RESOLUTION 1590
A RESOLUTION OFTHE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
99-007 FOR A MARTIAL ARTS INSTRUCTION STUDIO AT 616 EAST
LNE OAK AVENUE.
WHEREAS, on March 8, 1999, a Conditional Use Permit application was filed by
Jiang Hao Quan to operate a 995 square foot marital arts instruction studio, Development
Services Department Case No. C.U.P. 99-007, at property co=only known as 616 E.
Live Oak Avenue, more particularly described as follows:
Lot 35, tract 13540, Book 277, Page 11 and 12
WHEREAS, A public hearing was held on April 13, 1999, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOL YES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
I. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site abuts streets and highways adequate in width and pavement type
to, carry the kind of traffic generated by the proposed use.
4. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the

proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for a martial arts instruction studio upon the following
conditions:
1. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. That the hours of operation shall be limited from 9:00 a.m. to 10:00 p.m.,
Tuesday through Sunday.
4. That the instructional area shall not exceed 700 square feet, as shown on the
proposed floor plan.
5. That the maximum number of students to occupy the subject studio at anyone
time shall not exceed fifth-teen (15) students.
6. A modification shall be granted for 58 on-site parking spaces in lieu of 91;
and this approval shall not constitute an approval for the general reduction in parking for
the total site. That this parking modification shall only be for the use approved by C.u.P.
99-007 (a martial arts instruction studio).
7. That C.U.P. 99-007 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form that is available from the
Development Services Department to indicate awareness and acceptance of the
conditions of approval.
8. Noncompliance with the provisions and conditions of this conditional use
pennit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certifY to the adoption of this Resolution and
shall cause a copy to be. forwarded to the City Council of the City of Arcadia.

This Conditional Use Permit application was submitted by Jiang Hao Quan to operate
a 995 sq.ft. martial arts instruction studio at 616 E. Live Oak Avenue. There will be
four (4) martial arts session per day, one in the moming, one in the afternoon and two
at night. Each session will have a maximum of 15 students. The hours of operation,
will be 9:00 a.m. to 10:00 p.m., Tuesday through Sunday. The Development
Services Department is recommending' approval of CUP 99-007 and subject to the
conditions listed in this report and adoption of resolution 1590.
GENERAL INFORMATION
APPLICANT: Jiang Hao Quan
LOCATION: 616 E. Live Oak Avenue
1 REQUEST: A Conditional Use Permit for the operation of a 995 sq. ft. martial
arts instruction studio in an existing commercial shopping center.
Each session will have a maximum of 15 students. The hours of
operation will be 9:00 a.m. to 10:00 p..m., Tuesday through Sunday.
SITE AREA: 30,730 square feet (0.71 acres)
FRONTAGES: Approximately 204 feet on Live Oak Avenue, and 132 feet on
Hempstead Avenue.
EXISTING LAND USE & ZONING:
The site is developed with retail, church services, and restaurant
establishments, and is zoned C-2.

North: A church and mixed commercial uses: zoned C-2.
South: Single-family residences. which are located within the Los Angeles
County area.
East: vacant city-owned property; unzoned
West: Restaurants; zoned C-2
GENERAL PLAN DESIGNATION:
Commercial
PROPOSAL
Schools and instructional studios are permitted uses in the C-2 zone with an
approved conditional use permit.
The applicant is seeking a conditional use permit to operate a martial arts instruction
studio. The hours of operation will be from 9:00 a.m. to 10:00 p.m., Tuesday through
Sunday. There will be four (4) martial arts session per day, one in the morning, one
in the afternoon and two at night. Each session will have a maximum of 15 students.
The proposed studio would occupy 995 sq. ft. of retail space within a 9,539 sq. ft.
commercial shopping center which fronts on East Live Oak Avenue, as shown on the
attached site plan.

On-site parking is located in the front and rear of the subject building. A total of 58
on-site parking spaces exist on the site. When the site was first developed it was
required to have 48 parking spaces to accommodate the commercial uses.
Conditional Use Permit 89-018, granted on December 12, 1989 permitted the
operation of a restaurant at the subject site. The restaurant occupied 1,990 square
feet of retail space. This request required 20 spaces, which resulted in a net
increase of 10 spaces for the site (i.e., 5 spaces per 1,000 sq.ft. of retail as compared
to 10 spaces per 1,000 sq.ft. for an eating establishment). The addition of the
restaurant required the shopping center to maintain its. 58 parking spaces.
Since the approval of CUP 89-018, two additional CUPs have been granted requiring
additional parking spaces for the subject site:
1. Conditional Use Permit 90-018, granted on December 1, 1990,
permitted a 995 sq.ft. martial arts studio at the same location as the
proposed martial arts studio. With the approval of CUP 90-018, 70 on-
site parking spaces were required for the site. Said spaces resulted in
a net increase of an additional 12 parking spaces.

Conditional Use Permit 91-009, granted July 23, 1991 permitted an
eating establishment at the SUbject site. This request required 24
spaces, which resulted in a net increase of 18 additional spaces for the
site. With the approval of CUP 91-009, 88 on-site parking spaces were
required.
The proposed martial arts studio will replace the previous martial arts studio, which
closed on December 31,1994. However, within the proposed 995 square foot space
there will be a larger instructional area of approximately 700 square feet as compared
to 600 square feet for the previous martial arts studio, and requires 15 parking
spaces as compared to 12 spaces for the previous martial arts studio. This net
increase is due to the difference in the parking standards (i.e., 5 required spaces
based on 5 spaces per 1,000 square feet for retail as compared to 20 required
spaces based on 1 space per 35 square feet for instructional area). With the addition
of the new martial arts studio, 91 on-site parking spaces are required for the site.

ANALYSIS
The maximum of 15 students at a time, as proposed by the applicant, should prevent
the martial arts instruction studio from creating a parking problem, particularly if the
students use the rear parking area. The through circulation afforded by this
commercial shopping center's design and comer location should also prevent any
potential pick-up and/or drop-off traffic from creating a congestion problem.
The site has been operating under a l!imilar business layout since the Planning
Commission granted a take-outldelivery eating establishment on July 23, 1991.

Since 1991 similar types of businesses have been operating in the commercial
center, i.e. retail, two restaurants and a martial arts studio.
The Development Services' staff has visited the site on numerous occasions and on
those occasions no parking problems exist. The City of Arcadia has also not
received any complaint regarding parking problems for the site. Because the
previous business was a martial arts studio, it is staff's opinion that the proposed
martial arts instruction studio will not have a negative impact upon the other uses.
The applicant shall be required to comply with all code requirements .as determined
necessary by the Building Official, Fire Marshall, Maintenance Service Director and
Development Services Director.
CEQA
Pursuant to the prOVIsions of the Califomia Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 99-007 subject to the following conditions:
1. The martial arts instruction studio shall be maintained and operated in a manner
that is consistent with the application and plans submitted and approved for CUP
99-007.
2. . The applicant shall provide the following:
a. An on-site disabled van accessible parking space with an accessible path of
travel for the entire Shopping center shall be provided.
b. If only one of the proposed restrooms is to be disabled/handicapped
accessible, then both of the restrooms must be unisex.
c. Installation of a Knox-box with keys in conformance with the Uniform Fire
Code.
d. Installation of ar;t NFPA-72 fire alarm system in conformance with the
Arcadia Municipal Code.

3. Approval of CUP 99-007 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions of
approval.
4. All conditions of approval shall be complied with prior to completion of the tenant
Improvements, and opening of the martial arts instruction studio. Noncompliance
with the plans, provisions and conditions of CUP 99-007 shall be grounds for
immediate suspension or revocation of any approvals that could result in the
closing of the martial arts studio..
FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve the Negative Declaration and
adopt Resolution No. 1590: A Resolution of the Planning Commission of the City of
Arcadia, California, granting Conditional 'Use Permit No. 99-007 for a 995 sq.ft.
martial arts studio at 616 E. live Oak Avenue.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution which
incorporates the Commission's decision and specific findings.
