RESOLUTION 1606
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
CUP 00-003 TO OPERATE AN EDUCATIONAL LEARNING CENTER FOR
STUDENTS AGE 5-15, LOCATED AT 815 W. NAOMI AVE., #L.
WHEREAS, on April 3, 2000, a Conditional Use Permit application was filed by
Robert Fyles to operate an educational learning center for students age 5-15,
Development Services Department Case No. C.U.P. 00-003, at property commonly
known as 815 W. Naomi Avenue, #L.
WHEREAS, A public hearing was held on May 9, 2000, at which time all
interested persons were 'given full opportunity to be heard and to present evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBYRESOL YES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
4. That the granting of such Conditional Use Permit 'will not adversely affect the
comprehensive General Plan.
5. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.

SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate an educational learning center for students age 5-15,
upon the following conditions:
I. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section of the City of Arcadia.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. The maximum hours of operation shall be from 11:00 a.m. to 8:00 p.m.
Monday through Friday, and 10:00 a.m. to 6:00 p.m. on Saturday and Sunday, with a
maximum of twenty (20) computer stations shall be permitted within the facility.
4. Employees of the learning center shall park their vehicles in the parking lot
that is behind the subject.building.
5. The owner of the business shall inform parents not to stop along the driveway
aisle for dropping off or picking up students.
6. That C.U.P. 00-003 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form that is available from the
Development Services Department to indicate awareness and acceptance of the
conditions of approval.
7. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This Conditional Use Permit application was submitted by Robert Fyles to operate a
supplementary educational learning center that would administer academic programs
to children of ages 5-15 at 815 Naomi Avenue, #L. The intent of the learning center is
to aid young students to become academically successful in school.

The Development Services Department is recommending approval of CUP 00-003
and adoption of Resolution 1606 granting the conditional use permit subject to the
conditions in this staff report.
GENERAL INFORMATION

FRONTAGES: 496..77 feet along Naomi Ave. and 359.21 feet along Duarte Rd.
EXISTING LAND USE & ZONING:
The site is developed with a 64,872 sq.ft. Vons Pavilions market and a 19,881
sq.ft. multi-tenant strip commercial building. There are 425 on-site parking
spaces, and the site is zoned C-2.

GENERAL PLAN DESIGNATION:
The site is designated as Commercial
PROPOSAL AND ANALYSIS
The applicant is requesting a Conditional Use Permit to operate a 1,550 sq.ft.
supplementary educational leaming center for students of ages 5-15 at 815 W.
Naomi Avenue, Unit #L, as shown on the submitted site plan. The learning center
will have two (2) to four (4) employees, with an average of 12 students per session.
Each session will be approximately one hour. Students at the learning center will be
assigned to a computer station with software programs to teach them mathematics,
English, etc. Instructors will be available to answer question from students if they
have problems. The intent of the learning center is to aid young students to become
academically successful.

A learning center is a permitted use in the Cc2 zone with an approved conditional use
permit .
The proposed 1,550 sq.ft. learning center requires one space per 35 sq.ft. of
insfructlonal area (900 sq.ft.). Base on this requirement, 26 spaces are required for
the learning center.
Currently, the site has a parking deficiency of 33 spaces. and with the addition of the
proposed learning center the overall parking deficiency would be 51 spaces Le., 425
on-site spaces provided in lieu of 476 required by cod.

ANALYSIS
The applicant submitted a parking survey af the imrnediatearea to. the prapased
learning center far a week periad (the caunts accurred at 2:00 p.m., 4:00 p.m., and
6:00 p.m.). The survey indicated an abundance af available parking spaces in the
immediate area (See Attached Survey).
Althaugh the propased use wauld have an an-site parking deficiency af 17 spaces,
staff believes that such a deficiency wauld be mitigated because the students are nat
af driving age. Staff has visited the subject site an several different days, at different
times, and has abserved that there are ample an-site parking spaces available in the
vicinity af the prapased learning center. Staff does nat faresee that the prapased use
wauld campaund any existing deficiency ar traffic circulatian.
The applicant shall be required to. comply with all cade requirements as determined
necessary by the Building Official, Fire Marshall, Public Warks Services Director and
Cammunity DevelapmentAdministrator.
CEQA
Pursuant to. the pravlslans af the Califarnia Enviranmental Quality Act, the
Develapment Services Department has prepared an initial study far the prapased
praject. Said initial study did nat disclase any substantial ar patentially substantial
adverse change in any af the physical canditians within the area affected by the
praject including land, air, water, minerals, f1ara, fauna, ambient naise and abjects af
histarical ar aesthetic significance. When cansidering the recard as a whale, there is
no. evidence that the prapased project will have any patential far adverse effect an
wildlife resaurces ar the habitat upan which the wildlife depends. Therefare, a
Negative Declaratian has been prepared far this project.
RECOMMENDATION
The Develapment Services Department recommends appraval af Canditianal Use
Permit No.. CUP 00-003 subject to. the fallawing conditians:
1. The learning center shall be maintained and aperated in a manner that is
consistent with the applicatian and plans submitted and appraved far CUP 00-
003.
2. Emplayees af the learning center shall park their vehicles in the parking lat that is
behind the subject building.
3. There shall be no. parking ar stapping alang the driveway aisle far picking-up/ar
dropping aff af students.

4. The maximum number of students at anyone time shall not exceed twelve (12).
5. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services and the
Fire Department.
6. Approval of CUP 00-003 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions of
approval.
7. All conditions of approval shall be complied with prior to the opening of the
learning center. Noncompliance with the plans, provisions and conditions of
CUP 00-003 shall be grounds for immediate suspension or revocation of any
approvals for the remedial tutoring center;
FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve and file the Negative Declaration
and adopt Resolution No. 1606: A Resolution of the Planning Commission of the City
of Arcadia, California, granting Conditional Use Permit No. 00-003 to operate a
educational learning center.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should state the reasons for denial and direct staff to prepare the
appropriate resolution incorporating the Commission's decision and specific findings.

On the basis of this initial evaluation:
I fmd that the proposed project COULD NOT have a significant effect on the environment, and a
NEGATIVE DECLARATION will be prepared.
I find that although the proposed project could have a significant effect on the environment, there will
not be a significant effect in this case because revisions in the project have been made by or agreed to
by the project proponent. A MTIlGATED NEGATIVE DECLARATION will be prepared.
I find that the proposed project MAY have a significant effect on the environment, and an
ENVIRONMENTAL IMPACTREPORT is required.
I find that the proposed project MAY have a "potentially significant or "potentially significant unless
mitigated" impact on the environment, but at least one effect I) has been adequately analyzed in an
earlier document pursuant to applicable legal standards, and 2) has been addressed by mitigation
measures based on the earlier analysis as described on attached sheets. An ENVIRONMENTAL
IMPACT REPORT is required, but it must analyze only the effects that remain to be addressed.
I find that although the proposed project could have a significant effect on the environment, because
all potentially significant effects (a) have been analyzed adequately in an earlier EIR or NEGATIVE

EVALUATION OF ENVIRONMENTAL IMPACTS:
.
I) A brief explanation is required for aU answers except "No Impact" answers that are
adequately supported by the information sources a lead agency cites in the parentheses following
each question. A "No Impact" answer is adequately supported if the referenced information
sources show that the impact simply does not apply to projects like the one involved (e.g. the
project falls outside a fault rupture zone). A "No Impact" answer should be explained where it is
based on project-specific factors as well as general standards (e.g. the project wiU not expose
sensitive receptors to pollutants, based on a project-specific screening analysis).
2) All answers must take account of the whole action involved, including off-site as well as on-
site, cumulative as well as project-level, indirect as well as direct, and construction as well as
operational impacts.
3) Once the lead agency has determined that a particular physical impact may occur, then the
checklist answers must indicate whether the impact is potentially significant, less than significant
with mitigation, or less than significant. "Potentially Significant Impact" is appropriate if there is
substantial evidence that an effect is significant. If there are one or more "Potentially Significant
Impact" entries when the determination is made, an EIR is required.
4) "Negative Declaration: Less Than Significant With Mitigation Incorporated" applies where
the incorporation of mitigation measures has reduced an effect from "Potentially Significant
Impact" to a "Less than Significant Impact." The lead agency must describe the mitigation
measures, and briefly explain how they reduce the effect to a less than significant level
(mitigation measures from Section XVII, "Earlier Analyses," may be cross-referenced).
. 5) Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA
process, an effect has been adequately analyzed in.an earlier EIR or negative declaration. Section
15063(c)(3)(O). In this case, a brief discussion should identify the following:
a) Earlier Analyses Used. Identify and state where they are available for review.
b) Impacts Adequately Addressed. Identify which effects from the above checklist were
within the scope of and adequately analyzed in an earlier document pursuant to applicable
legal standards, and state whether such.effects.were addressed by mitigation measures based
on the earlier analysis.
c) Mitigation Measures. For effects that are "Less than Significant with Mitigation
Measures Incorporated," describe the mitigation measures which were incorporated or refined
from the earlier document and the extent to which they address site-specific conditions for the
projeCt.
6) Lead agencies are encouraged to incorporate into the checklist references to information
sources for potential impacts (e.g. general plans, zoning ordinances). Reference to a previously

The proposed use will be in an existing commercial
building, any exterior improvements will be required
to comply with local architectural standards and
illumination limits and will not result in any of the
above impacts.
U. AGRICULTURE RESOURCES. In determining
whether impacts to agricultural resources are significant
environmental effects, lead agencies may refer to the
Califomia Agricultural Land Evaluation and Site
Assessment Model (1997) prepared by the California
Dept. of Conservation as an optional model to use in
assessing impacts on agriculture and farmland. Would the
project:
a)Convert Prime Farmland, Unique Farmland, or
Farmland of Statewide Importance (Farmland), as shown
on the maps prepared pursuant to the Farmland Mapping

conversion of Farmland, to non-agricultural use?
The proposal is consistent with the commercial
designation in the General Plan and with the C-2
zoning of the site, and is reqnired to comply with the
regulations any other jurisdictional agency with

The proposed learning center and Its operation willbe
subject to local air quality regulations as administered
by the South Coast Air Quallty Management District
which should prevent any impacts relative to items (a)
and/or (b) above. There are no exterior improvements
proposed that would result In alterations to air
movement, moisture or temperature, or cause a
change In climate. No objectionable odors have been
associated with the proposed use.
