RESOLUTION 1597
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE F'ERMIT NO.
99-015 TO OPERATE A 752.8Q.FT COFFEE SHOP WITH SEATliNG FOR 22
PATRONS AT 848 W. DUARTE ROAD.
WHEREAS, on August 4, 1999, a Conditional Use Permit application was filed
by Rachel Lieu to operate a 752 sq.ft. coffee shop with seating for 22 patrons,
Development Services Department Case No. C.U.P. 99-015, at property commonly
known as 848 W. Duarte Road, more particularly described in Exhibit"A".
WHEREAS, A public hearing was held on September 14, 1999, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOL YES AS FOLLOWS:
SECTION I. That the fachial data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds;
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
4. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
5. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will hilve any potential for an adverse effect on wildlife'r.:sources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
. Conditional Use Permit to operate 752 sq.ft. coffee shop with seating for 22 patrons,
upon the following conditions:
1. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. That the hours of operation shall be limited from 7:00 a.m. to 12:00 p.m.,
Monday through Sunday, with a maximum seating of22 persons.
4. There shall be no food preparation on the premises and that all food served
shall be pre-baked and prepackaged.
S. No lunches or dinners shall be served and the use shall remainslrictly a coffee
shop.

6. A modification shall be granted for 383 on-site parking spaces in lieu of 394;
and this approval shall not constitute an approval for the general reduction in parking for
the total site. That this parking modification shall only be for the use approved by C.U.P.
99-015 (coffee shop).
7. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its, immediate suspension or revocation.
SECTION 4. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia

SUBJECT: Conditional Use Permit No. CUP 99-015 to operate a ?52 sq.ft. coffee
bar with seating for 22 patrons from 7:00 a.m. to 12:00 a.m., seven
days a week.
SUMMARY
This Conditional Use Permit application was submitted by Rachel Lieu to operate a
752 sq.ft. coffee bar with seating for 22 patrons that would occupy a portion of an
existing 3669 sq.ft. Banking Institution (Intemational Bank of Califc1mia) located at
848 W. Duarte Road. The coffee bar will be open 7 days a week fr<:lm 7:00 a.m. to
12:00 a.m. The Development Services Department is recommending approval of
. CUP 99-015 subject to the conditions in this staff report.

GENERAL PLAN DESIGNATION:
The sUbject site is designated as Commercial.
PROPOSAL
The applicant is requesting a Conditional Use Permit to operate a 7'52 sq.ft. coffee
bar with seating for 22 patrons that would occupy a portion of an existing 3,669 sq.ft.
Banking Institution located at 848 W. Duarte Road, as shown on tho submitted site
plan. The coffee bar's business will consists of the retail sale and sl~rving of freshly
brewed coffee and prepackage pastries. No meals will be prepared on the premises.
The coffee bar will be open 7 days a week from 7:00 a.m. to 12:00 a.m. The
intention !Jf opening the coffee bar at the subject location is to increase retail and
pedestrian activity at the north/east comer location of the shopping cl~nter, which the
owner believes is underutilized.
BACKGROUND INFORMATION
Several Conditional Use Permits have been granted for restaurant related use at the
subject site, which is commonly known as "President's Square." On November 22,
1988 the Planning Commission granted a CUP for three restaurants of 4,800 square
feet, 1,600 squars feet, and 1,200 square feet. On May 8, 199.0 the Planning
Commission granted a CUP for Tawa Supermarket for the salle of alcoholic
beverages within the grocery store for off-premise consumption within 150 feet of
residentially zoned property, and for an eating establishment within the grocery store
with seating for 12 person. On April 9, 1999, the Planning Commission approved a
CUP for a 14,179 sq.ft. food court facility at the site with a parking modification to
permit 383 on-site parking spaces in lieu of385 required.
ANALYSIS
The applicant is proposing a coffee bar that will only consists of tho retail sale and
serving of freshly brewed coffee and prepackage pastries. Staff believes the coffee
bar will not result in any parking or traffic impacts due to different peak parking
demands of various businesses at the site. Unlike restaurants where the peak
parking demands are during lunch and dinner hOUrs, the proposed coffee bar's peak
parking demands are in the morning and late evenings. Also, the two) peak business

Based upon the applicant's proposal and "Parking Survey," it is stafrs opinion that
the proposed coffee bar will not create any potential parking or traffic impact for the
site. The applicant shall be required to comply with all code requirements as
determined necessary by the Building Official, Fire Marshall, Mainte,nance Service
Director and Development Services Director.
CEQA
Pursuant to the provIsions of the Califomia Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise, and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
,
The Development Services Department recommends approval of Gonditional Use
Permit No. CUP 99-015 subject to the following conditions:
1. Seating shall be limited to a maximum of 22 persons.
2. There shall be no food preparation on the premises and all food served shall be
pre-baked and prepackaged.
3. No lunches or dinners shall be served and use shall remain strictly a coffee bar.
4. The square footage of the coffee bar shall be a maximum of 752 ,sq.ft.
5. That an on-site parking modification be granted for 394 parking !ipaCeS in lieu of
383 spaces required by Code. This parking modification does not constitute an
approval of a general reduction of the parking requirement for the entire
shopping center, but only for the specific use approved by CUP 99-015.
3. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services and the
Fire Departmentwhich shall include, but not limited to the following items:
a. If only one of the proposed restrooms is to be disabled/handicapped
accessible, then both of the restrooms must be unisex.
b. Installation of a Knox-box with keys in conformance with the Uniform Fire
Code.

c. Installation of an NFPA-72 fire alarm system in conformance with the
Arcadia Municipal Code.
4. Approval of CUP 99-015 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate. acceptance of th,e conditions of
approval.
5. All conditions of approval shall be complied with prior to completion of the tenant
improvements, and opening of the coffee bar. Noncompliance with the plans,
provisions and conditions of CUP 99-015 shall be grounds for immediate
suspension or revocation of any approvals that could result in the closing of the
restaurant.
FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1597: A Resolution of the Planning Commission of
the City of Arcadia, California, granting Conditional Use Permit No. 99-015 for a
752 sq. fto coffee bar at 848 W. Duarte Road.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution which
incorporates the Commission's decision and specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:
. 1. A brief explanation is required for all answers except "No Impact" anSWI:r5 that are adequately
supported by the information sources a lead agency cites in the parentheses following each
question. A "No Impact" answer is adequately supported if the referenced information sources
show that the impact simply does not apply to projects such as the one involved (e,g., the project
is not within a fault rupture zone). A ''No Impact" answer should be explained where it is based
on proJect-specific factors as well as general standards (e.g., the project will not expose sensitive
receptors to pollutants, based on.a project-specific screening analysis).
