HomeMy WebLinkAbout1618 - . . RESOLUTION NO. 1618 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. 00-013 TO OPERATE A 4,362 SQ.FT. RESTAURANT AT 101 W. HUNTINGTON DRIVE. WHEREAS, on July 17, 2000,. a Conditional Use Pennit application was filed by Gary Wang to operate a 4,362 sq.ft. restaurant, Development Services Department Case No. C.U.P. 00-013, at property commonly known as 101 W. Huntington Drive; and WHEREAS, A public hearing was held on August 22, 2000, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission .finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 4. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 5. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Pennit to operate a 4,362 sq.ft. restaurant, upon the following conditions: - . . I. Building Code compliance and conditions of approval must be met to the complete satisfaction of the Building Section. 2. Fire safety shall be provided to the complete satisfaction of the Fire Department. 3. Seating shall be limited to a maximum of one hundred and twenty (120) people. 4. The red metal roof shall be re-painted to an earth tone color subject to the review and approval of the Development Services Department. 5. A landscaping plan shall be submitted to the Development Services Department for review and approval prior to issuance of a building permit. 6. The parking lot shall be re-surfaced and the parking stalls shall be re-stripped in accordance with Section 9269.1. of the Arcadia Municipal Code. 7. The driveway entry on Huntington Drive shall be re-paved with stamp concrete. 8. The light ftxtures in the parking lot shall be re-painted. 9. The plywood overhang shall be stucco to continue the stucco treatment around the entire building. 10. Noncompliance with the provisions and conditions of this conditional use permit shall constitute grounds for its immediate suspension or revocation. SECTION 4. The Secretary shall certifY to the adoption of this Resolutio~ and shall cause a copy to be forwarded to the City Council of the City of Arcadia. This Conditional Use Permit (C.U.P.) application was submitted by Gary Wang to operate a 4.362 sq.ft. restaurant with seating for 120 patrons located at 101 W. Huntington Drive. The Development Services Department is recommending approval of C.U.P. 00-013 and adoption of Resolution #1618 granting the conditional use permit subject to the conditions in this staff report. In addition the Planning Commission is being requested to consider the ,architectural design review of a proposed pole sign and wall signs. GENERAL INFORMATION APPLICANT: Gary Wang (architect) " LOCATION: 101 W. Huntington Dr. REQUEST: A Conditional Use Permit to operate a 4,362 sq.ft. restaurant with seating for 120 patrons. SITE AREA: 48,594 sq.ft. (.90 acres) FRONTAGES; 86 Feet on Huntington Drive 323 Feeton Santa Clara Street EXISTING LAND USE & ZONING: The site is developed with a vacant building; zoned C-2 . . . . SURROUNDING LAND USES & ZONING: North: Single-family residential; zoned R-1. South: "100 to one" Club/restaurant and karoke bar; zoned C-2. East: Vacant Auto Dealership; zoned C-2. West: Office building; zoned C-2. GENERAL PLAN DESIGNATION: The site is designated as Commercial. BACKGROUND INFORMATION The subject site was granted a C.U.P. in 1976 (CUP 76-026) for the construction of a restaurant (Sambo's) and sincethat-time a restaurant has operated at this site. The most recent restaurant to operate at this location was Angel's Diner, which was a theme restaurant reminiscent of the 1950's that opened in June of 1994 and closed on December 31, 1995. The property has been vacant since that time. When the diner's owner, Vicorp Restaurants Inc., proposed to open their restaurant thely were required to obtain Redevelopment Agency (a.k.a "Agency") approval. Vicorp worked with the Agency to obtain approval for their design concepts to have neon lighting against polished stainless steel, tiled surfaces, glass block entry columns, etched glass windows and a red metal roof. City staff agreed with the overall design concepts, except for the red metal roof. Staff's concern with the color was the prominent location of the site (Santa Clara and Huntington), the location of the building on the property (near the street' with little setback) and the fact that there were no red metal roofs in the p~oject area. Vicorp considered the red roof an important element of the corporate image, which they wanted to establish for their restaurant chain. Although City ~aff did not support the red roof, the Arcadia Redevelopment Agency approved the existing building design on May 3,1994. PROPOSAL & ANALYSIS The applicant's proposal is to operate a 4,362 sq.ft. buffet-type restaurant with seating for 120 patrons located at 101 W. Huntington Drive, as shown on the submitted site plan. The restaurant will be open 7 days a week from 10:00 a.m. to 11 :00 p.m. In addition the Planning Commission is being requested to consider the architectural design review of a proposed pole sign and wall signs. The restaurant will not create any potential parking or traffic impacts upon the site, and the parking spaces provided exceed the City's parking requirements. Forty-four (44) parking spaces are required for the restaurant; sixty-seven (67) parking spaces are provided as shown on the plan. CUP 00-013 August 22. 2000 Page 2 . . . The site has been vacant for over five (5) years since Angel's Diner closed, and since that time the site has deteriorated. The colors of the red metal roof and exterior stucco wall's have faded. The landscaping with trees, shrubbery, and flowers have not been maintained. The parking lot surface is cracking and showing signs of disrepair. The restaurant proposal calls for improvement to the site that will consist of painting the lighting fixtures in the parking lot and the trash enclosure. The plan also includes the installation of a 7'-0" high by 12'-0" wide double face cabinet sign on an existing 18'-0" high pole, which will be covered by a rectangular sleeve painted to match the building with an overall height of 25'.0" high. Two channel letter wall signs (Great Wall Buffet) are proposed on the south and east elevation of the building with two color neon tubes (red and blue) along the entire length of the top edge of the fascia. The Development Services staff recommends a monument sign as an alternative to the proposed pole sign for the "Great Wall Super Buffet", The Redevelopment Agency as well as the Development Services Department has been encouraging monument signs both in the Redevelopment Project Area as well as throughout the City. The monument sign should incorporate in its design the building's materials and colors to make it compatible with the building's architecture. The final design shall be subject to the review and approval of the Community Development Administrator. In addition staff is recommending removal of the neon color tubes. The neon tubes are inconsistent with the characteristics of the area, and out-of- character with the design elements of the building. Reopening the restaurant will be a positive improvement to the site and will enhance the neighborhood and the surrounding prop~rties. Although the applicant has proposed improvements to the site, the following items were not addressed by the applicanf'and should be completed prior to the opening of the new restaurant: 1. Repaving and re-striping of the parking lot; 2. Clean-up all planter areas and replant where necessary; 3. Repaint the building roof and trim earth-tone colors to be approved by the Community Development Administrator; In regards to the red roof, its is staff's opinion that it should be repainted to an earth- tone color to be consistent with other roof colors in the Redevelopment Project Area. The red roof is no longer a critical part of the design concept, as with the image Vicorp wanted to establish for their Angel's restaurant chain. CUP 00-013 August 22, 2000 Page 3 . . . The applicant shall be required to comply with all code requirements as determined necessary by the Building Official, Fire Marshall, Public Works Director and Community Development Administrator. CEQA Pursuant to the provisions of the Califomia Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on ' wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit No. CUP 00-013 subject to the following conditions: 1. Seating shall be limited to a maximum of 120 persons. 2. The red metal roof shall be re-painted an earth tone color subject to the review approval of the Community Development Administrator. 3. Staff recommends a monument sign in lieu of the proposed pole sign as submitted by the applicant. Said siqn shall be submitted to the Community Development Administrator for review and approval. 4. A landscaping plan shall be' submitted to the Community Development Administrator for review and ap\lroval prior to issuance of a building permit. 5. The parking lot shall be re-surfaced and the parking stalls shall be re-striped in accordance with Section 9269.1. of the Arcadia Municipal Code. 6. The driveway entry on Huntington Drive shall be repaved with stamped concrete. 7. The light fixtures.!n the parking lot shall re-painted. 8. The plywood overhang shall be stucco to continue the stucco treatment around the entire building. 9. Repaint the building and trim with colors approved by the Community Development Administrator. 10. Approval of CUP 00-013 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate acceptance of the conditions of approval. CUP 00-013 August 22, 2000 Page 4 . . . 11. All conditions of approval shall be complied with prior to completion of the tenant improvements, and opening of the restaurant. Noncompliance with the plans, provisions and conditions of CUP 00-013 shall be grounds for immediate suspension or revocation of any approvals that could result in the closing of the restaurant. FINDINGS AND MOTIONS Approval The Planning Commission should move to approve the Negative Declaration and adopt Resolution No. 1618: A Resolution of the Planning Commission of the City of Arcadia, California, granting Conditional Use Permit No. 00-013 for a 4,362 sq. ft. restaurant at 101 W. Huntington Drive. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should move for denial and direct staff to prepare a resolution which incorporates the Commission's decision and specific findings.
