RESOLUTION NO. 1595
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT
NO. CUP 99-013 FOR A SMALL EATING ESTABLISHMENT WITH
TABLES AND CHAIRS FOR A MAXIMUM OF 15 PEOPLE IN AN 886
sa. FT. RETAIL SPACE AT UNIT-A OF 160 EAST DUARTE ROAD.
WHEREAS, on June 30, 1999, an application was filed by H:,iu Ling Liu to
operate an 886 sq. ft. bakery with tables and chairs for 15 people; Development
Services Department Case No. CUP 99"013, in Unit-A of 160 East Duarte Road,
more particularly described as follows:
Parcels 1 and 2 of Parcel Map No. 15487 in the City of Arcadia, County
of Los Angeles, State of California, as per Map recorded in Belok 167,
Pages 88 and 89 of Maps, in the Office of said County Recorder.
WHEREAS, a public hearing was held on August 10, 1999, at which time all
interested persons were given full opportunity to be heard and to pres'~nt evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report dated August 10, 1999 are true and correct.
SECTION 2. This Commission finds:
1. That the granting of the Conditional Use Permit will not b(! detrimental to
the public health or welfare, nor injurious to the property or improvements in the
zone or vicinity.
2. That the use applied for at the location indicated is pmperly one for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size, and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses in
the neighborhood.
4. That the site abuts streets and Highways adequate in width and
. pavement type to carry the kind of traffic generated by the proposed LIse.

5. That the subject property is designated for commercial use in the
General Plan, that the proposed use is consistent with that designation, and that the
granting of the Conditional Use Permit will not adversely affect the comprehensive
general plan.
6. That the evaluation of the environmental impacts as set fo~h in the initial
study are appropriate and that the project will have no significant e,ffect upon the
environment within the meaning of the California Environmental Quality Act of 1970,
and, when considering the project as a whole, there was no evidence before the City
that the proposed project would have any potentially adverse effect on wildlife
resources or the habitat upon which wildlife depends, and therefore, a Negative
Declaration should be approved.
SECTION 3. That for the foregoing reasons this Commission approves
Conditional Use Permit No. CUP 99-013 for a small eating establishment with tables
and chairs for a maximum of 15 people in an 886 sq. fl. retail spac:e at Unit-A of
160 East Duarte Road, subject to the following conditions:
1. The use approved by CUP 99-013 is limited to a small eating
establishment with tables and chairs for a maximum of 15 peoplEl that shall be
operated and maintained in a manner that is consistent with the proposal and plans
submitted and approved for CUP 99-013.
2. All City requirements regarding accessibility, fire protectkm, occupancy,
safety, site design, and water service shall be complied with to the satisfaction of the
Building Official, Fire Marshall, Community Development Administrator, and Public
Works Services Director which shall include, but are not limited t,) the following
items:
a. Provision of a grease interceptor, if necessary.
b. A disabled van accessible parking space shall be provided.
c. Installation of a Knox-box with keys per UFC Section 902.
d. Installation of an NFPA-72 fully automatic addressable fire alarm system
that is central station monitored at all times.
e. The fire alarm room shall be properly labeled.

f. Actual occupancy limits, seating arrangements, and exitinlJ requirements
shall be based on the final design. A seating plan approved by the E:uilding Official
and Fire Marshall shall be posted in a conspicuous location.
g. A Modification for 5 parking spaces in lieu of 18 spaces is granted for
CUP 99-013 along with a reduction of one space, if necessary to comply with the van
accessible parking space requirement, and is in addition to the ModifiC'.ations granted
for CUP 86-010 and CUP 93-002. These Modifications do not consUMe an approval
for a general reduction of the parking requirement for the retail builcling, but rather
only for the specific uses approved by the CUPs, except with regard to the one
space reduction necessary to accommodate the van accessible parking space.
h. Solid metal gates shall be installed on the trash enclosure,
i. Backflow preventers shall be provided on the fire sprinl{ler system as
approved by the Water Division, and located and screened to the satisfaction of the
Community Development Administrator.
j. A Water Meter Clearance Application shall be submitted to the Arcadia
Water Division to ensure adequate water service and meter size. If the existing
water service and/or meter are inadequate, the facilities shall be abandoned and
new facilities installed by the Arcadia Water Division at the applicant's or owner's
expense.
3. Approval of CUP 99-013 shall not take effect until the property owner
and applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate awareness and acceptance of the
conditions of approval.
4. All conditions of approval shall be complied with prior to the installation
of tables and chairs at the subject property. Noncompliance with the plans,
provisions and conditions of CUP 99-013 shall be grounds for immedi::ate suspension
or revocation of any approvals, which would result in removal of '-he tables and
chairs.

SECTION 4. The decision, findings, and conditions of approval contained
in this Resolution reflect the Planning Commission's action of August 10, 1999, by
the following vote:
AYES: Commissioners Huang, Kalemkiarian, Sleeter and Bruckner
NOES: None
ABSENT: Commissioner Murphy
SECTION 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City ()f Arcadia.

A proposed 886 sq. ft. bakery at Unit-A of 160 E. Duarte Road.
SUMMARY
This Conditional Use Permit application was submitted by Hsiu Ling Liu to operate
an 886 sq. ft. bakery with tables and chairs for 15 people in Unit..A of the retail
building at 160 E. Duarte Road. The Development Services Department is
recommending approval subject to the conditions listed in this report.

GENERAL INFORMATION
APPLICANT: Hsui Ling Liu
LOCATION: Unit-A of 160 E. Duarte Road
REQUEST: A Conditional Use Permit and parking modification for an 886 sq. ft.
bakery with tables and chairs for 15 people. The daily hours of
operation will be 9:00 a.m. to 9:00 p.m.
SITE AREA: 24,400 sq. ft. (0.56 acre)
FRONTAGES: 136.59 feet along E. Duarte Road
184.33 feet along S. Second Avenue
EXISTING LAND USE & ZONING:
The subject comer site is improved with a 4,57:7 sq. ft. retail
building with 24 on-site parking spaces. The propert:f is zoned C-2:
General Commercial.

GENERAL PLAN DESIGNATION: Commercial
BACKGROUND
The subject retail building was developed in 1985. There are 24 on-site parking
spaces. It is a separate piece of property from the shopping center anchored by the
99~ Store, but there are cross-easements between the two properties for access.
Under current requirements there should be 56 on-site parking spaGes for a 4,577
sq. ft. retail building with the existing tenant mix. However, the property is
considered legal-conforming wiih its current 24 on-site parking spaces (5 spaces per
1,000 sq. ft.) based on modifications granted in conjunction with the Conditional Use
Permits for the yogurt shop (CUP 86-010) and game arcade (CUP 98.-002).

PROPOSAL & ANALYSIS
The applicant is proposing an 886 sq. ft. bakery with tables and chairs for 15 people.
The daily hours of operation will be 9:00 a.m. to 9:00 p.m. ThEl applicant has
indicated that he will be selling pastries and assorted drinks.
Parkina
The subject retail building conforms to the parking requirement of 5 spaces per
1,000 sq. ft. for retail uses. A bakery with take-out sales only is considered a retail
use and would be allowed by-right. However, a bakery with on-site consumption is
considered an eating establishment and requires 20 parking spaces per 1,000 gross
square feet. The result is a parking requirement of 18 spaces for this proposal,
rather than the 5 parking spaces allotted to the subject commercial space, and
therefore requires a parking modification of 13 spaces.

There are 24 on-site parking spaces. However, based on I:urrent parking
requirements for each of the individual uses in the retail buildin!~, including the
proposed bakery, there should be a total of 69 on-site parking spaces and one
loading zone. The CUP granted for the yogurt shop (CUP 86-010) approved a
deficiency of 11 parking spaces, and the CUP for the game arcade (CUP 98-002)

approved a deficiency of 20 spaces with conversion of the loading zone into a
parking space. With this proposal and its 13 parking space modification, there will
be an overall deficiency of 45 spaces.

With the proposed bakery, this retail building will be fully occupied. The adjacent
shopping center is also fully occupied, and has seen an increase in activity over the
past year since the major anchor space was occupied by the 99i Store.
While the subject retail building and the adjacent shopping center oach have their
own on-site parking spaces, the reality is that the two properties share parking.
In particular, the parking spaces in the area to the east of the adj.acent shopping
center and to the south of the subject retail building appear to be readily shared by
the businesses at the two properties.
A review of the current parking situation by staff indicates that there is not a parking
problem at this retail building. Staff took the following counts of the on-site parking
during the week of July 19 through 24:

The limited amount of seating and the specific type of service indicated by the
applicant's proposal (a bakery selling pastries and assorted drinks) should prevent
this proposal from creating a parking problem because the proposed use is primarily
a bakery.
However, if the business were to be some other type of eating establishment, such
as a coffee shop where customers spend longer periods of time, mom of the parking
might be used. Nevertheless, based on staffs observations, it does not appear that
any type of eating establishment with limited seating would result in a parking
problem. In fact, a bakery/coffee shop could be a good complement to the other
businesses in this area.
CEQA
Pursuant to the provIsions of the Califomia Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there
is no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 99-013 subject to the following conditions:
1. The use approved by CUP 99-013 is limited to a small eating establishment with
tables and chairs for a maximum of 15 people that shall be operated and
maintained in a manner that is consistent with the proposal and plans submitted
and approved for CUP 99-013.
2. All City requirements regarding accessibility, fire protection, occupancy, safety,
site design, and water service shall be complied with to the salisfaction of the

PLANNING COMMISSION ACTION
Approval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1595: A Resolution of the Planning C:ommission of
the City of Arcadia, California. granting Conditional Use Permit No. CUP 99-013
for a small eating establishment with tables and chairs for at maximum of
15 people in an 886 sq. ft. retail space at Unit-A of 160 E. Duarte noad.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution
incorporating the Commission's decision and specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by the information sources a lead agency cites in the
