RESOLUTION 1559 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 97-014 AMENDING AND DELETING CONDITIONS OF APPROVAL FOR THE EXISTING BOWLING ALLEY AT 1020 SOUTH BALDWIN AVENUE WHEREAS, on October 20, 1997, Gary Ford on behalf of Bowling Square, Inc. filed an application, Community Development Division Case No. C.U.P. 97-014 at 1020 South Baldwin Avenue more particularly described as follows: Lots 36 and 37, Tract No. 3430, in the City of Arcadia, County of Los Angeles, State of California, as per Map Book 42, Page 32 in the office of the County recorder ohaid County. WHEREAS, a public hearing was held on November 25, 1997 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Community Development Division in the attached report is true and correct. Section 2. This Commission finds: 1. That the bowling alley is an existing use and the applicant is requesting the conditional use to replace the existing zone variance (City Council Resolution 3264) and amend and delete specific conditions of approval relating to the operation of the bowling alley. 2. That the granting of this Conditional Use Permit will not be detrimental to the pUblic health or welfare, or injurious to the property or improvements in such zone or vicinity as set forth in finding 4 below. 3. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized as established in the zoning ordinance. 4. That the site is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate as designed to adjust said use with the land and uses in the neighborhood. 5. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. -1- 1559 . . . 6. The subject site is designed as commercial on the General Plan. The proposed restaurant is consistent with that designation and the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 7. Subject to the conditions set forth in this Resolution, the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons the Planning Commission approved Conditional Use Permit 97-014 for the existing 40-lane bowling alley subject to the following conditions: 1. That the bowling center shall not ooerate between the hours of 3:00 a.m. and 6:00 a.m. on any day and that the bowling center shall not be open prior to 8:00 a.m. on any Sunday. That the Planning Commission shall review the hours of operation within six (6) months from the date of the approval to ensure that the extended hours have not created any prOblems in the neighborhood. 2. That the number of billiard and pool tables in the bowling center shall be restricted to two (2) 3. That C.U.P. 97-014 shall not take effect until the owner and applicant have executed a form available at the Community Development Division indicating awareness and acceptance of the conditions of approval. 4. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 25, 1997 and the following vote: AYES: Commissioners Bell, Huang, Kalemkiarian, Streeter, Murphy NOES: None ABSENT: Commissioner Bruckner Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- 1559 .' Butler, Community Development Administrator SUBJECT: Consideration of Conditional Use Permit 97-014 - Bowling Square SUMMARY This application was filed by Bowling Square Inc. and is requesting a conditional use permit to delete the conditions of approval as set forth below and included in City Council Resolution 3264 granting a zone variance for the operation of a bowling alley at 1020-1030 South Baldwin Avenue. . The Development Services Department is recommending approval of the conditional use permit subject to the conditions set forth in this staff report. GENERAL INFORMATION LOCATION: REQUEST: Gary Ford on behalf of Bowling Square, Inc. 1020 South Baldwin Avenue APPLICANT: A conditional use permit to replace the existing zone variance (City Council Resolution 3264) and amend or delete the following conditions of approval for the existing bowling alley: . 1. Delete Condition 5(a) that required the cocktail lounge to be separated from the bowling lanes. 2. Delete Section 5(b) that prohibits intoxicating liquor to be served on the bowling concourse (with the exception of beer. . 3. Amend Section 5 (c) that prohibits operation of the bowling alley between the hours of 2 a.m. and 6 a.m. on C.U.P.97-014 November 25, 1997 Page 1 . . . any day and prohibits operation prior to 10 a.m. on Sunday. 4. Delete Section 5(d) that prohibits billiard or pool tables on the premises. EXISTING LAND USE & ZONING The site is developed with a 40 lane bowling alley, including a restaurant in the basement area. The site is zoned C-2H-4. SURROUNDING LAND USE & ZONING North: South: West: East: Developed with mixed commercial uses; zoned C-2 Developed with a bank and mixed commercial uses; zoned C-2 Developed with mixed commercial uses; zoned C-2 Developed with multiple-family units; zoned R-3 GENERAL PLAN DESIGNATION Commercial BACKGROUND In 1960 a variance was granted for the construction of a 24 lane bowling alley (City Council Resolution 3264). In 1962, the number of lanes was increased to 40; however, there is no application on file that approved the additional 16 lanes. Earlier this year, Mr. Ford, owner of Bowling Square inquired about what would be necessary to eliminate the condition prohibiting alcoholic beverages (except beer) in the concourse area. After reviewing Resolution 3264, Mr. Ford noted that there were several conditions that the bowling alley was not in compliance with since it began operation. In order to bring the property into conformity, Mr. Ford is requesting that several of the previous conditions be amended or deleted. PROPOSAL Zone variances are no longer applicable for "use" type applications. Since the mid 1960's bowling alleys have been allowed through the conditional use permit process. Because the applicant wished to amend certain conditions set forth in the existing zone variance, staff recommended that the applicant apply for a conditional use permit that would replace the previous zone variance. The proposed conditional use permit is to allow the operation of the bowling alley as it is currently being operated. The following summarizes the major changes to the original conditions of approval: C.U.P.97-014 November 25, 1997 Page 2 . 1. Condition 5(a) required the cocktail lounge to be separated from the bowling lanes. The lounge has never been separated from the bowling lanes. The entrance to the lounge does not face the lanes, but is an integral part of the bowling alley. 2. Section 5(b) prohibits intoxicating liquor to be served on the bowling concourse (with the exception of beer). According to the applicant, Arcadia is the only community that prohibits the sale of alcoholic beverages, other than beer, in the concourse area. The bowling alley is abiding by this restriction, however, to make them competitive in the bowling alley business, they are requesting that they be allowed to serve all types of alcoholic beverages on the bowling concourse. Staff concurs with this request and does not feel that the consumption of alcoholic beverages in the concourse area will create a problem. Mr. Ford notes in his letter that Bowling Square "is at a disadvantage in the marketplace because the five other competing bowling centers are able to serve liquor in the bowling area: . 3. Section 5 (c) orohibits operation of the bowling alley between the hours of 2 a.m. and 6 a.m. on any day and prohibits operation prior to 10 a.m. on Sunday. . Mr. Ford is requesting that the hours on Thursday, Friday and Saturday be extended to 3 a.m. due to the large number of persons who like to bowl late into the evening. On occasion they operate until 3:00 a.m. to accommodate "late night" bowlers. Security guards are on the premises in the evening hours during the weekend to ensure that there are no problems. Also, they would like their opening hour on Sunday to be changed to B a.m. to conform to the actual practice that has taken place during the past twenty (20) years. The Police Chief (see attached memo) has no objections to Mr. Ford's request for a variance to several of the conditions of approval, including the hours of operation. Notices regarding tonight's meeting have been mailed to all property owners within a 300 foot radius. The Planning Commission may wish to conditionally approve the extended hours and come back for review in six months to determine if the extended hours have created a problem in the neighborhood. . 4. Section 5(d) prohibits billiard or pool tables on the premises. C.U.P. 97-014 November 25,1997 Page 3 . According to the applicant they have had two pool tables in the bowling center for approximately ten (10) years. Because the addition of pool tables is incidental 10 the overall operation of the bowling alley, staff recommends that the number of pool tables be restricted to two within the entire bowling center. As noted above, the Police Chief has no problems with any of the above changes, subject to compliance with all the Alcoholic Beverage Control laws. ANALYSIS A bowling center is a permittecl use in the C-2zone with an approved conditional use permit. Bowling Square has been operating for approximately 25 years and the City has not had any notable problems with the operation. It is staff's opinion that as times change, a business must adapt to the needs and requests of its customers. If the applicant's request is approved and there are substantiated problems in the future, the Planning Commission may review the application for compliance witl1 the conditions and could further restrict the use if it is deemed to be a nuisance for the neighbors. CEQA This project is categorically exempt from CEaA. . RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit 97-014 to operate a 40-Iane bowling alley subject to the conditions set forth below: 1. That the bowling center shall not operate between the hours of 3:00 a.m. and 6:00 a.m. on any day and that the bowling center shall not be open prior to 8:00 a.m. on any Sunday. That the Planning Commission shall review the hours of operation within six (6) months from the date of the approval to ensure that the extended hours have not created any problems in the neighborhood. 2. That the number of billiard and pool tables in the bowling center shall be restricted to two (2). 3. That C.U.P.97-014 shall not take effect until the owner and applicant have executed a form available at the Community Development Division indicating awareness and acceptance of the conditions of approval. . 4. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and direct staff to prepare the appropriate resolution for adoption at its next meeting. Under Section 5(a), the lounge has never been separated from the lanes during the past 20 years. The entrance to the lounge does not face the lanes, however. Please delete this section. . Under Section 5(b), we are requesting this section be deleted in its entirety. Arcadia is the only city in California that prohibits an on-sale general type 47 licensee from serving liquor in and around the bowling area. This puts Bowling Square at a disadvantage in the marketplace since the 5 competing bowling centers are all able to serve liquor in the bowling area. Under Section 5[c), we request that the hours on Thursday, Friday, and Saturday be extended to 3:00 a.m. due to the large number of Asians who like to bowl late. Once again, this puts us at a disadvantage with the other bowling centers in the area. Also, that the opening hours on Sunday be changed to 8:00 a.m. to conform with the actual practice of the past 20 years. Under Section 5(d), we request an allowance of2 pool tables to conform with the 2 tables that have been licensed the past 10 years.
