J i u "'-'-= ~lUJ u I A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION OF A NEW SERVICE STATION FACILITY ON PROPERTY LOCATED AT 2 EAST DUARTE ROAD IN SAID CITY. WHEREAS, there was filed with this Commission on the 26th da.y of November, 1965, the a.pplication of Richfield Oil Corporation for a conditional use permit for the construction of a new service station facility on property known as 2 East Duarte Road in the City of Arca.dia, County of Los Angeles, State of California, more speci- fically described as follows: . Lot 1 of Tract No. 13252, per map recorded in Book 345, pages 6 to 8, of Maps in the office of the County Recorder of said County; and, WHEREAS, a public hearing was duly held on said matter by and before this Commission on the 14th day of December, 1965, at which time a.ll interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1, That subject property is located at a major intersection, is commercially zoned and presently developed with a service station adjacent to other commercially zoned property and . has adequate ingress and egress. That the property to the east is developed with commercial uses. The property to the north is de- veloped with a mixture of commercial and residential uses. The prop- erty to the west is the location of the City Library and to the south is an R-3 Zone developed with apartments. That the proposed redevelop- ment would represent an improvement which would benefit the surrounding -1- 574 / . . . properties; that the use is identical to the utilization of the loca- tion for the past fifteen (15) years; that the property abuts Duarte Road and Sa,nta Anita Avenue, streets that are adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That the granting of such conditional use permit will not ad- versely affect the comprehensive general plan. SECTION 2. That for the foregoing reasons, this Commis- sion hereby grants a conditional use permit for the construction of a new service station facility on the above-described property in . accordance with the plot plan submitted by applicant and upon com- pliance with all regulations of Division 5 of Part 7 of Chapter 2 of Article IX of the Arcadia Municipal Code,except such portions of Title 4 thereof as may be waived by the City Counci~upon the follow- ing conditions: 1. That plans for drainage from the site shall be approved by the Department of Public Works; 2. That complete landscape plans, including adequate landscaping areas on Santa Anita Avenue, shall be submitted to and approved by the Planning Depart- ment. SECTION 3. This Commission further recommends to the Arca.dia City Council that Paragraphs 1, 2, 3 and 4 of Section 9275.4.11 of the Arcadia Municipal Code be waived to the extent necessary to permit the following: 1. The north planter along Duarte Road to be three (3) feet in width instead of five (5) feet; . 2. The planter along the south property line to be fourteen (14) feet short of the front building line, provided that the width is increased to ten (10) feet; 3. That sixty (60) square feet of planter may be a.llowed at the intersection of Santa Anita Avenue and Duarte Road rather than the required 150 square feet; -2- 574 . . . 4. That no planting be required along the north building facade rather than the required thirty (30) square feet; for the reason that the strict adherence to said Paragraphs 1, 2, 3 and l~ of Section 9275.4.11 would be inappropriate or inapplicable to the intended use of the property in view of its proposed development. SECTION 4. The Secretary shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 14th day of December, 1965, by the following vote: AYES: Commissioners Golisch, Lauber, Norton, Parker and Kuyper . P. 65-8 - 2 EAST DUARTE ROAD APPLICATION The application was filed by the Richfield Oil Corporation for the purpose of constructing a new service facil ity at the southeast corner of Santa Anita Avenue and Duarte Road. PRESENT ZONING AND LAND USE Attached is a map of the surrounding zoning. The subject property is presently developed with a service station. The property to the east is developed with commercial uses. The property to the north is developed with 0 mixture of commercial and residential uses. The property to the west is the location of the City Library. To the south is anR-3 Zone developed with apartments. PROPOSED DEVELOPMENT The proposed development would remove the existing building in order to construct o more modern facility. The new station would, for the most port, comply with the new standards governing service stations. There are some variances from the code requirements, principally due to the fact that the present curb cuts, pu'mp island loca- tions and separations required by building regulations affect the adjustment of building to lot. ANALYSIS The subject property is located at a major intersection, is commercially zoned and presently developed with 0 service station adjacent to other commercially zoned property and has adequate ingress and egress. The proposed redevelopment would represent an improvement which would benefit the surrounding properties. Therefore, the development proposal is appropriate for the location, not injurious to the properties or improvements in the vicinity, and not adverse to the comprehensive general plan. (NOTE: The above statements may be used in the resolution to indicate reasonS for action if the Planning Commission should act favorably on this matter). RECOMMENDA TlONS The Planning Deportment would recommend approval of the plot plan, subject to the regulations specified in the Code.
