STAFF REPORT
DEVELOPMENTSERWCESDEPARTMENT
July 28, 1998
TO:
Chairman and Members of the Arcadia Planning Commission
FROM:
Donna L. Butler, Community Development Administrator
By: John Halminski, Assistant Planner
SUBJECT:
Conditional Use Permit No. CUP 98-016
SUMMARY
.
This Conditional Use Permit application was submitted by Harold and Maria Potter to
operate a child day care center between the hours of 7:00 a.m. to 6:00 p;m., Monday through
Friday at 2612 S Baldwin Avenue. The Development Services Department is recommending
approval of the application, subject to the conditions that are outlined in this staff report.
GENERAL INFORMATION
APPLICANT: Harold and Maria Potter
LOCATION: 2612.S. Baldwin Avenue
REQUEST: To operate a child day care center between the hours of 7:00 a.m. to 6:00
p.m., Monday through Friday.
LOT AREA: Approximately 20,687 square feet (.48 acres)
FRONTAGE: 95.00 feet along Baldwin Avenue
EXISTING LAND USE & ZONING:
The site is currently developed with a 5,136 sq. ft. office building, and is
zoned CoO.
.
,. -
.
GENERAL PLAN DESIGNATION:
Commercial
SURROUNDING LAND USES & ZONING:
The neighboring properties to the north of the site are developed with
single-family residential; zoned R- 1. Properties to the south, east and west
of the site are developed with mixed commercial uses and muliiple-family
units; zoned C-2 and R-3.respectively.
PROPOSAL & ANALYSIS
The applicant is requesting a conditional use permit to operate a child day care center open
between the hours of7:00 a.m. to 6:00 p.m., Monday through Friday. The proposed day care
center would occupy an existing 5,900 sq, ft. building, as shown on the submitted site plan
(copy attached).
The proposed day care center would accommodate 60 children, and provide both indoor and
outdoor play areas, as shown on the submitted site plan. The outdoor play area will be
enclosed by a 6'-0" high fence combination of wrought iron and masonry block. An existing
. 6' -0" high solid masonry block wall encloses the property along three sides.
The applicant's intent is to instruct children between the ages of 2 Y, through 5 years with
eight full-time staff members. The eight staff members will work staggered shifts.
The required minimum of one off-street parking space shall be provided upon the premises
for each employee. A total of 9 off-street parking spaces will be provided.
A circular driveway has been designed to provide adequate vehicular ingress and egress, and
a safe loading and unloading area for children (as shown on the attached site plan).
Day care centers are a permitted use with an approved conditional Use permit in the.C-O
zone. The proposed use complies with the zoning regulations found in Arcadia Municipal
Code Section 9275.3 through 9275.3.9. The day care center is consistent with the other uses
in the area, provided all code requirements are complied with. In addition, the outdoor play
area and driveway along ,the northerly property line, separating the residentially zoned
properties to the north, are divided by a 6' -0" high masonry wall and landscaping in excess of
6' -0" high in places. Based on staffs review of the proposed site plan, the outdoor play area
is appropriately designed, due to the location and distances of adjacent structures.

Services Department has prepared an initial study for the proposed project Said initial study
did not disclose any substantial adverse change in any of the physical conditions within the
area affected by the project including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. When considering the record as a who I;,
there is no evidence that the proposed project will have any potential for an adverse effect on
wildlife resources. Therefore, a Negative Declaration.has been prepared for this project.
RECOMMENDATIONS:
The Development Services Department recommends approval of Conditional Use Permit
No.98-016, subject to the following conditions of approval:

(To be compleled by lbe Lead Agency)
On the basis of this initial evaluation:
[Xl I fmd that the proposed project COULD NOT bave a significant effect on the
environment, and a NEGATIVE DECLARATION will be prepared.

environment, there will not be a significant effect in this case because the mitigation

measures described on an attached sheet have heen added to the project. A
NEGA TlVE DECLARA TJON will be prepared.
[ ] I find that the proposed project MAY have a significant effect on the environment,
and an ENVIRONMENTAL IMPACT REPORT is required.
[ ] I find that the proposed project MAY have a significant effect on the environment,
but that at least one effect has been adequately analyzed in an earlier document
pursuant to applicaBle legal standards and has been addressed by mitigation
measures based on that earlier analysis as described on attached sheets, and if any
remaining effect is a "Potentially Significant Impact" ot "Potentially Significant
Unless Mitigated," an ENVIRONMENTAL IMPACT REPORT is required, but
it only needs to analyze the effects that have not yet been addressed.
[ ] I find that although the proposed project could have a sibrnificant effect on the
environment, there WILL NOT be a significant effect in this case because all
potentially significant effects have been analyzed adequately in an earlier
Environmental Impact Report pursuant to applicable standards and have been
avoided or mitigated pursuant to that earlier EIR, including revisions or mitigation
measures that are imposed upon the proposed project.

For
EV ALUA TIONOF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are adequately
supported by the information sources a lead agency cites in the parentheses following each
question. A "No Impact" answer is adequately supported if the referenced information sources
show that the impact simply does not apply to projects such as the one involved (e.g., the project
is not within a fault rupture zone). A "No Impact" answer should be explained where it is based
on project-specific factors as well as general standards (e.g., the project will not expose sensitive
receptors to pollutants, based on a project-specific screening analysis).
2. All answers must take account of the whole action involved, including off-site as well as on-site,
cumulative as well as project-level, indirect as well as direct, and construction related as well as
operational impacts.
-3-
CEQA Checklist
7/95
.
.
.

3. "Potentially Significant Impact" is appropriate if there is substantial evidence that an effect is
significant. If there are one or more, "Potentially - Significari"f Impact" entries when the
determination is made, an Environmental Impact Report is required.
4. "Potentially Significant Unless Mitigation Incorporated" applies where the incorporation of
mitigation measures has reduced an effect from "Potentially Significant Impact" to a "Less Than
Significant Impact." The lead agency must describe the mitigation measures, and briefly explain
how they reduce the effect to a less than significant level (mitigation measures 'from Section 17
"Earlier Analyses" may be cross-referenced).
5. Earlier analyses may be used where, pursuant to the tiering, program Environmental Impact
Report, or other CEQA process, an effect has been adequately analyzed in an earlier EIR or
Negative Declaration {Section 15063(c)(3)(D)}. Earlier analyses are discussed in Section 17 at
the end of the checklist.
6. Lead agencies are encouraged to incorporate into the checklist, references to info~ation sources
for potential i1npacts(e.g., general plans, zoning ordinances). Reference to a previously prepared
or outside document should, where appropriate, include a reference to the page or pages where
the statement is substantiated.
