A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA,' GRANTING A CONDITIONAL
USE PERMIT TO ALLOW THE PROPERTY AT
171 EAST LIVE OAK AVENUE IN SAID CITY
TO BE USED FOR THE EXPANSION OF AN
EXISTING SERVICE STATION.
WHEREAS, there was filed with this Commission on the 16th day
of August, 1965, the application of Shell Oil Company for a conditional
use permit for the expansion of existing service station facilities on
the property known as 171 East Live Oak Avenue, Arcadia, specifically
described as follows:

Those portions of Lots 4 and 5 of Tract 12670 in the
City of Arcadia, County of Los Angeles, per map re-
corded in Book 245, page 47, of Maps, Records of Los
Angeles County, California, described as follows:
The easterly 160.18 feet of said Lot 5 measured at
right angles to the westerly line and the easterly
160.18 feet of the southerly 26.49 feet of said Lot 4
measured at right angles to the westerly and southerly
lines respectively;
EXCEPT therefrom those portions of Lots L~ and 5 dedi-
cated to the City of Arcadia for street and alley
purposes by Grant Deeds recorded in Book 55889, pages
392 thrOUgh 397 of Official Records.
vlliEREAS, a public hearing was duly held on said matter by and
before this Cornnission on the 14th day of September, 1965, at which time
all interested persons were given full opportunity to be heard and to
present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. That subject property is in Zone C-2 and D. The

property to the south is in Zone C-2 and is developed with a market, stores
and a service station. The southeast corner also in Zone C-2 is developed
with a service station. The property to the east is in Zone C-l and is
developed with a service station. To the north property is zoned PR-3
and R-2. The PR-3 land is used for the storage of plants. The R-2
properties are developed with units. The property to the east is zoned

C-2 and D and is developed with a coffee shop and nursery. The present
building contains approximately 1,215 square feet and is proposed to be
enlarged to 1,485 square feet by the addition of another lubrication bay
to the existing building. The dimensions of subject property are approxi-
mately 148 feet by 143 feet and said property contains approximately 21,000
square feet. That there are stations at all four corners of the inter-
section of Second and Live Oak Avenues. That the station does not in-
terrupt or pose a danger to pedestrian traffic in the corr~ercial area
and its location at a street intersection affords ease of ingress and
egress. The existing six (6) foot high wall north of the alley (20 feet
wide) and landscaping adjacent thereto provide an adequate buffer between
the station and the residential area to the north and there is sufficient
area on the site to provide adequate space for parking.
SECTION 2. That the granting of such conditional use permit
will not be detrimental to the public health or welfare or injurious
to the property or improvements in such zone or vicinity. That the site
for the proposed use is adequate in size and shape to accommodate said
use, and all yards, spaces, walls, fences, parking, loading, landscaping,
and other features required to adjust said use with the land and uses
in the neighborhood. That the site abuts streets and highways adequate
in width and pavement type to carry the kind of traffic generated by
the proposed use. That the granting of such conditional use permit will
not adversely affect the comprehensive general plan.
SECTION 3. That for the foregoing reasons, this Comnission
hereby grants a conditional use permit to use the above described property
for the expansion of an existing service station in accordance with the
plot plan submitted b~ applicant and upon compliance with all regulations
of Division 5 of Part 7 of Chapter 2 of Article IX of the Arcadia Muni-
cipal Code except such portions of Title 4 thereof as may be waived by
the City Council.

SECTION 4. This Commission further recommends ~ the Arcadia
Paragraphs 1 and 4 of tl~{
City Council that Sections 9275.4.9,/9275.4.11 and 9275.4.12 be waived
for the reason that they are inappropriate or inapplicable to the in-
tended use of the property in view of its present development.
SECTION 5. The Secretary shall certify to the adoption of
this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted at
a regular meeting of the City Planning Commission held on the 28th day
of September, 1965, by the following vote:
AYES: Commissioners Ferguson, Hanson, Parker and Kuyper
NOES: Commissioner Norton

BEFORE THE
ARCADIA CITY PLANNING COMMISSION
WHEREAS, SHELL OIL COMPANY, Les~ee of real property located within the
City of Arcadia, California, and hereinafter described, has filed with the Planning
Commission of the City of Arcadia, a Conditional Use Permit Application,
The subject property is located at 171 East Live Oak Avenue,
The legal description of the property is:
THOSE PORTIONS OF LOTS four (4) and five (5) of TRACT NUMBER 12670,
in the City of Arcadia, County of Los Angeles, State of California,
as per map recorded in Book 245, pages 47 and 48 of Maps, in the
Office of the County Recorder of said County, described as follows:
BEGINNING AT A POINT in the South line of said Lot five (5), distant
westerly thereon twelve and fifteen hundredths (12.15) feet from the
westerly terminus of the curve in the boundary of said Lot five (5)
having a radius of fifteen (15) feet in a length of twenty-one and
twenty-two hundredths (21,22) feet as shown on said map; thence west-
erly along said South line one hundred thirty-seven and seventeen
hundredths (137.17) feet; thence northerly parallel with the East
line of said Lot four (4) and southerly prolongation of said East
line to the South line of the land secondly described in the deed to
the City of Arcadia recorded on October 18, 1957, as Instrument No,
3859 in Book 55889, Page 395 of Official Records, in the Office of
the County Recorder of said County; thence easterly and southerly
along the boundary of the land secondly described in said deed to
the southerly terminus of the curve therein concave southwesterly
