WHEREAS, on June 22, 1998, applications were filed by Harold and Maria Potter to operate a child day care center, to be located in a C-O zoned property that is commonly known as 2612 S. Baldwin Avenue, and more particularly descnbed as: Lot 2 of Tract No .6641 in the City of Arcadia, County of Los Angeles, State of California, as per Map Recorded in the Book 226 Page 67 of Maps, in the Office of the County Recorder of said County, Except therefrom the westerly 17 feet of , Lot 2 measured at right angles to thll street purposes, by deed recorded July 7, 1965 as Instrument No.3005. WHEREAS, A public hearing was held on July 28, 1998, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW TIIEREFORE, TIlE PLANNING COMMISSION OF TIlE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: I. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the initial study did not disclose any substantial adverse affects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper use for which a . Conditional Use Permit is authorized. - -- . 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adverseiyaffect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the new exterior design elements for the subject building are in compliance with the design criteria set forth in the City's Architectural Design Review Regulations. 7. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit, to operate a child day care center upon the following conditions: I. All City code requirements and policies regarding accessibility, civil engineering, construction, fire protection, maintenance of public facilities, occupancy, plan checking, safety, and utility services shall be complied with to the "llti~f'lction of all City Departments. 2. That the number of children shall be limited to 60. 3. That the hours of operation shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday. 4. C.u.P. 98-016 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form that is available from the Development Services Department to indicate awareness and acceptance of the conditions of approval. 2 1S7S - . .- 5. Noncompliance with the provisions and conditions of this conditional use permit shall constitute grounds for its immediate suspension or revocation. SECTION 4. This Conditional Use Permit application was submitted by Harold and Maria Potter to operate a child day care center between the hours of 7:00 a.m. to 6:00 p;m., Monday through Friday at 2612 S Baldwin Avenue. The Development Services Department is recommending approval of the application, subject to the conditions that are outlined in this staff report. GENERAL INFORMATION APPLICANT: Harold and Maria Potter LOCATION: 2612.S. Baldwin Avenue REQUEST: To operate a child day care center between the hours of 7:00 a.m. to 6:00 p.m., Monday through Friday. LOT AREA: Approximately 20,687 square feet (.48 acres) FRONTAGE: 95.00 feet along Baldwin Avenue EXISTING LAND USE & ZONING: The site is currently developed with a 5,136 sq. ft. office building, and is zoned CoO. . ,. - . GENERAL PLAN DESIGNATION: Commercial SURROUNDING LAND USES & ZONING: The neighboring properties to the north of the site are developed with single-family residential; zoned R- 1. Properties to the south, east and west of the site are developed with mixed commercial uses and muliiple-family units; zoned C-2 and R-3.respectively. PROPOSAL & ANALYSIS The applicant is requesting a conditional use permit to operate a child day care center open between the hours of7:00 a.m. to 6:00 p.m., Monday through Friday. The proposed day care center would occupy an existing 5,900 sq, ft. building, as shown on the submitted site plan (copy attached). The proposed day care center would accommodate 60 children, and provide both indoor and outdoor play areas, as shown on the submitted site plan. The outdoor play area will be enclosed by a 6'-0" high fence combination of wrought iron and masonry block. An existing . 6' -0" high solid masonry block wall encloses the property along three sides. The applicant's intent is to instruct children between the ages of 2 Y, through 5 years with eight full-time staff members. The eight staff members will work staggered shifts. The required minimum of one off-street parking space shall be provided upon the premises for each employee. A total of 9 off-street parking spaces will be provided. A circular driveway has been designed to provide adequate vehicular ingress and egress, and a safe loading and unloading area for children (as shown on the attached site plan). Day care centers are a permitted use with an approved conditional Use permit in the.C-O zone. The proposed use complies with the zoning regulations found in Arcadia Municipal Code Section 9275.3 through 9275.3.9. The day care center is consistent with the other uses in the area, provided all code requirements are complied with. In addition, the outdoor play area and driveway along ,the northerly property line, separating the residentially zoned properties to the north, are divided by a 6' -0" high masonry wall and landscaping in excess of 6' -0" high in places. Based on staffs review of the proposed site plan, the outdoor play area is appropriately designed, due to the location and distances of adjacent structures. . CUP 98-016 July 28, 1998 Page 2 . CEQA Pursuant to the provisions of the Caiifomia Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project Said initial study did not disclose any substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a who I;, there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources. Therefore, a Negative Declaration.has been prepared for this project. RECOMMENDATIONS: The Development Services Department recommends approval of Conditional Use Permit No.98-016, subject to the following conditions of approval: I. All City code requirements and policies regarding accessibility, civil engineering, construction, fire protection, maintenance of public facilities, occupancy, plan checking, safety, and utility services shall be complied with to the satisfaction of all City Departments. 2. That the number of children be limited to 60. . 3. That the hours of operation be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday. 4. That CUP 98-016 shall not take affect until the owner and applicant have executed a form available at the Planning Office indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this conditional use permit shall constitute grounds for its immediate suspension or revocation. FINDINGS AND MOTIONS Approval If the Planning Commission intends to approve this conditional use permit application, the Commission should move to approve and file the Negative Declaration and direct staff to prepare a resolution which incoIporated the Commission's decision, specific findings and conditions of approval as set forth in the staff report, or as modified by the Commission. . Denial If the Planning Commission intends to deny this conditional use" permit application, the Commission should move for denial and direct staff to prepare a resolution which incorporates the Commission's decision and. specific findings.
