RESOLUTION NO. 1567
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING CONDmONAL USE PERMIT
NO. CUP 98-008 TO OPERATE A 740 SQ. FT. COFFEE HOUSE WITH
SEATING FOR 16 PEOPLE AT 148 E. DUARTE ROAD.
WHEREAS, on April 3, 1998, an application was filed by Monica McManus to operate
a 740 sq. ft. coffee house with seating for 16 people; Development Services Department Case
No. CUP 98-008, to be located at 148 E. Duarte Road, more particularly described as follows:
Lots I, 2 and 3 of Parcel Map No. 2114, in the City of Arcadia, County of Los
Angeles, State of California, as per map recorded in Book 32, Page 81 of Parcel
Maps, in the Office of said County Recorder.
WHEREAS, a public hearing was held on May 12, 1998, at which time all interested
persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOllOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of the Conditional Use Pennit will not be detrimental to the
public health or welfare, nor injurious to the property or improvements in the zone or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to accommodate
said use, and all yards, spaces, walls, fences, parking, loading, IlIntl!ll'-aping, and other features
required to adjust said use with the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type to
carry the kind oftratlic generated by the proposed use.
5. That the subject property is desigl'lIted for commercial use in the General Plan,
that the proposed use is consistent with that designation, and that the granting of the
Conditional Use Pennit will not adversely affect the comprehensive general plan.

6. That the evaluation of the environmental impacts as set forth in the initial study are
appropriate and that the project will have no significant effect upon the environment within the
meaning of the California Environmental Quality Act of 1970, and, when considering the
project as a whole, there was no evidence before the City that the proposed project would have
any potential1y adverse effect on wildlife resources or the habitat upon which wildlife depends,
and therefore, a Negative Declaration should be approved.
SECTION 3. That for the foregoing reasons this Commission approves Conditional
Use Permit No. CUP 9S-00S to operate a 740 sq. ft. coffee house at 14S E. Duarte Road
subject to the following conditions:
1. The coffee house and the site sha1l be operated and maintained in a manner that is
cOnsistent with the proposal and plans submitted and approved for CUP 9S-00S which includes
seating for a maximum of 16 people, daily hours of 11:00 a.m. to 9:00 p,m., and a parking
modification of 104 spaces in lieu of205 spaces.
2. All City code requirements regarding accessibility, fire protection, occupancy, and
safety sha1l be complied with to the satisfaction of Building Services and the Fife Department
which shall include, but are not limited to the following items:
a. Provision of a grease interceptor.
b. A disabled van parking space sha1l be provided directly in front of the coffee house.
c. Installation of a Knox-Box with keys in conformance with UFC Section 902.
d. mQtRI1Rtion of a Type-l range hood and duct extinguishing system.
e. Actual occupancy limits and exiting requirements sha1l be based on the fina1 design.
3. Water services sha1l be provided to the satisfaction of the Arcadia Water Division
including the submittal of a Water Meter Clearance Application to ensure adequate water
meter and service size.
4. Approval of CUP 9S-00S sha1l not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the Development
Services Department to indicate acceptance of the conditions of approval.
5. All conditions of approval sha1l be complied with prior to the installation of seating
at the coffee house. Noncompliance with the plans, provisions and conditions of CUP 98-00S

sha1l be grounds for immediate .suspension or revocation of any approvals which could result in
removal of the seating.
SECTION 4. The decision, flnrlil1gs, and conditions of approval contained in this
Resolution reflect the Plannil1g Commission's action of May 12, 1998, by the following vote:
AYES: Commissioners Bell, Bruckner, Huang, Kalemkiarian, Sleeter, and Murphy
NOES: None
ABSENT: None
SECTION 5. The Secretary sha1l certify to the adoption of this Resolution and sha1l
cause a copy to be forwarded to the City Council of the City of Arcadia

SUMMARY
This Conditional Use Permit application was submitted by Monica McManus to operate a 740
sq. ft. coffee shop (dba: Be Be Cafe) with sealing for 16 people, within the existing shopping
center at 140-160E. Duarte Road. The Development Services Department is recommending
approval subject to the conditions listed in this report.

GENERAL INFORMATION
APPUCANT: Monica McManus
LOCATION: 148 E. Duarte Road
REQUEST: A Conditional Use Permit and parking modification for a 740 sq. ft. coffee
shop (dba: Be Be Cafe) with !lel'til18 for a maximum of 16 people. The
daily hours of operation will be 11 :00 am. to 9:00 p.rn.
SITE AREA: 88,800 sq. ft. (2.04 acres)
FRONTAGES: J99.21 feet along E. Duarte Road and 100 feet along S. Second Avenue
GENERAL PLAN DESIGNATION: Commercial

EXISTING LAND USE & ZONING:
The site is improved with J2,760 sq. ft. of commercial space with
105 parking spaces. The property is zoned C-l: Limited Commercial.
SURROUNDING LAND USES & ZONING:
North: Mixed commercial - zoned C-2
South: Single-family residentia\- zoned R-l
East: Bank - zoned C-l
West: Legal-nonconforming fast food - zoned R-l

BACKGROUND
The subject shopping center was built in 1966 with 112 parking spaces and.was origina1ly
anchored by an Alpha Beta grocery store. The current 105 parking spaces results from prior
parking modifications and re-striping fOr handicapped spaces. Under current requirements
there should be 194 on-site parking spaces for a retail center of this size and tenant mix.
However, the shopping center is considered legal-conforming with its current 105 on-site
parking spaces (3.21 spaces per 1,000 sq. ft.).
PROPOSAL & ANALYSIS
The applicant is proposing a 740 sq. ft. coffee shop within the existing shopping center with
BeAting for a maximum of 16 people. The daily hours of operation will be 11:00 am. to 9;00
p.m. The applicant has indicated that the coffee shop will also serve light snscks. .
Parking
Coffee shops require 20 parking spaces per 1,000 gross square feet which results in a parking
requirement of 15 spaces for this proposal. Based on the 105 existing parking spaces, only
2.J8 parking spaces can be a110tted to the subject commercial space.

Based on current parking requirements for each of the individual uses in the shopping center,
including the proposed coffee shop, there should be a total of 205 on-site parking spaces.
Therefore, there is an overa\1 deficiency of 100 spaces. The proposed mix of uses, their
current parking requirements, and the deficiencies are shown in the following table:

With the proposed coffee shop, aU of the ancillary commercial spaces will be occupied. The
anchor retail space (approx. 21,000 sq. ft.) has been vacant for a long time, but may soon be
occupied by a 99t Only Store (tenant improvement plans are in plan check).

A review of the current parking situation by staff indicates that there is presently not a parking
problem at this shopping center. Staff's observations concur with the following parking counts
provided by the applicant:

Full occupancy of this shopping center will significantly increase the parking demand.
. However, observations at the current 99t Only Store seem to indicate that the current parking
vacancy of 60+ spaces should be adequate for the anticipated tenant mix. The limited amount
of S('~ting. and the specific type of service indicated by the applicant's proposal (coffee shop
with light snscks) should prevent this proposal from creating a parking problem. A coffee
shop should be a good complement to the existing tenant mix.
CEOA
Pursuant to the provisions of the California Environmental Quality Act, the Development
Services Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentia11y substantia1 adverse change in any of the physical
conditions within the area affected by the project including land, air, water, minerals, flora,
fauna, ambient noise and objects of historical or aesthetic siglliflcance. When considering the
record as a whole, there is no evidence tha~ the proposed project will have any potential for
adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore,
a Negative Declaration has been prepared for this project.
RECOMMENDATION
.
The Development Services Department recommends approval of Conditional Use Permit No.
CUP 98-008 subject to thefollowing conditions:
1. The coffee shop and the site sha1l be operated and maintained in a manner that is
consistent with the proposal and p1ans submitted and approved for CUP 98-008.

to approve and file the Negative Dec1aration and direct staff to prepare a resolution
incorporating the COlJ\mi.won's decision, supporting findings and conditions of approyal as set
forth in the staffreport, or as modified by the Commi~sion.
