RESOLUTION NO. 1604
A RESOLUTION OF THE PLANNING COMMISSION OF THE eITY OF
ARCADIA, eALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
00-001 FOR THE RETAIL SALE OF BEER AND WINE FOR OFF-SITE
CONSUMPTION AT 140 E. DUARTE ROAD.
WHEREAS, on March 28, 2000, a Conditional Use Permit. application was filed
by Henry Miller for the retail sale of beer and wine for off-site consumption within one-
hundred fifty feet of residentially zoned property, Development Services Department
Case N:o. C.U.P. 00-001, at property commonly known as 140 E. Duarte Road; and
WHEREAS, A public hearing was held on March 28, 2000, at which time all
interested persons were given full opportunity to be heard and to present evidence:
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, eALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
DepartJnent in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health orwelfate, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the.,site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
4. That the gi'antingof such eonditional Use Permit will not adversely affect the
comprehensive General Plan.
S. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habit~t upon which the wildlife depends.

SEeTION 3. That for the foregoing reasons this eommission grants a
. Conditional Use Permit for the retail sale, of beer and wine for off-site consumption, upon
the following conditions:
1. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. The area dedicated for the. sale of beer and wine shall not exceed 6% of retail
sales area or 1 ,000 sq. ft. whicheveris less..
4. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds forits immediate suspension or revocation.
SECTIQN 4. The Secretary shall certify to the adoption of this Resolution and
shall c~use a copy to be forwarded to the City Council of the City of Arcadia.

SUBJECT: Conditional Use Permit No. CUP 00-001 for the retail sale of beer and
wine for off-site consumption to be located within one hundred fifty
(150) feet of residentially zoned property.
SUMMARY
.
This Conditional Use Permit application was submitted by Henry Miller to permit the
retail sale of beer and wine for off-site consumption in conjunction with an existing
retail "99 Cent Only Store" at 140 E. Duarte Road. The Development Services
Department is recommending approval of CUP 00-001 and adoption of Resolution
1604 granting the conditional use permit subject to the conditions in this staff report.
GENE~L INFORMATION
APPLICANT: Henry Miller ("99 Cent Only Store" representative)
LOCATION: 140 E. Duarte Road
REQUEST: A Conditional Use Permit for the retail sale of beer and wine for off-
site consumption to be located within one hundred fifty (150) feet of
residentially zoned property.
SITE AREA: 88,800 sq.ft. (2;04 acres)
FRONTAGES: 399.21 feet along E. Duarte Road and 100 feet along S. Second
Avenue
EXISTING LAND USE & ZONING:
The site is improved with a 32,760 sq.ft. commercial shopping
center with 105 on-site parking spaces. The property is zoned C-1 &
D (Limited Commercial with a Design Overlay).

GENERAl PLAN DESIGNATION:
The site is designated as Commercial
BACKGROUND
Originally the "99 Cent Only Stores" business opened in Arcadia in 1984 at 645 W.
Duarte Road. The business operation consisted of the retail sale of goods and
products in conjunction with the incidental retail sale of beer and wine for off-site
consumption. In June of 1998, the company relocated their business operation to
140 E. Duarte Road. The new location requires an approved Conditional Use Permit
for the retail sale of beer and wine for off-site consumption, because the site is
located within one hundred fifty of residentially zoned property, as shown on the
attached land use and zoning map.
PROPOSAL AND ANALYSIS
The applicant is seeking approval for the retail sale of beer and wine for off-site
consumption in conjunction with the existing 21,000 sq.ft. "99 Cent Only Store" at 140
E. Duarte Road. The sale of beer and wine will be incidental to the primary business
operation, which consists ofthe retail sale of goods and products.
Based upon the applicant's proposal and background information about the business
operation, it is staff's opinion that the proposal would be an appropriate addition to
the business operation with an approved Conditional Use Permit, provided that the
retail sale of beer and wine for off-site consumption remains incidental to the primary
retail business. Also, staff is not aware of any problems related to the sale of beer
and wine at the previous "99 Cent Only Store" operation at 645 E. Duarte Road. The
applicant has indicated that they would utilize approximately 1,000 sq.ft. of the retail
sales area for the sale of beer and wine (6% of the retail salesarea:16,328 sq.ft.).
In staff's opinion the retail sale Of beer and wine for off-site consumption will remain
incidental to the retail sale of goods and products i.e., the retail sale of beer and wine
should not exceed 6% of the retail sales floor area.
The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Public Works Services Director and
Development Services Director.

CEQA
Pursuant to the provIsions of the Califomia Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora; fauna, ambient noise and objects of
historical or aesthetic significance. When consitfering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 00-001 subject to the following conditions:
1. The area dedicated for the sale of beer and wine shall not exceed 6% of retail
sales area or 1,000 sq.ft. whichever is less.
2. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of the Building Official and
the Fire Marshall.
3. Approval of CUP 00-001 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions of
approval.
4. Noncompliance with the plans, provisions and conditions of CUP 00-001 shall be
grounds for immediate suspension or revocation of any approvals for the retail
sale of beer and wine for off-site consumptiom.
FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve and file the Negative Declaration
and adopt Resolution No. 1604: A Resolution of the Planning Commission of the City
of Arcadia, Califomia, granting Conditional Use Permit No. 00-001 for the retail sale
of beer and wine for off-site consumption at 140 E. Duarte Rd.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are adequately
supported by the information sources a lelw. agency cites in the parentheses following each
question. A "No Impact" answer is adequately supported if the referenced information sources
show that the impact simply does not apply to projects such as the one involved (e.g., the project
is not within a fault rupture zone). A ''No Impact'~ answer should be explained where it is based
on project-specific factors as well as general stanaards (e.g., the project will not expose sensitive
receptors to pollutants, based on a project-specific screening analysis).
2. AIl answers must take account of the whole action involved, including off-site as well as on-site,
cumulative as well as project-level, indirect as well as direct, and construction related as well as
operational impacts.
3. "Potentially Significant Impact" is apjlropriate if there is substantial evidence that an effect is
significant. If there are one or more, "Potentially Significant Impact" entries when the
determination is made, an Environmental Impact Report is required.
4. ''Potentially Significant Unless Mitigation Incorporated" applies where the incorporation of
mitigation measures has reduced an effect from ''Potentially Significant Impact" to a "Less Than
Significant Impact." The lead agency must describe the mitigation measures, and briefly explain

the end of the checklist.
6. Lead agencies are encouraged to incorporate into the checklist, references to information sources
for potential impacts (e.g., general plans, zoning ordinances). Reference to a previously prepared

subject area. The operation of the proposed business will be subject to all other environmental plans or policies
