lots. The properties to the north are developed with 0 mixture of residential and commercial uses. Properties to the south are in Zone R-2 and developed with single-family structures. Several of the lots have more than one unit per lot. PROPOSED DEVELOPMENT The proposed development would remove the existing buildings in order to construct a service station facility. The proposed station would comply with the new standards governing service stations. U. P. 65-10 January 11, 1946 Page Three ANALYSIS The subject property is located on a major street, is commercially zoned, and is presently developed with a mixture of non-conforming buildings. The site is adjacent to other commercially zoned property and has adequate ingress and egress. The proposed develop- ment and landscaping would represent an improvement which would benefit the community and the surrounding properties. Since there are a number of service station facilities already in existence on Duarte Road (between Fifth Avenue and Santo Anita Avenue) the need for on additional facility might be questioned. The Staff is of the opinion that the elimination of the four non- conforming buildings and the quality of development proposed should be given the greatest weight. Therefore, the Planning Department would conclude that the development proposed is appropriate for the location and would not be injurious to the properties or improvements in the vicinity, and would not be adverse to the comprehensive general plan. (NOTE: The above statements may be used in the resolution to indicate reasons for action if the Planning Commission should oct favorably on this matter).
