A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE
PERMIT NO, 00-018 TO OPERATE A 2,800 SQ.FT. INTERNET CAFE
AT 1311 S. BALDWIN AVENUE.
WHEREAS, on October 23, 2000, a Conditional Use Permit application
was filed by Paul Hsiao to operate a 2,800 sq.ft. internet cafe, Development
Services Department Case No. c.u.P. 00-018, at property commonly known as
1311 S, Baldwin Avenue; and
WHEREAS, A public hearing was held on November 28, 2000, at which
time all interested persons were given full opportunity to be heard and to present
evidence,

NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY
OF ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1, That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2, This Commission finds for the reasons set forth in the above
report:

1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injurious to the property or
improvements in such zone or vicinity,
2. That the use applied for at the location indicated is a proper use for
which a Conditional Use Permit is authorized,
3, That the site, or sites, for the proposed use are adequate in size and
shape to accommodate said use, and all yards, spaces, walls, fences, parking,
loading, landscaping and other features required to adjust said use with the land
and uses in the neighborhood.
4. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.

5, That the use applied for will not have a substantial adverse impact on
the environment, and that based upon the record as a whole there is no evidence
that the proposed project will have any potential for an adverse effect on wildlife
resources or the habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit No. CUP 00-018 to operate a 2,800 sq.ft, internet cafe,
upon the following conditions:
I, Building Code compliance and conditions of approval must be met to
the complete satisfaction of the Building Section,
2, Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3., Seating shall be limited to a maximum of fifty-eight seats (58) for the
cafe use and twenty-nine (29) seats for the internet use.
4. Noncompliance with the provisions and conditions of this conditional
use permit shall constitute grounds for its immediate ,suspension or revocation,

SECTION 4, The decision and findings contained in this Resolution
reflect the Planning Commission's action of November 28,2000, by the following

SUBJECT: Conditional Use Permit No, 00-018
SUMMARY
This Conditional Use Permit (C.U,P,) application was submitted by Paul Hsiao to
operate a 2,800 sq.ft. internet cafe for patrons to dine and access the internet, from
12:00 p.m, to 12:00 a.m. at 1311 S. Baldwin Avenue, The Development Services
Department is recommending denial of this application due to inadequate on-site
parking.

GENERAL INFORMATION
APPLICANT: Paul Hsiao (Tenant)
LOCATION: 1311 S. Baldwin Avenue
REQUEST: A Conditional Use Permitto operate an internet cafe,
SITE AREA: 391,720 sq.ft. (8.99 acres)
FRONTAGES: 660 Feet on Baldwin Avenue
680 Feet on Duarte Road
535 Feet on Naomi Avenue
EXISTING LAND USE & ZONING:
The site is developed with the Burlington Coat Factory, a two level parking
structure and various retail shops; zoned C-2 and C-2 & H-4 (along Baldwin
Avenue),

North: General commercial uses; zoned C-2 and C-2 & D
South: Retail shopping center (Sllv-On) and mixed residential uses; zoned C-
2 and R-3 respectively
East: General commercial uses; zoned C-2 & H,
West: Vons Pavilion and retail shops; zoned C-2,
GENERAL PLAN DESIGNATION:
The site is designated as Commercial.
PROPOSAL
Restaurants are permitted uses in the C-2 zone with an approved conditional use
permit.
The applicant is requesting a Conditional Use Permit to operate a proposed 2,800
sq,ft. intemet cafe that would occupy a vacant space within the commercial shopping
center at 1311 S, Baldwin Avenue, The Intemet cafe would reserve half of the space
for a restaurant use and half of the space for a internet use. The intemetcafe would
provide 58 seats for the cafe and 29 seats for the internet use, from 12:00 p.m, to
12:00 a.m" 7 days a week.
PARKING
The on-site parking consists of 771 spaces (418 spaces are Within the site's two-story
parking structure), The on-site parking does not comply with the current Code
requirements, as summarized in the following table:

The current on-site parking ratio for the shopping ~enter is 2,15 spaces per 1,000 sq.
ft. of commercial space (206,192 sq,ft.) which results in an allocation of 11 spaces for
the applicant's 2.800 sq, ft. internet cafe, Such a ratio is inconsistent with the code

The current on-site parking ratio for the shopping center is 2,15 spaces per 1,000 sq.
ft. of commercial space (206,192 sq,ft.) which results in an allocation of 11 spaces for
the applicant's 2,800 'sq. ft, internet cafe. Such a ratio is inconsistent with the code
standard of providing 10 spaces per 1,000 sq,ft, for the proposed use (I.e., 28
spaces),
Based on current parking requirements for the entire Shopping center, including the
proposed restaurant, there should be.1 ,055 on-site parking spaces.
ANALYSIS
The applicant indicated to staff that the site currently has ample on-site parking
spaces per his recent parking survey of the site. Although, the survey indicates
ample on-site parking (see attached parking survey), the survey in staff's opinion
does not reflect the current use of such parking. The parking area that is adjacent to
the location of the cafe, where patrons of the proposed cafe would likely park (See
Exhibit 1: Area #A), has virtually no parking available, Staff believes that the
proposed cafe, if approved, would further impact this area where there is already
limited parking. Also, staff is concerned with the potential Increase in traffic, which
may result from new retail uses, which may locate on this site, Uses such as eating
establishments and restaurants require conditional use permits and traffic concerns
can be addressed as part of the consideration of such applications. Other uses such
as convenience stores do not require conditional use permits and would be permitted
even though they generally are associated with increased vehicular traffic. At this
time staff does not wish to see any further increase in the site's existing parking
deficienCY and therefore is opposed to the requested conditional use permit.
CEQA
Pursuant to the prOVIsions of the California Environmental Quality Act. the
Development Services Department has prepared an initial study for the proposed
project. Said inilial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient'noise and objects of
historiCal or aesthetic significance, When conSidering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends, Therefore,a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends denial of Conditional Use
Permit No. CUP 00.018.

If the Planning Commission wishes to approve Conditional Use Permit 00-018, the
Development Services Department recommends the following conditions of approval:
1, The restaurant shall be maintained and operated in a manner that is
consistent with the application and plans submitted and approved for CUP
00-018.
2. Seating shall be limited to a maximum of fifty-eight people for the
restaurant use and twenty-eight people ~or the Internet use (excluding the
waiting areas),
3, A modification is granted for 771 on-site parking spaces in lieu of 1,055
spaces required. This approval shall not constitute an approval fora
general reduction in parking for the total site. That this parking modification
shall only be for the use approved by CUP 00-018 (Intemet caUl),
4, All City code requirements regarding accessibility, fire protection,
occupancy, and safety shall be complied with to the satisfaction of Building
Services and the Fire Department which shall include, but not limited to the
following items:
5. If only one of the proposed restrooms is to be disabled/handicapped
accessible, then both of the restrooms must be Unisex.
6, Installation of a Knox-box with keys in conformance with the Uniform Fire
Code.
7. Installation of an NFPA-72 fire alarm system in conformance with the
Arcadia Municipal Code.
8, Approval of CUP 00-018 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions
of approval.
9. All conditions of approval shall be complied with prior to completion of the
tenant improvements, and the opening of the restaurant. Noncompliance
with the plans, provisions and conditions of CUP 00-018 shall be grounds
for immediate suspension or revocation of any approvals that could result
in the closing of the restaurant.
FINDINGS AND MOTIONS
Denial
The Planning Commission should move to deny this application and adopt
Resolution No. 1625: A Resolution of the Planning Commission of the City of
Arcadia, California, denying Conditional Use Permit No. 00-025 for a 2,800 sq, ft.
restaurant at 1311 S, Baldwin Avenue.

Approval
If the Planning Commission intends to approve this Conditional Use Permit
application, the Commission should move to adopt the Negative Declaration, state
the supporting findings, and direct staff' to prepare a resolution which incorporates the
Commission's decision and specific findings,

Finding:
The Planning Commission. having reviewed the Initial Study of this proposed project and
having reviewed the written comments received prior to the public hearing of the Planning
Commission, including the recommendation of the City's staff, does hereby find and declare
that the proposed project will not have a significant effect on the environment based on the
consistency of the proposed project with the City's General Plan and Zoning Ordinance and
the inclusion of the following mitigation measure:
. The square footage of the Internet cafe shall be a maximum of 2,800 sq,ft. and the seating
shall be limited to 58 seats for the cafe use and 29 seats for the intemet use,
The Planning Commission hereby finds that this Negative Declaration reflects its independent
judgment. A copy of the Initial Study may be obtained at the location listed below. The
location and custodian of the documents and any other material which constitute the record of
proceedings upon which the City based its decision to adopt this Negative Declaration are as
follows:

I) A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by the information sources a lead agency cites in the parentheses following

The operation of the proposed business will be subject
to all other environmental plans or policies adopted by
agencies with'jurlsdiction over this area. There are no
agricultural resources or operations In the vicinity.
