HomeMy WebLinkAbout1561 . . . RESOLUTION NO. 1561 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. CUP 98-002 TO OPERATE A 2,500 SQ. FT. TUTORIAL CENTER AT 641 W. DUARTE ROAD. WHEREAS, on January 5, 1998, an application was filed by Lai En Zhou and Fan Hui Kong to operate a 2,500 sq. ft. tutorial center; Development Services Department Case No. CUP 98-002, to be located at 641 W. Duarte Road, more particularly described in Exhibit "An. WHEREAS, a public hearing was held on February 10, 1998, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: SECTION I. That the factual data submitted by the Development Services. Department in the attached report is true and correct. SECTION 2. This Commission finds: I. That the granting of the Conditional Use Permit will not be detriment~ to the public health or welfare, nor injurious to the property or improvements in the zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to acconunodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the subject property is designated for commercial use in the General Plan, that the proposed use is consistent with that designation, and that the granting of the Conditional Use Permit will not adversely affect the comprehensive general plan. 6. That the evaluation of the environmental impacts as set forth in the initial study are appropriate and that the project will have no significant effect upon the environment within the meaning of the Califomia Environmental Quality Act of 1970, and, when considering the project as a whole, there waS no evidence before the City that the proposed project would have any . . . potentially adverse effect on wildlife resources or the habitat upon which wildlife depends, and therefore, a Negative Declaration should be approved. SECTION 3. That for the foregoing reasons this Commission approves Conditional Use Permit No. CUP 98-002 to operate a 2,500 sq. ft. tutorial center at 641 W. Duarte Road subject to the foIlowing conditions: I. The tutorial center and the site shall be maintained in a manner that is consistent with the plans submitted and approved for CUP 98-002. 2. All City code requirements regarding accessibility, ftre protection, occupancy, and safety shall be complied with to the satisfaction of Building Services and the Fire Department which shaIl include, but are not limited to the following items: a. Provision of a one-hour occupancy separation from the adjoining businesses. b. Provision of a one-hour fire-rated corridor extending from the front entrance/exit to the rear entrance/exit including the reception/lobby and rear open area. c. Fire and smoke dampers shall be provided on the ventilation ducts in the above required one-hour fire-rated corridor. d. A disabled van parking space and sidewalk ramp shall be provided directly adjacent to the front entrance of the tutorial center. e. Installation of a Knox-box with keys in conformance with UFC Section 902. f. Installation ofa fire alarm system in conformance with NFPA 72. 3. Water services shall be provided to the satisfaction of the Arcadia Water Division including any backflow devices, double-check valves, and pressure vacuum breakers. 4. The operators of the tutorial center wiIl encourage the drivers that are dropping-off and/or picking-up the students to use the parking spaces to the rear (northeast) of the tutorial center. Signs and/or notices to such effect shaIl be provided by the applicants. 5. Approval of CUP 98-002 shall nottake effect until the property owner and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate acceptance of the conditions of approval. 6. All conditions of approval shaIl be complied with prior to completion of the tenant improvements, and opening of the tutorial center. Noncompliance with the plans, provisions and conditions of CUP 98-002 shall be grounds for immediate suspension or revoclltion of any approvals which could result in thec10sing of the tutorial center. -2- 1561 e . . Duarte Road SUBJECT: SIJMMARY This Conditional Use Permit application was submitted by Lai En Zhou and Fan Hui Kong to operate a 2,500 sq. ft. tutorial center within the existing shopping center at 627-655 W. Duarte Road. The Development Services Department is recommending approval subject to the conditions listed in this report. .. GENERAL INFORMATION APPLICANTS: Lai En Zhou and Fan Hui Kong LOCATION: 641 W..Duarte Road REQUEST: A Conditional Use Permit to operate a 2,500 sq. ft. tutorial center within an existing shopping center. SITE AREA: 110.932 sq. ft. (2.55 acres) FRONTAGES: 389 feet along W. Duarte Road and 310 feet along Arcadia Avenue GENERAL PLAN DES1GNATION: Commercial . EXISTING LAND USE & ZONING: The site is improved with approximately 48,175 sq. ft. of commercial space with 214 parking spaces. The property is zoned C-2 & H-4; General Commercial with a Height Overlay for a maximum of 4 stories, not to exceed 45 feet. . . . SURROUNDING LAND USES & ZONING: North: South: East: West: Multiple family residential -- zoned R-3 Offices -- zonedC-2 & H-4 Offices -- zonedC-O Offices - zoned C-2 BACKGROUND The subject shopping center was built in 1959. Under current requirements there should be 241 on-site parking spaces for a retail center of this size. However, the shopping center is considered legal-nonconforming with its current 214 on-site parking spaces (4.44 spaces per 1,000 sq. ft.). There are 175 parking spaces in the middle of ~e shopping center and 39 spaces behind the northerly and easterly buildings. PROPOSAL & ANALYSIS The applicants are proposing a 2,500 sq. ft. tutorial center within the existing shopping center. The tutorial center will offer classes in art, math and English. The hours of operation will be 2:30 p.m. to 6:30 p,m. There will be four classrooms, two private piano practice rooms, one computer room, and an open study area. The applicant indicates that there Will be approximately 5 to 8 students per class. Instructional levels would range from kindergarten through sixth grade. Parking and Traffic Approximately 1,500 sq. ft. of the tutorial center's 2,500 sq. ft. subject space would be used for instructional purposes. One parking space is required for each 35 sq. ft. of instructional space which results in a parking requirement of 43 parking spaces. In comparison, the current on-site parking ratio of 4.44 spaces per 1,000 sq. ft. of commercial space results in an allocation of II spaces for the applicant's 2;500 sq. ft. use. Therefore, based on current parking requirements, there would be a deficiency of 32 parking spaces for the proposed tutorial center. Based on current parking requirements for the whole shopping center, including the proposed tutorial center, there should be a total of 418 on-site parking spaces at this shopping center. The proposed tutorial center would account for 32 spaces (16%) of an overall deficiency of 204 parking spaces. Three previously approved Conditional Use Permits (i.e., the Martial Arts Center, Gymboree, and the Chinese food eating establishment at the north end of the westerly building) would account for 123 spaces (60%) of the overall deficiency, and the legal-nonconforming status of CUP 98-002 February 10, 1998 Page 2 . . . this shopping center would account for the balance (49 spaces = 24%) o(the deficiency. A review of the current parking situation by staff indicates that there is not a parking problem at this shopping center. However, because there will be an increase in the amount of on-site traffic due to the students being picked-up and/or dropped-off, and the proximity to popular businesses in this center (I.e., the 99t Store & Gymboree) there could be a congestion problem in the parking area in front of the proposed tutorial center. A possible way to alleviate any congestion would be to have the operators of the tutorial center direct the drivers that are dropping-off and/or picking-up the students to use parking spaces that are more toward the center of the parking lot. While it may take some time for CUP 98-002 February 10, 1998 Page 3 . . . such dri.vers to get used to parking a short distance away from the tutorial center, it would help prevc;:nt any congestion problem that might be caused by the tutorial center. CEQA Pursuant to the provisions of the Califomia Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitit upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDA nON The Development Services Department recommends approval of Conditional Use Permit No. CUP 98-002 subject to the following conditions: 1. The tutorial center and the site shall be maintained in a manner that is consistent with the plans submitted lind approved for CUP 98-002. 2. Denial If the Planning Commission intends to deny this application, the Commission should move for denial and direct staff to prepare a resolution which incorporates the Commission's decision and supporting findings. .
