CUP 98-019 TO ALLOW "KARAOKE" AND/OR "SING-ALONG" ENTERTAINMENT AT THE EXISTING RESTAURANT & COCKTAlL LOUNGE (GINA'S) AT 1020-B S, BALDWIN AVENUE (IN THE BASEMENT OF BOWLING SQUARE). WHEREAS, on August 31, 1998, an application was filed by Mr. lui Chi Yuan (dba Gina's Restaurant) to allow "karaoke" and/or "sing-along" entertainment; Development Services Department CliseNo. CUP 98-019, at the existing restaurant and cocktail lounge at 1020-B S. Baldwin Avenue (m the basement of the bowling alley), more particu1arly described as fOllows: Lots 36 & 37 ofTract No. 3430 in the City of Arcadia, County of Los Angeles, State of California, as per Map Book 42, Page 32 in the Office of said County Recorder. WHEREAS, a public hearing was held on October 13, 1998, at which time all interested persons were given full opportunity to be beard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF "THE CITY OF ARCADIA HEREBY RESOLVES AS FOllOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report dated October 13, 1998 is true and correct, SECTION 2. This Commission finds: 1. That the granting of the Conditional Use Permit will not be detrimental to ~e public health or we1fill:e. nor injurious to the property or improvements in the zone or vicinity. 2, That the use applied for at the location indicated is properly one fOr which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . . . 5. That the subject property is designated for commercial use in the General Plan, that the proposed use is consistent with that designation, and that the granting of the Conditional Use Permit will notadverseIy affect the comprehensive general plan. 6. That the evaluation of the environmental impacts as set forth in the initial study are appropriate and that the project will have no significant effect upon the environment within the meaning of the California Environmental Quality Act of 1970, and, when considering the project as a whole, there was no evidence before the City that the proposed project would have any potential1y adverse effect on wildlife resources or the habitat upon which wildlife depends, and therefore, a Negative Declaration should be approved, SECTION 3. That for the foregoing reasons this Commission approves Conditional Use Permit No, CUP 98-019 to allow "karaoke" and/or "sing-along" entertainment at the existing restaurant" cocktail lounge (Gina's) at 1020-B S. Baldwin Avenue (in the Basement of Bowling Square), subject to the following conditions: 1. The restaurant and cocktai1lounge along with the incidental entertainment and the site sha1l be operated and maintained in a manner that is consistent with the application and plans submitted and approved for CUP 98-019. 2, Compliance with all City code requirements regarding accessibility, business operations, fire protection, "karaoke" and/or "sing-along" entertainment, occupancy, pollution control and safety shaI1 be verified by, and complied with to the satisfaction of the appropriate City agencies and may require, but are not limited to the following items: a, Provision of all required fire-safety equipment including, but not limited to, a Knox- Box with keys, an NFP A fire alarm system, and an NFP A central-station monitored automatic fire sprinkler system with quick response sprinkler heads. A certified copy of the central- station-monitoring contract must be filed with the Fire Department. b. The inclusion of a grease interceptor and/or garbage grinder. 3. Approval of CUP 98-019 sha1l not take effect until the property owner and applicant have CX!lCUted and filed the Acceptance Form available from the Development Services Department to indicate acceptance of the regulations and conditions of approval. 4. All regulations and conditions of approval shall be complied with prior to providing "karaoke" and/or "sing-aIong" entertainment at the subject property. Noncompliance with the -2- 1579 , . . . plans, provisions, regulations and conditions of approval for CUP 98-019 sha1l be grounds for immediate suspension or revocation of any approvals, which could result in closure of the establishment. SECTION 4. SUMMARY This Conditional Use Permit application was submitted by Mr. lui Chi Yuan to aIlow "karaoke" and/or "sing-along" entertainment at the restaurant & cocktail lounge at 1020-B S, Baldwin Avenue which is in the basement of the Bowling Square building. The Development Services Department is recommending approval subject to the regulations and conditions listed in this staff report, GENERAL INFORMATION APPLICANT: Mr. lui Chi Yuan LOCATION: 1020-B S. Baldwin Avenue- Gina's Restaurant & Cocktail Lounge (In the basement of Bowling Square) REQUEST: A Conditional Use Permit to aIlow "karaoke" and/or "sing-along" entertainment at an existing restaurant & cocktail lounge. SITE AREA: 83,285 sq, ft. (1.91 acres) FRONTAGES: 188::1: ft. along Baldwin Avenue and 332:1: ft. along Arcadia Avenue EXISTING LAND USE & ZONING: The site is occupied by a 40-Iane bowling aIley, a tanning salon and Gina's Restaurant & Cocktail lounge. There are 96 off-street parking spaces for these three businesses. The property is zoned C-2: General Commercial, . - . .. SURROUNDING LAND USES & ZONING: North: Commercial offices - zoned C-2 South: Bank - zoned C-2 East: Multiple family residential- zoned R-3 West: Retai1- zoned C-2 GENERAL PLAN DESIGNATION: Commercial PROPOSAL & ANALYSIS The applicant operates a 2,900 sq. ft. restaurant and cocktail lounge in the basement of the bowling alley at 1020 S. Baldwin Avenue. The proposal is to add "karaoke" and/or "sing-along" entertainment to the activities at the restaurant and cocktail lounge. The restaurant and cocktail lounge were permitted by CUP 85-1, and the applicant was granted an entertainment permit for live music, dancing, a pool table, a jukebox and 2 game machines in November of 1997. "Karaoke" entertainment was being provided by the applicant without an approved Conditional Use Permit. The applicant was unaware that a CUP is nCC('OOAry. The City became aware of the "karaoke" entertainment when the applicant submitted a temporary banner application to advertise the "karaoke" entertainment. Karaoke Regulations In 1993 the City Council adopted Ordinance No. 1998 establishing regulations for "karaoke" and/or "sing-along" entertainment. The ordinance was adopted in response to problems being encountered primarily at "karaoke parlors". The regulations are as follows: 1, Karaoke and/or sing-along businesses sha1l only be allowed in open areas. There sha1l be no private rooms, booths or enclosures, 2. No person under the age of twenty-one (21) shall be permitted unless otherwise authorized by the specific Alcoholic Beverage Control (ABC) license issued by the Department of Alcoholic Beverage Control. 3. No minors (persons under eighteen (18) years of age) sha1l be aIlowed on the premises after 10:00 p.m., unless accompanied by a parent or legal guardian and specifically authorized by the Alcoholic Beverage Control (ABC) license issued by the Department of Alcoholic Beverage Control. CUP 98-019 October 13, 1998 Page 2 - . 4. No alcoholic beverages may be consumed or sold in any business exclusively operated as a karaoke and/or sing-along. Alcohol may only be consumed or sold in conjunction with a restaurant and cocktail lounge when karaoke and/or sing-along is an incidental or nonprimary use. 5. All businesses shall be located with street visibility to allow direct inspection and response by emergency personnel. 6. All entrance and exit doors shaI1 remain unlocked and unobstructed during business hours and when any patrons are on the premises. 7. The business premises sha1l be open and available for inspection by any lawful agent of the City of Arcadia during regu1ar business hours. 8. All conditions of the Conditional Use Permit sha1l be posted at a conspicuous location at the premises and all employees sha1l be apprised of the conditions, SPECIAL INFORMATION The Arcadia Police Department has reviewed this proposal. They are not opposed to this request provided that the business complies with the City's regulations, and they did not recommend any conditions of approval. Attached for the P1anning Cornmkqion's consideration is a petition from the Baldwin Stocker Elementary PT A opposing this request. CONCLUSION The applicant's proposal is to include "karaoke" and/or "sing-along" as an incidental use with the other types of entertAinment (i.e" live music &. dancing). Staff's opinion is that as an incidental use subject to the City's regulations, "karaoke" and/or "sing-along" entertainment supplements the live music and dancing and is an appropriate activity for restaurants and cocktail lounges that provide entertainment. CEOA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potential1y substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, . a Negative Declaration has been prepared for this project. CUP 98-019 October 13, 1998 Page 3 . . . RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit No. CUP 98-019 subject to the following conditions: I, The restaurant and cocktail lounge along with the incidental entertainment and the site sha1l be operated and maintained in a manner that is consistent with the application and plans submitted and approved for CUP 98-019. 2. FINDINGS AND MOTIONS Approval If the Planning Commission intends to approve this application, the Commission should move to approve and file the Negative Declaration and direct staff to prepare a resolution incorporating the Commkoion's decision, supporting findings and conditions of approval as set forth in the staff report, or as modified by the Commission. Denial If the Planning Commksion intends to deny this application, the Commission should move for denial, state the supporting findings, and direct staff to prepare a resolution incorporating the Commission's decision and findings. Therefore, I am taking this opportunity to state that I and other members of the PT A have become alarmed at the rising number of nightlife entertainment which is invading the city limits. We are also opposed to and have written to our mayor about the opening of the Tattoo parlor on Duarte Avenue very close to our high school. 'We were dismayed to read the article written about the tattoo parlor's grand opening where the owner states that he was surprised how quickly he received a permit to open his shop and how accommodating the city was in allowing him to open his shop where other towns.had held him up for long periods of time. As aboard member of the high school PT A and a PT A president I am in touch with many parents of children of all ages. These sort of business do not belong within our city limits. Arcadia was designed to be a bedroom community for family living and late night entertainment, tattoo and body piercing businesses which have been shown to have a connection to many gang groups directly contradicts what the founding fathers of Arcadia and what most residents wish to have operate within the city limits.
