A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALlFORNlA, GRANTING CONDmONAL USE
PERMIT NO. CUP 98-018 FOR A THEOLOGICAL SEMINARY AT
141 E. DUARTE ROAD.
WHEREAS, on August 17, 1998, an application was filed by Dr. Daniel Wong
of the Truth Theological Seminary to establish and operate a theological seminary;
Development Services Department Case No. CUP 98-018, in an existing 9,400 sq. ft.
two-story office building at 141 E. Duarte Road, more particularly described as follows:
Lots 13 & 14 of Arcadia Santa Anita Tract in the City of Arcadia, County of
Los Angeles,. State ofCa1ifomia, as per Map recorded in Book 1023, Pages
45 &46 of Maps in the Office of said County Recorder.
WHEREAS, a public hearing was .held on September 22, 1998 and
October 27, 1998, at which time all interested persons were given full opportunity to be
heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
. ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report dated October 27, 1998 is true and correct.
SECTION 2. This Commission finds:
1. That the granting of the Conditional Use Permit will not be detrimentl!l to the
public health or welfare, nor injurious to. the property or improvements in the zone or
vicinity.
2. That the use applied for at the location indicated is properly one for which
a Conditional Use Pennit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping
and other. features required to adjust said use with the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the-kind of traffic generated by the proposed use.

5. That the subject.property is designated for commercial use in the General Plan,
that the proposed use is consistent with that designation, and that the granting of the
Conditional Use Pennit will not adversely affect the comprehensive general plan.
6. That the evaluation of the environmental impacts asset forth in the initial study
are appropriate and that the project; as mitigated, ~ have no significant effect upon the
environment within the meaning of the California Environmental.Quality Act of 1970, and,
when considering the project as a whole, there was no evidence before the City that the
proposed project would have any potentially adverse effect on wildlife resources or the
habitat upon which wildlife depends, and therefore, a Negative Declaration with mitigation
measures should be approved.
SECTION 3. That for the foregoing reasons this Commission approves
Conditional Ur Pennit No. CUP 98-018 to establish and operate a theological seminary in
the 9,400 sq. ft. two-story office building at 141 E. Duarte Road, subject to the following
conditions:
1. The theological seminary and the site shall be operated and maintained in a
ma.nner that is consistent with the plans and proposal presented for CUP 98-018 and shall
_ . include the following provisions:
a. Classes shall be limited to 20 students.

b. No mOre than one class may be in session at a time.
c. No more than 30 persons may occupy the Seminary at any time, except that on
Monday mornings, from 11:00 a.m. to 12:00 noon, chapel services may be held, with a
maximum attendance of 40 persons.
d. A public hearing shall be set six (6) months from the date of occupancy of the
building by the Seminary, at which time testimony will be heard on the question of
compliance by the Seminary.with the conditions of this grant and any modifications which
may appear appropriate, at which time the grant may be modified or tenninated, at the
discretion of the Planning Commission.
e. A full and complete set of these conditions shall be posted at a prominent
location at the Seminary, and shall be provided to each student and each staff member upon
enrollment at the Seminary.

f. The existing tutorial center cannot remain at this location because of the limited
parking.
2. For "Just Cause" as determined by the Development Services Department, a
noticed public hearing before the Planning Commission to review the Conditional Use
Permit granted herein shall be conducted. At that hearing the Commission may suspend,
revoke, or re-condition (i.e."amend or add conditions) this pennit. For the purposes of this
condition of approval, "Just Cause" shall mean a probable violation of the existing
conditions ofapproval based on complaints, observations, or other verifiable infonnatiotL
3. The plans and proposal shall be amended/revised to include the following items
to the satisfaction of the Community Development Administrator:
a. The existing concrete block trash enclosure adjacent to the alley shall be
equipped with solid metal gates, and an additional masonry enclosure shall be provided to
properly accommodate the recyclables bin.
b. Any plumbing backflow devices existing or to be installed shall be screened
from public view to the satisfaction of the Community Development Administrator.
c. The driveway apron onto Duarte Road is to be widened to 26-feet to match the
width of tile parking lot drive aisle. The driveway apron shall be constructed in
confonnance with APW A standards to the satisfaction of the City Engineer.
4. All City code requirements , regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but are not limited to the following items:
a. Two disabled access'toiIet rooms (one male, one female) on the ground floor
must be available in confonnancewith the Unifonn Building Code.
b. Two disabled access parking-spaces, one of which shall be van accessible, must
be provided. These parking spaces are to be provided in confonnance with the Unifonn
Building Code.
c. A Knox-Box With keys shall be installed in confonnance with Unifonn. Fire
Code, Section 902.
d.- - An NFPA-72 fire alarm system shall be installed in-accordance with the
Unifonn Building Code and all other applicable provisions of the Arcadia Municipal Code.

e. An NFPA-13 central-station monitored automatic fire sprinkler system with
quick response sprinkler heads must be installed by a State licensed C-16 contractor and
representative sprinkler heads'with identification as to their locations in the building shall be
provided in a spare sprinkler box. A certified copy of the central-station-monitoring
contract must be filed with the Fire Department prior.to occupancy.
f. A fire hydrant must be located on the same. side of the street and within 150
feet of the on-site fire department connection.
5. Domestic water, fire sprinkler, and landscape irrigation services for the building
and lot sha1l be provided to the satisfaction of the Arcadia Water Division including the
submittal of a Water Meter Clearance Application to ensure adequate water meter and
service size. If a new water service is necessary, installation of the new service and
abandonment of the existing service shall be performed by the Arcadia Water Division at the
applicant's expense.
6. Approval of CUP 98-018 shall not take effect until the property owner and
_ applicant have executed and filed the Acceptance Form available from the Development
. Services Department to indiCate acceptance of the coilditions ofapproval.
7. All conditions of approval sha1l be complied with prior to the conducting of
classes at the subject. property. Noncompliance with the plans, provisions and conditions of
approval for CUP 98-018 shall be grounds for immediate suspension or revocation of any
approvals, which could result. in the cessation of classes,
SECTION 4. The decision, findings, and conditions of approval contained in this
Resolution reflect the Planning Commission's action. of October 27, 1998, by the following

Re: CUP 98-018
This is in reply to your letter dated November 23, 1999, with
regard to CUP 98-018 Six month public hearing. Since we received
the Conditional Use Permit in June 1999, we have operated as
a theological seminary. We have complied with your conditions
as specified in your letter dated November 3, 1998. While
awaiting Bureau for Private Postsecondary and Vocational
Education's approval to offer degree granting programs, we have
started evening diploma classes since September 7, 1999. One
class which meets on Monday evenings has an enrollment of 30.
In order to meet the City's conditions, the class was moved
to meet at Mandarin Baptist Church of Pasadena, at 501 N. Santa
Anita Ave., Arcadia, CA 91006. Another class which meets on
Tuesday evenings has an enrollment of 40. It was divided into
two classes, one from 7:00 to 8:15 P.M. and the other from 8:30
to 9:45 P.M. At the close of both classes on December 6 & 7,
neighbors' overa.ll responses were very positive.
For next term, starting from January 3, 2000, we plan to offer
three courses, to be conducted on Monday, Tuesday and Thursday
evenings.
In accordance with your instructions this Seminary. has its
offices, class room, chapel and library on the first floor.
We have another class room and a conference room on the second
floor.
We have very good relationships with our neighbors and
surrounding businesses. Enclosed herewith are statements of
support signed by our neighbors and surrounding businesses.
We also held a reception for the neighbors on December 14, 1999.
In our original application for the Conditional Use Permit we
were thinking of day time students. In our present situation
of conducting evening classes, we wish that the condition of
limiting each class to not. more than 20 students be modified.

The following revisions to a Conditional Use Pennit for a theological seminary that is

A) Revise Condition No. 1.a. to increase the maximum class attendance limit from 20
students to 30 students for the hours of 8:00 a.m. to 6:00 p.m. on weekdays and to 60
students for weekends and weekdays after 6:00 p.m.
B) Delete Condition No. 1.b. that requires that no more than one class be in session at a

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are

31. The site is flat in nature with angled frontage along Duarte
Road. The site contains a 2-story building, 34 parking
spaces, landscaped areas, and an .alley to the north. No
historical structures exist. The building contained a dance
school, a tutorial school, an architect's office, a pager
sales, and medical health office etc. before the Truth
Theological Seminary purchased the building. Now it is
being used by the Seminary for instruction of theological
and biblical courses.
32. The surrounding properties to the north are developed with
2-story residential apartments/condominiums ands4.ngle resi-
dences. The properties to the east and west are developed
with a bank, retail and restaurant uses. Theproperties
to the south are developed commercially, market etc.

TRUTH THEOLOGICAL SEMINARY
BUSINESS PLAN
Truth Theological Seminary is a non-profit Religious Corporation
that has been in existence since 1997. This corporation is
under the direction of a Chairman of the Board of Directors and
President. The applicant has served 5 years as Chairman of
Board of Directors of another theological seminary in Los
Angeles and over 2 years as Chairman of Board of Directors of
this Seminary.
The proposed use of the site is to operate a theological seminary
for adults. The Seminary has already been granted CUP 98-018
since June 1999. This application is to request modification
of the original conditions as contained in Resolution #1578 as
follows.:
1. a. Attendance for all classes shall be limited to 30/60 students.
[Change the attendance limit to 30 students for weekday
business hours (8 a.m. to 6 p.m.) and to 60 students for
non-business hours (weekdays after 6 p.m.)]

c. Amend to limit to 40 persons during weekday business hours
(8 a.m. to 6 p.m.) and to 80 persons for non-business hours
(weekdays after 6 p.m. and weekends), provided that addi-
tional parking is available within 500 feet (per 9269.60).
When the Seminary is in full operation, there will be about 5
administrative staff, 2 full-time professors and 30/60 students
during the daylevening respectively. The staff will include
President, Administrative Vice President, Academic Vice Presidentl
Academic Dean, Registrar and Secretary/Receptionist. Approxi-
mately 17 part-time faculty instructors will come at various
times to teach one or more courses.
The basic elements that are provided by the Seminary include a
Chapel, Library, Classrooms and Offices. The present usage of
the building includes the following:

Dear Rev. Chang:
The Arcadia City Planning Commission, at their February 22, 2000
meeting, approved your requested revision of Resolution No. 1578 for
Conditional Use Permit No. CUP 98-018, which permits a theological
seminary at 141 E. Duarte Road.
Condition Nos. 1.a., 1.b. and 1.c. are revised to read as follows:
1. The theological seminary and the site shall be operated
and maintained in a manner that is consistent with the .
plans and proposal presented for CUP 98-018 and shall
include the following provisions:
a. Classes shall be limited to a maximum of 30 students
for the hours of 8:00 a.m. to 6:00 p.m. on weekdays
and to a maximum of 60 students for weekends and
weekdays after 6:00 p.m.
b. Deleted.
c. Not more than 40 persons may occupy the Seminary
during the hours of 8:00 a.m. to 6:00 p.m. on
weekdays and up to a maximum of 80 persons may
occupy the Seminary at any other time provided that at.
least an additional 35 parking spaces are available
during those times in accordance with the City's
parking regulations.
A new Resolution, No. 1603 is being drafted to formalize the approval
of the revision to CUP 98-018, and will be presented to the
Commission for adopti~n at their March 14, 2000 meeting.

There is a five (5) working day appeal period after the adoption of the resolution.
Appeals must be filed by Tuesday, MarCh 21 i 2000. You will be notified if an
appeal is filed. .
For the revised conditions of approval to be offull effect, a covenant binding the
additional parking to the Seminary use must be executed by all of the parties
involved; Le., the Seminary, the owner of the additional parking, and the City of
Arcadia. In order for this covenant to be drafted, the following documents and a
$75.00 administrative fee must be provided to the Community Development
Division:
. Copies of the deeds and title reports for the properties involved
(Le., both the Seminary and the additional parking)
. Documents of authorization for the signatories for the Seminary and
for the ownership oHhe additional parking.
. A site plan of the additional parking indicating the parking spaces to
be available for use by the Seminary.
Once these documents have been received,. the covenant will be drafted by the
City Attorney's Office and then sent to the parties .for signatures. The signatures
must be notarized, and the applicant must provide a Check for am 'amount to be
determined for the recording fees. Please see the enclosed handout.
If the revised conditions of approval are not implemented within one year
(by February 22, 2001) the approval shall expire and the revision shall be null
and void. If an extension is necessary, a written request and fee must be
submitted to the Community Development Division in time for the Planning
Commission to consider the extension request prior to the expiration date.
