CUP 98-020 TO OPERATE AN 1,100 SQUARE FOOT MARTIAL ARTS INSTRUCTION AND TUTORIAL CENTER AT 500~ E. LIVE OAK AVENUE. WHEREAS, on September 8, 1998, an application was filed by Mr. Fu Hang Ng to operate an 1,100 square foot martial arts instruction and tutorial center;DeveIopment Services Department Case No. CUP 98-020, at 500~ E. Live Oak Avenue, more particu1arly described in the attached Exhibit "An. WHEREAS, a public hearing was held on October 13, 1998, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report dated October 13, 1998 is true and correct. SECTION 2. This Commission finds: 1, That the granting of the Conditional Use Permit will not be detrimental to the public health or we1fare, nor injurious to the property or improvements in the zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5. That the subject property is designated for commercial use in the General Plan, that the proposed use is consistent with that designation, and that the granting of the Conditional Use Permit will not adversely affect the comprehensive general plan. 6. That the evaluation of the environmental impacts as set forth in the initial study are appropriate and that the project will have no significant effect upon the environment within the . . . meaning of the California Environmental Quality Act of 1970, and, when considering the project as a whole, there was no evidence before the City that the proposed project would have any potentially adverse effect on wildlife resources or the habitat upon which wildlife depends, and therefore, a Negative Declaration should be approved. SECTION 3. That for the foregoing reasons this Commission approves Conditional Use Permit No. CUP 98-020 to operate an 1,100 square foot martia1 arts instruction and tutorial center at 5001h E. Live Oak Avenue, subject to the following conditions: 1. The martia1 arts instruction and tutorial center and the site shaI1 be maintained and operated in a manner that is consistent with the application and plans submitted and approved for CUP 98-020. 2, All City code requirements regarding accessibility, fire protection, occupancy, and safety sha1l be COIJ!p1ied with to the "l'hd;,ction of Building Services and the Fire Department . and shaI1 include, but not be limited to the following items: a. An on-site disabled van accessible parking space with an accessible path of travel for ~e entire shopping center shaI1 be provided. b. If only one .of the proposed restrooms is to be disabledJhandicapped accessible, then both of the restrooms must be unisex. c. Installation ofa Knox-box with keys in conformance with the Uniform Fire Code. d. Installation of an NFP A-72 fire alarm system in conformance with the Arcadia Municipal Code. 3. Water services sha1l be provided to the satisfaction of the Southern California Water Company. 4. Approval of CUP 98-020 sha1lnot take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate acceptance of the conditions of approval. 5. All conditions of approval sha1l be complied with prior to completion of the tenant improvements, and opening of the martia1 arts instruction and tutorial center. Noncompliance with the plans, provisions and conditions of CUP 98-020 sha1l be grounds for immediate suspension or revocation of any approvals that could result in the closing of the tutorial center. -2- 1580 . . . . . Associate Planner SUBJECT: Conditional Use Permit No, CUP 98-020 for an 1,100 sq. ft. martial arts instruction and tutorial center at 500~ E. Live Oak Avenue, SUMMARY . This Conditional Use Permit application was submitted by Fu Hang Ng to operate an 1,100 sq. ft. martia1 arts instruction and tutorial center at 500~E. Live Oak Avenue. There will be a maximum of 1 5 students, and the hours of operation will be 10:00 a.m. to 10:00 p.m., 7-days a week. The Development Services Department is recommending approval subject to the conditions listed in this report. GENERAL INFORMATION APPUCANT: Fu Hang Ng LOCATION: 500~ E. Live Oak Avenue REQUEST: A Conditional Use Permit for the operation of an 1,100 sq, ft. martial arts instruction and tutorial center in an existing shopping center. There will be a maximum of 15 students at a time, The hours of operation will be 10:00 a.m. to 10:00 p.m., 7-days a week. SITE AREA: 17,780% sq. ft, (0.40 acre) FRONTAGES: 100 feet along Live Oak Avenue and ISO feet along Lenore Avenue. EXISTING LAND USE & ZONING: The site is improved with an 8,500 sq. ft. retail building with 23 on-site parking spaces. The property is zoned C-2: General Commercial. . SURROUNDING LAND USES & ZONING: . North: Multi-family residential zoned R-3, and strip retail & a gas station zoned C-2. South: Church parking lot zoned PR-2, and single family residential in LA County East: Take-out pizza parlor, beauty salon and restaurant zoned C-2 West: Multi-family residential zoned R-3 GENERAL PLAN DESIGNATION: Commercial BACKGROUND The subject shopping center was built in 1963. Under current requirements there should be 43 on-site parking spaces for a retail center of this size. However, the shopping center is considered legal-nonconforming with its curreirt 23 on-site parking spaces (2.7 spaces per 1,000 sq. ft.), There are 13 parking spaces in front of the shopping center and 10 spaces behind the building across an alley. In addition, there are 8 curbside spaces adjacent to this shopping center. The Planning Commission may consider the availability of curbside parking; however, it is not counted toward satisfYing the parking requirement. PROPOSAL & ANALYSIS . The applicant is proposing an 1,100 sq. ft. martial arts instruction and tutorial center within the existing shopping center. The hours of operation will be 10:00 a.m. to 10:00 p.m., 7-days a week. There will be one 700 sq, ft. open instruction/study area. The applicant proposes that there will be a maximum of 15 students at a time. Instruction will be offered to children and adults. Instruction and tutoring on weekday mornings and afternoons will most likely be for children. Weekday evenings will be for adults. Weekends can be for both children and adults. . Parking and Traffic Approximately 700 sq, ft. of the center's 1,100 sq. ft. space is to be used for instructional purposes. One parking space is required for each 35 sq, ft. of instructional space, which results in a parking requirement of 20 spaces. In comparison, the current on-site parking ratio of 2. 7 spaces per 1,000 sq. ft, of commercial space results in an aIlocation of 3 spaces for the applicant's 1,100 sq. ft. use. Therefore, based on current parking requirements, there is a deficiency of 17 parking spaces for the proposed martia1 arts instruction and tutorial center. Based on current parking requirements for the whole shopping center, including the proposed use, there should be a total of 63 on-site parking spaces at this shopping center. The proposed martial arts instruction and tutorial center would account for 17 spaces of an 0vera1l deficiency of 40 parking spaces. One previously approved Conditional Use Permit (CUP 90-009) for the 1,500 sq. ft. restaurant accounts for 11 spaces of the overall deficiency, and the legal- nonconforming status of this shopping center accounts for the other 12 spaces of the CUP 98-020 October 13, 1998 Page 2 . . . deficiency, The proposed mix of uses and current parking requirements are shown in the following table: ;ProDOSed Mb: or Uses and Current Parkin!!' Observations by staffindicate that there is not a parking problem at this shopping center. The applicant conducted a parking survey that is attached to this report. The through circulation afforded by this shopping center's design and comer location should also prevent any pick-up and/or drop-off traffic from creating a congestion problem, Martial arts instruction and tutorial centers have become popular uses throughout the community. A combination of the two uses could prove to be very convenient for the clientele, and may reduce traffic by eliminating a separate trip. Staff's opinion is that the limited scale of the proposed martia1 arts instruction and tutorial center will prevent it from negatively impacting the other uses in this smaIl neighborhood shopping center, and will provide uses that appear to be lacking in this part of the City. CEOA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends, Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit No. CUP 98-020 subject to the foUowing conditions: I. The martial arts instruction and tutorial center and the site sha1l be maintained and operated in a manner that is consistent with the application and plans submitted and approved for CUP 98-020. 2. Live Oak Avenue and Lenore Avenue are major streets in Arcadia. There is also an alley at the back. Hence there is easy access to the site. The site is in a flat area with most surfaces covered with concrete or asphalt. There is no problem with soil' stability. There is a small landscape area with some plants at one corner of the site. There are 5 existing businesses at the site, namely a restaurant, a delicatessen, a launderette, a liquor store and an office.
