I A RESOLUTION OF THE CITY PL COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A ZONE VARIANCE TO PERMIT THE REMODELING AND ENLARGEMENT OF A NON- CONFORMING STRUCTURE AT 1415, 1417 AND 1421 SIXTH AVENUE IN SAID CITY. WHEREAS, there was filed with this Commission on the 7th day of October, 1964" the application of Vincent and Josephine Gallina, as owners, for a zone variance to permit the remodeling and en1arge- . ment of a non-conforming structure on property located at 1415, 1417 and 1421 South Sixth Avenue in the City of Arcadia, County of Los Angeles, State of California, which property is described as follows: The south 92.5 feet of the north 254.20 feet of the easterly 284.92 feet of Lot 57, of Tract No. 808, per map' recorded in Book 16, page 82, of Maps in the office of the County Recorder of Los Angeles County; and, WHEREAS, after due notice as required by the Zoning Ordi- nance of said City, a public hearing was duly held on the matter by and before this Commission on the 27th day of October, 1964, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That for the foregoing reasons this Commission recommends to the City Council that a variance be granted to permit the remodeling and enlargement of a non-conforming structure on the above described property upon the following conditions: 1. That the existing garage with a dwelling unit above and a shed in back of the front structure shall be removed and a carport shall be constructed for the front dwelling unit. 2. That complete working draWings for all such construc- tion and alteration shall be submitted to the Division of Building and Safety for approval. SECTION 3. The Secretary shall certify to the adoption of . this Resolution and shall cause a copy hereof to be forwarded to the City Council of the City of Arcadia. -2- 536 ..;<,. . . . Gallina, the owners of real property locoted within the City of Arcadia, California, and hereinafter described, has filed with the Planning Commission of the City of Arcadia, an opplication requesting a zoning variance as fallows: The south 92.5 feet of the north 254.20 feet af the easterly 2B4.92 feet of Lot 57, of Tract No. BOB, e per map recarded in Book 16, page B2, of Maps '..- in the office of the County Recorder of Los Angeles County,..- e...lll1l1vllly kUUWJI u:a 141.5 - 1417 1421 ue. The structure ;s non-conforming as it is the third and rear hause on a Zane R-1 lot which permits one house only. NOW, THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday, October 27, 1964, at the hour of B:OO .o'clock P.M., in the Council Chamber of the City Hall, 240 W~t Huntington Drive, Arcadia, California, said Planning Commission will hold a public hearing on the question of said proposed variance, and an opportunity will be afforded to persons particularly interested, and the public generally, to be heard on all matters concerning said variance. APPLICATION The application filed by Vincent and Josephine Gallina requests 0 zone variance to permit the remodelling and enlargement of 0 non-conforming structure. 2. PROPERTY CHARACTERIS TICS The subject property is in Zone R-l and presently has four separate dwelling unih constructed upon it. The fourth and rearmost house is the one proposed to be enlarged. The lot is 92.5 ft ,,^ :" and 284,92 Ft. deep and is surraunded by Zone R-l property. 3. ANALYSIS This applicotion is necessary because of the recently adopted ordinance which permil's one house on each Zone R-l lot. Possage of this ordinance approximately nine months ago caused 011 structures located to the rear of the front structure to toke on 0 non- conforming status. By law no structure in this category may be structurally altered, except by virtue of a variance. In order for a variance to be approved four prerequisite conditions must be clearly satisfied by the appl icant. They are os follows. A. That there are exceptional or extraordinary circumstonces or conditions applicable to the property involved, or to the intended use of the property, that do not opply generally to the property or class of use in the Same zone or vicinity. B. That the granting of such voriance will not be materially detrimentol to the public health or welfare or injurious to the property or improvemenl's in such zone or vicinity in which the property is located. C. That such variance is necessary for the preservation and enjoyment of a sub- stantial property right of the appl icant possessed by other property in the same zone and vicinity. D.
