RESOLUTION NO. 557 C ;:' ,\'" J ~lj)l( d A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A ZONE VARIANCE TO PERMIT TliE CONSTRUCTION OF A TWENTY-ONE UNIT APARTMENT DEVELOPMENT AT 343 COLORADO BOULEVARD IN SAID CITY. WHEREAS, there was filed with this Commission on May 28, 1965, the application of Frank Marchese, as owner, for a zone variance to permit the construction of twenty-one (21) apartment units specifically consisting of seven (7) duplexes, two (2) triplexes, and one (1) single- family dwelling unit on property located at 343 West Colorado Boulevard . in the City of Arcadia, specifically described as follows: That property bounded on the north by the A. T. and S. F. Railroad, on the southw~~t by Colorado Boulevard, and on the southeast by-",the north- westerly boundary of Tract No. 184~~per map re- corded in Book 461, page 48, ~? Ma,~ F,'~" in the office of the County Recorder; C:Cluii-ty of Los Angeles, State of California,[~ and, f\ WHEREAS, after notice duly g;t~4 as required by the Zoning ,If'" , Ordinance, a public hearing was du~n~d ~ the matter by and before \, this Commission on the 8th daY{~ J ,~~ 1965, which hearing was duly ~ '\, ~ continued to June 22, 1965, and '(iga;t,j continued to July 13, 1965, at '", 1\ which times all interested partie~ere given a full opportunity to be heard and to present evid~~ce; ~,~ NOW, THEREFORE, T~ CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE \S F~~OWS: " If SECTlo,~~ha~Ubject property is bounded on the north by the A. T. and Sf'F. Rail~ad, on the southwest by Colorado Boulevard, and on the southeast by the rear property lines of residential lots on the northwest side of Renoak Way, comprising an area of 112,830 square feet of land. That subject property is in Zone R-l and is surrounded by Zone R-l property, some of which has been more densely developed under variances granted many years ago. That there already exists in . -1- 557 . . . . the City of Arcadia a substantial amount of land zoned for multiple dwelling purposes, which areas have been kept reasonably well confined and have much development potential yet available. That traffic condi- tions on Colorado Boulevard pose a hazardous problem which would only be increased by the granting of the requested variance. That there are no exceptional or extraordinary circumstances applicable to the property involved that do not apply generally to the property or class of use in the same zone or viclnlty; that such vari.ance is not necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. That the granting of the requested variance and the construction of twenty-one (21) apartment units as proposed will be injurious to other properties in the same vicinity and zone, SECTION 2, That for the foregoing reasons, this Commission recommends to the Ci.ty Council of the City of Arcadia that a variance to permit the construction of twenty-one (21) apartment units on the above described property be denied, SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia. July 27, 1965 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: V-65-1 21 UNIT GARDEN APARTMENT PROPOSAL AT 343 COLORADO STREET This application was first presented to the Planning Commission at its meeting of June 8, 1965. The Architect requested additional time to prepare an amended plan. The amended plan was presented to the Commission at its last regular meeting of July 13, 1965. At that meeting the public hearing was closed and a vote was taken. The motion to approve the variance wos not passed for lack of a majority vote. Two members of the Commission voted for and two vo.ed against the proposal. Three of the Commission members were absent. This matter will again be considered in an attempt to reach a decision. Any Commission member absent from the last meeting should review the tapes of that meeting to make himself eligible to vote on this motter. WEIMER, Acting as Agent for the owners of real property located within the City of Arcadia, California, and hereinafter described, has filed with the Planning Commission of the City of Arcadia, an application requesting a zone variance to construct twenty-four (24) garden apartment units on 112,830 square feet of land zoned R-l, as follows: That property bounded on the north by the A. T. and S. F. Railroad on the southwest by Colorado Street, and on the southeast by the northwesterly boundary of Tract No. 18487. . The subject property is commonly known as 343 W. Colorodo Street. The changes from the original plan os presented in the Planning Department report of June 8, 1965, are as follows: 1. The number of duplexes has been increased from four to seven. 2. The number of triplexes has been decreased from four to two. (The total number of units remains the same). 3. The floor areas are changed slightly but comply with all R-3 regulations 4. The building coverage is substantially the same, showing a sl ight decrease. 5. The number of parking spaces has been increased fram 56 to 64, which is 3 spaces and a fraction per unit. The number of covered spaces is 42, the open spaces 22. 6. The driveway widths camply'with R-3 standards. It should be noted, however, that the drives should be posted for one way traffic ~ and overhead obstructions could not be allowed. 7. The swimming pool has been relocated ta the west end of the site. 8. The central court area has been enlarged. 9. The setbacks are substantially the same. 10. The turning radii comply with R-3 standards. /' / The Planning Department in its original report dated June 8, 1965 has recommended approval. The decision to make this recommendation follows a pattern of action set on similar property in that area. On several occasions the City Council has granted variances in this area in the same zone. In the opinion of the Planning Department, as per the conditions set forth in Sectian 9291.1.2 of the Arcadia Municipal Code, the granting of a variance on this property is necessary for the preservation and enjoyment of a substantial property right of the appl icant possessed by other property in the same zone and vicinity. An example of such property rights is set forth in Resolution No. 3665. In Section 2 of Resolution No. 3665, which sets forth the reasons for granting the variance on the property known as 241 Colorado Boulevard, many of the reasons used in this decision equally apply to the subject property. A copy of this resolution is attached to this report. Similarly resolution No. 2387 granted a variance for multipTe residential use on property located at 245 Colorado Blvd. - 1 - . . . V -65-1 July 13, 1965 Page Two . . In the opinion of the Planning Department, the above resolutions establish the measure by which large unusually shaped properties in this vicinity must be judged. Our recommendation would therefore be for approval, subject to the fol lowing conditions: 1. The variance shall not be operative until complete working drawings prepared by a Registered Architect in substantial compliance with the approved, revised preliminary drawings, and including landscaping and irrigation plans prepared by a Landscape Arch itect, have been submitted to and approved by the Planning Department, which drawings ,/ shall be submitted within one year from the date of this resolution. l '7. ~;;r-;-;t;..~ 2. A six foot high wall shall be constructed along the southeast property line, such wall to be measured from contiguous properties. In no case shall such wall be less that:! five feet in height when measured from subject site. 3. Final plans shall include drainage and grading plans prepared by a, registered Civil Engineer, and approved by the Department of Public Works. 4. Ingress and egress to the site shall meet with the approval of the Department of Public Works, which shall include landscape heights and visual clearance. 5. Curb, gutter and sidewalk shall be constructed along Colorado Boulevard and Colorado Street, subject to the requirements and approval of the State Division of Highways and the Arcadia Department of Publ ic Works. 6. Street trees sha II be planted in locations approved by the Department of Publ ic Works and the State Division of Highways. 7. Water services shall meet with the standards set forth in the Uniform Plumbing Code and shall be approved by the Water Superintendent. 8. Electrical and telephone utility lines to buildings shall be installed underground, and no overhead services shall be permitted. 9. The working drawings shall meet with all the requirements of the Building Code. 10. The source of all exterior lighting on the site within 100 feet of any residential dwelling shall not exceed 6 feet in height above the finished grade of the ground. All other exterior lighting shall not exceed a height of 10 feet above finished grade. 12. The maximum height of buildings adjacent to the rear yards of properties fronting on Renoak Way shall not exceed a height of 20 feet. 13. Provision shall be made for a screened refuse storage area for each building containing dwelling units. 14. All mechanical equipment shall be screened from view, or totally contained within an enclosed building. 15. Except as herein expressly specified to the contrary, the development of the subject property shall conform with all the provisions of the Arcadia Municipal Code appl icable to properties in Zone R-3, in effect at the time of construction. 16. The City Planning Commission and City Council shall reserve the right, without necessity of further notice or hearing, to make minor modifications of any of the foregoing conditions, if such modification will achieve substantially the same results and will in no way be detrimental to adjacent properties or improvements than will the strict compl iance with said conditions.
