A RESOLUTION OF TIlE PLANNING COMMISSION OF TIlE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT NO. CUP 98-018 FOR A TIlEOLOGICAL SEMINARY AT
141 E. DUARTE ROAD.
WHEREAS, on August 17, 1998, an application was filed by Dr. Daniel Wong
of the Truth Theological Seminary to establish and operate a theoiogical !l.eminary;
Development Services Department Case No. CUP 98-018, in an existing 9,400 sq. ft.
two-story office building at 141 E. Duarte Road, more particularly described as fonows:
Lots 13 & 14 of Arcadia Santa Anita Tract in the City of Arcadia, County of
Los Angeles, State ofCalifomia, as per Map recorded in Book 1023, Pages
45 & 46 of Maps in the Office of said County Recorder.
WHEREAS, a public hearing was beld on September 22, 1998 and
October 27, 1998, at which time all interested persons were given full opportunity to be
heard and to present evidence;
. NOW, TIIEREFORE, TIlE PLANNING COMMISSION OF TIlE CITY OF
ARCADIA HEREBY RESOLVES AS FOlLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report dated October 27, 1998 is troe and correct.
SECTION 2. This Commission finds:
1. That the granting of the Conditional Use Permit will not be detrimental to the
public health or welfare, nor injurious to the property or improvements in the zone or
vicinity.
2. That the use applied for at the location indicated is properly one for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping
and other features required to adjust said use with the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type
. to carry the kind of traffic generated by the proposed use.

5. That the subject property is designated for commercial use in the General Plan,
that the proposed use is consistent with that designatioo, and that the granting of the
Conditional Use Pennit will not adversely affect the comprehensive general plan.
6. That the evaluation of the envirOllmental impacts as set forth in the initial study
are appropriate and that the project, as mitigated, will have no significant effect upon the
environment within the meaning of the California Environmental Quality Act of ] 970, and,
when considering the project as a whole,. there was no evidence before the City that the
proposed_ project woUld have any potentially adverse effect on wildlife resources or the
habitat upon which wildlife depends, and therefore, a Negative Declaration with mitigation
measures shoUld be approved.
SECTION 3. That for the foregoing reasons this Commission approves
Conditional Use Permit No. CUP 98-0]8 to establish and operate a theological seminary in
the 9,400 sq. ft. two-story office building at 141 E. Duarte Road, subject to the following
conditions:
] . The theological seminary and the site sha11 be operated and maintained in a
manner that is consistent with the plans and proposal presented for CUP 98-0]8 and sha11
include the following provisions:
a. Classes sha11 be limited to 20 students.
b. No more than one class may be in session at a time.
c. No more than 30 persons may occupy the Seminary at any time, except that on
Monday mornings, from] ]:00 a.m. to ]2:00 nooo, chapel services may be held, with a
maximum atte'1dance of 4() persons.
d. A public hearing sha11 be set six (6) months from the date of occupancy of the
building by the Seminary, at which time testimony will be heard on the question of
compliance by the Seminary with the conditions of this grant and any modifications which
may appear appropriate, at which time the grant may be modified or terminated, at the
discretion of the Planning Commission.
e. A full and complete set of these conditions sha11 be posted at a prominent
location at the Seminary, and sha11 be provided to each student and each staff member upon
enrollment at the Seminary.

f. The existing tutorial center cannot remain at this location beca'lge of the limited
parking.
2. For "Just Cause" as determined by the Development Services Department, a
noticed public hearing before the plAnning Commission to review the Conditional Use
Permit granted herein sbal1 be conducted. At that hearing the Commission may suspend,
revoke, or re-conditioil (i.e., amend or add conditions) this permit. For the purposes of this
conditionof.approva1, "Just Cause" sbal1 mean a probable violation of the existing
conditions of approval based on complaints, observations, or other verifiable information.
3. The plans and proposal sbal1 be amended/revised to include the following items
to the satisfaction of the Community Development Administrator:
a. The existing concrete block trash enclosure adjacent to the a11ey sbal1 be
equipped with solid metal gates, and an additional masonry enclosure sbal1 be provided to
properly accommodate the recyclablesbin.
b. Any plumbing backtlow.devices existing or to be installed sbal1 be screened
trom public view tothe'satisfactionofthe Community Development Administrator.
c. The driveway apron onto Duarte Road-is to be widened to 26-feet to match the
width of the parking lot drive aisle. The driveway apron sbal1 be constructed in
conformance with APW A standards to the satisfaction of the City Engineer.
4. All City code requirements regarding accessibility, fire protection, occupancy,
and safety sbal1 be complied with to the satisfaction of Building Services and the Fire
Department which sbal1 include, but are not limited to the following items:
a. Two disabled access toilet rooms (one male, one female) on the ground floor
must be available in conformance with the Uniform Building Code,
b. Two disabled access parking spaces, one of which sbal1 be vanllCceSS1ble, must
be provided. These parking spaces are to be provided in conformance with the Uniform
Building Code.
c. A Knox-Box with keys sbal1 be installed in conformance with Uniform Fire
Code, Section 902.
d. An NFP A- 72 fire alarm system sbal1 be installed in accordance with the
Uniform Building Code and a11 other applicable provisions of the Arcadia Municipal Code.

e. An NFP A-13 central-station monitored automatic fire sprinkler system with
quick response sprinkler heads must be installed by a State licensed C-16 contractor and
representative sprinkler heads with identification as to their locations in the building shall be
provided in a spare sprinkler box. A certified copy of the central-station-monitoring
contract must be filed with the Fire Department prior to occupancy.
t: A fire hydrant must be located on the same side of the street and within 150
feet of the on-site fire department connection.
5. Domestic water, fire sprinkler, and landscape irrigation services for the building
and lot shall be provided to the satisfaction of the Arcadia Water Division including the
submittal of a Water Meter Clearance Application to ensure adequate water meter and
service size. If a new water service is necessary, installation of the new service and
abandonment of the existing service shall be performed by the Arcadia Water Division at the
applicant's expense.
6. Approval of CUP 98-018 shall not take effect until the property owner and
;applicanthave executed and filed the Acceptance Form available from the Development
. . Services Department to indicate acceptance of the conditions of approval.
7. All conditions of approval shall be complied with prior to the conducting of
classes at the subject property. Noncompliance with the plans, provisions and conditions of
approval for CUP 98-018 shall be grounds for immediate suspension or revocation of any
approva1s, which could result in the cessation of c1nses.
SECTION 4. The decision, findings. and conditions of approval contained in this
Resolution reflect the Planning Commi!lSion's action of October 27, 1998, by the following

SUMMARY
This Conditional Use Permit application was submitted by Dr. Daniel Wong of the Truth
Theological Seminary to establish a seminary in an existing 9,400 sq. ft. office building at
141 E. Duarte Road. The Development Services Department is recommending denial of this
application as proposed.
GENERAL INFORMATION
APPLICANT: Dr. Daniel Wong - Truth Theological Seminary
LOCATION: 141 E. Duarte Road
REQUEST: A Conditional Use Permit for a theological seminary to occupy an existing
9,400 sq. ft. two-story office building.
SITE AREA: 19,365 sq. ft. (0.44 acre)
FRONTAGES: 101.24 feet along Duarte Road
GENERAL PLAN DESIGNATION: Commercial
EXISTING LAND USE & ZONING:
The site is improved with a 9,400 sq. ft_ two-story office building with
35 parking spaces. The property is zoned C-2: General Commercial.
SURROUNDING LAND USES & ZONING:
North: Multiple family residential- zoned R-3
South: Retail center - zoned C-l
East: Commercial center - zoned C-2
West: Credit Union - zoned C-2
. PROPOSAL & ANALYSIS
The applicant is proposing to operate a theological seminary in the existing 9,400 sq. ft.
two-story office building at 141 E. Duarte Road. The proposal does not include any
improvements to the exterior of the building. The proposal states that the semimuy will start
with an enrollment of 12 to 16 students for the first year, 1999, and the plans show that two
existing tenants will remain temporarily.
The applicant has indicated that he intends to eventually occupy the entire building. and that
the maximum enrollment would be 40 students. The staff will be comprised of three fWl-time
administrators, one part-time clerical person. and 14 part-time instructOIS. Office hours will be
Monday through Friday 9:00 am. to 5:00 p.m. Classes will be available as follows:
Monday 8:00 am. to 9:00p.m.
Tuesday & Thursday 1:30 p.m. to 9:00 p.m.
Wednesday & Friday 9:00 am. to 5:00 p.m.
The proposed facilities include two classrooms (1,440 sq. ft.), three offices (2,208 sq. ft.),
a 1,344 sq. ft. chapel, a 1,344 sq. ft. hormy and a 768 sq. ft. faculty conferenceJlounge area.
Two general office uses (1,536 sq. ft.) will remain untiJ their leases expire, and will eventually
be used for classrooms or offices, depending on the needs at that time.

NotwJthst~nrli"g the applicant's indicated occupancy limits, the proposed facilities would allow
for a mAYimum occupancy of 71 people in the two classrooms, 63 people in the three offices,
192 people in the chapel, and 27 people in the Iibrmy. Issues to be addressed are parking, and
compatibility with surrounding uses.
Parking
There are 35 on-site parking spaces. However, two disabled access parking spaces, one of
which must be a van accessible parking space, will be required which will reduce the total
number of parking spaces to 34. In addition. an enclosure is necessary for the reyclables bin
that may result in the loss of one more parking space.
The applicant has indicated that there could eventually be a maximum of 40 students, and there
would be approximately threefWl-time and 15 part-time employees. However, the applicant
has stated that rarely would all of the students and employees be on the p"""i""$ at one time.
The chapel and hormy are to be used only by the students and staft: and will not be available
for use by the general public.
It is difficult toregu1ate and-monitor the mn;mnm number of people at a location as suggested
by the applicant. Therefore, based upon the allowable occupancies of the proposed facilities,
the parking could be deficient. BeC81lse of the mid-block location of this site, a need for
additional parking could result in the inappropriate use of parking on neighboring properties.

. Compatibility with Surrounding Uses
The adjacent uses are a multi-tenant commerci81 building to the east, and a credit union to the
west. While the Zoning Code aIlows schools in any zone with an approved Conditional Use
Permit (AMC Section 9275.1.35.1) the Commercial Land Use Designation in the General Plan
does not include educational institutions among the appropriate uses. It reads as follows:

Commercial (C) - Provides appropriately located areas for the general
commercial and professional office needs of the area residents, workers and
visitors. Appropriate uses include a range of common retail and personal
service uses, specialty retail, offices, auto related uses, financi81 institutions,
and hotels and motels.
This proposal involves the entire 9,400 sq. ft. two-story building. Its conversion from a
commercial building to a theological seminary (an educational and religious institution) is a
significant change from the commercial identity of this area, and does not complement the
surrounding uses.
Numerous Conditional Use Permits have been granted for tutorial centers in commercial
buildings. Those, however, are commercial in nature, limited in scale, and serve the residents of
the surrounding neighborhoods, and, none occupy as much space as this proposal. Most
tutorial centers utilize only a portion of the commercial buildings in which they are located.
In fact, a tutorial center is approved for 1,344 sq. ft. of the ground floor of this building
(CUP 93-003/Reso. 1498). This tutorial center would be required to relocate by this proposal.
Although the applicant's proposed maximum is 40 students &. 34 full'and part-time stafl: the
facilities have the potential for the following mR,nmnm occupancies: .

2,208 sq. ft. of office space 63 people
1,344 sq. ft. libnuy 27 people
1,344 sq. ft. chapel 192 people

Staff is concerned because succe5dill ventures typical1y expand and maximize the use of their
available space, which in this case could result in significant parking problems that would
substantia11y disrupt the commercial activity in this area.
CEOA
Pursuant to the provisions of the California Environmental Quality Act, the Development
Services Department has prepared an initial study for the proposed project. Said initial study
did disclose certain substantial or potentially substantial adverse changes in some of the

physical conditions within the area affected by the proiect including land, air, water, minerals,
flora, fauna, ambient noise and objects of historical or aesthetic significance. Notwithstanding
those findings, however. when considering the record as a whole, there is no evidence that the
proposed project will have any potential for adverse effect on wildlife resources or the habitat
upon which the wildlife depends. Therefore, a Negative Declaration, with mitif!ation
measures. has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends denial of Conditional Use Permit
No. CUP 98-018 as proposed. If the Planning Commi~sion determines that this proposal is
an appropriate use, staff recommends the following conditions of approval:

1. Attendance shal1 be limited to a maximum .of 20 students at any one time, and the
theological seminary and the site shal1 be operated and maintained in a manner that is
proportionately consistent with that level of enrollment (i.e., the proposed filcilities sbaII
be reduced in size to match an attendance level of 20 students, and the balance of the
building is to be occupied by general office uses of a commercial nature. The existing
tutorial center cannot remain at this location because of the limited parking). The
proposal sbaII be revised and sbaII include the following items to the qti.far.tion of the
Community Development Administrator:
a. The existing concrete block trash enclosure adjacent to the alley sbaII be equipped

31. The site is flat in nature with angled frontage along Duarte Road, The
site contains ~ 2-story building, 35 parking spaces, landscaped areas,
and alley to the north. No historical stnictures exist. The building
contains a dance school, a tut~rial school, a pager sales, medical
health, and offices.

residential apartments/condominiums. The properties to the east and
west are developed with a bank, retail and restaurant uses. The

Attachment A
Truth Theological Seminary
Business Plan
Truth Theological Seminary is a non-profit Religious Corporation that has
been in existence since 1997. This corporation is under the direction of a
Chairman of the Board of Directors, and President. The applicant served 2
years as president of another theological seminary in Alhambra, while his
partner has served 5 years as Chairman of Board of Directors.
The proposed Theological Seminary at 141 E. Duarte Road will utilize the
entire firstand second floors of the 9,360 square foot building. Two (2) of
the existing tenants (units 107 and 201) will be permitted to operate until
their lease expires. The Seminary will start with enrollment of 12 to 16
students for the first year 1999. The students are older adults with college
degrees who may be working as interns in churches or other professional
fields. Classes will be available on Monday 8:00 a.m. to 9:00 p.m., Tuesday
& Thursday 1:30 p,m. to 9:00 p.m. and Wednesday & Friday 1:30 p.m. to
5:30 p.m. Office hours will be Monday through Friday 9:00 a.m. to 5:00
p,m. The staff will include President/Academic Vice President,
Administrative Vice President,' Registrar and a part-time
Secretary/Receptionist. Approximately 14 part-time faculty instructors will
come at various times to teach one or more courses.
The basic elements that should be provided by a Seminary include a Chapel,
Library, Classrooms and Offices, much of the floor area is given to the
Chapel and Library. The proposed 9,360 square foot Seminary at this
location will include the following:

Library 1,344 sq. ft. (151 floor)
Chapel 1,344 sq. ft. (151 floor)
Classroom 1,440 sq. ft. (151 & 2" floor)
