RESOLUTION 1592
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
99-010 TO ADD A 473 SQ.FT. OUTDOOR DINING AREA WITH BEER AND
WINE SERVICE TO AN EXISTING RESTAURANT AT 627 W. DUARTE
ROAD.
WHEREAS, on May 17, 1999, a Conditional Use Permit application was filed by
Angela W~ to add a 473 sq.ft. outdoor dining area with beer and wine service,
Development Services Department Case No. C.D.P. 99-010, at property commonly
known as 627 W. Duarte Road, more particularly described in Exhibit "A".
WHEREAS, A public hearing was held on June 22, 1999, at which time all
interested persons were.given full opportunity to be heard and to present evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOL YES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
4. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
5. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there IS no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
. Conditional Use Pennit to add a 473 sq.ft. outdoor dining area to an existing restaurant,
upon the following conditions:
I. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. That the hours of operation shall be limited from 11:00 a.m. to 10:00 p.m.,
Monday through Sunday.
4. That the outdoor dining area shall not exceed 473 sq.ft., as shown on the
proposed floor plan.
5. That the maximwn nwnber of outdoor seating shall not exceed thirty-six (36)
seats.

6. A modification shall be granted for 214 on-site parking spaces in lieu of 423;
and this approval shall not constitute an approval for the general reduction in parking for
the total site. That this parking modification shall only be for the use approved by C. u.P.
99-010 (outdoor dining area to an existing restaurant).
7. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUBJECT: Conditional Use Permit No. CUP 99-010 to add a 473 sq.ft. outdoor
dining area with beer and wine service at 627 W. Duarte Rd.

SUMMARY
.
This Conditional Use Permit application was submitted by Angela Wu to add a 473
sq.ft. outdoor dining area with beer and wine service to an existing restaurant at 627
W. Duarte Road. The restaurant will be open 7 days a week from 11 :00 a.m. to
10:00 p.m. Currently, the restaurant's seating is for 100 patrons. The Development
Services Department is recommending approval of CUP 99-010 subject to the
conditions in this staff report.
GENERAL INFORMATION
APPLICANT: Angela Wu (Sole proprietor)
LOCATION: 627 W. Duarte Rd.
REQUEST: A Conditional Use Permit to add a 473 sq.ft. outdoor dining area to
an existing restaurant (Cafe St. Michel).
SITE AREA: 110,932 sq.ft. (2.55 acres)
FRONTAGES: Approximately 389 feet on W. Duarte Road, and 310 feet on Arcadia
Avenue.
EXISTING LAND USE & ZONING:
The site is developed with a 48,175+ sq.ft. commercial shopping
center with 214 on-site parking spaces. The property is zoned C-2
& H-4 (General Commercial with a Height Overlay for a maximum of
4 stDries, not to exceed 45 feet).

SURROUNDING LAND USES & ZONING:
North: Multiple family residential: zoned R-3.
South: Offices: zoned C-2 & H-4.
East: Offices: zoned C,O
West: Offices: zoned C-2
PROPOSAL
Restaurants with outdoor dining areas are permitted uses in the C-2 zone with an
approved conditional use permit.
The applicant is requesting a Conditional Use Permit to add a proposed 473 sq.ft.
outdoor dining area with beer and wine service to the existing 3,400 sq. ft. restaurant
at 627 W. Duarte Road. as shown on the submitted site plan. The outdoor dining
area will occupy a space that is currently landscaped. The restaurant will be open 7
days a week from 11 :00 a.m. to 10:00 p.m.
A seating arrangement for approximately 100 patrons is currently provided within the
3,400 sq.ft. restaurant. The applicant is requesting an additional seating capacity of
36 people for the proposed outdoor dining area.
PARKING
.
The subject shopping center was built in 1959, and currently provides 214 on-site
parking spaces (175 parking spaces at the central area of the shopping center and
39 spaces behind the retail buildings on the northerly and easterly pDrtion of the site).
The on-site parking does not comply with the current Code requirements, as
summarized in the following table:

The current on-site parking ratio for the shDpping center is 4.44 spaces per 1,000 sq.
ft. of commercial space (48,175 sq.ft.) which results in an allocation of 15 spaces for
the applicant's 3,400 sq. ft. restaurant.
Based on current parking requirements for the entire shopping center, including the
proposed outdoDr dining area, there should be 423 on-site parking spaces. The
proposed restaurant would account for 24 spaces (12%) of an overall deficiency of
209 parking spaces.
ANALYSIS
Based upon the applicant's proposal and background information about the site, it is
staffs opinion that the proposed outdoDr dining area would be an appropriate
addition to the applicant's restaurant. Staff believes that the outdoor dining area will
not impact the current parking situation because its use would be incidental to the
primary indoor dining area.
The Development Services' staff has visited the site on numerous occasions and
noted no parking problems exist. Also, staff is not aware of any complaints regarding
parking problems for the site. The applicant shall be required to comply with all code
requirements as determined necessary by the Building Official, Fire Marshall,
Maintenance Service Director and Development Services Director.
CECA
Pursuant to the proVISIons of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said ihitial study did hot disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the recDrd as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 99-010 subject to the follDwing conditions:
1. The outdoor dining area shall be maintained and operated in a manner that is
consistent with the application and plans submitted and approved for CUP 99-
010.

2. The proposed design elements of the outdoor dining area (fencing, seating,
tables, landscaping, etc.) shall be subject to review and approval of the
Community Development Division.
3. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with..to the satisfaction of Building Services and the
Fire Department which shall include, but not limited to the following items:
a. If only one of the proposed restrooms is to be disabled/handicapped
accessible, then both of the restrooms must be unisex.
b. Installation of a Knox-box with keys in conformance with the Uniform Fire
Code.
c. Installation of an NFPA-72 fire alarm system in conformance with the
Arcadia Municipal Code.
4. Approval of CUP 99-010 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions of
approval.
5. All conditions of approval shall be complied with prior to completion of the tenant
improvements, and opening of the outdoor dining to an existing restaurant.
Noncompliance with the plans, provisions and conditions of CUP 99-010 shall be
grounds for immediate suspension Dr revocation of any approvals that could
result in the closing of the restaurant.
FINDINGS AND MOTIONS
.Approval
The Planning Commission should move to approve the Negative DeclaratiDn and
adopt Resolution No. 1592: A Resolution of the Planning Commission of the City of
Arcadia, California, granting Conditional Use Permit No. 99-010 for a 3,873 sq. ft.
restaurant with outdoor dining at 627 W. Duarte Road.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution which
incorporates the Commission's decision and specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:

1. A brief explanation is required for all answers except "No Impact" answers that are adequately
