A RESOLUTION OF THE PLANNING COMMISSION OF THE'
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL
USE PERMIT NO. 97-008 TO OPERATE A RESTAURANT AT
SPACE D5 WInUN THE SANTA ANITA FASmON PARK MALL
COMPLEX, 400 SOUTH BALDWIN AVENUE.
WHEREAS, on June 2, 1997, a conditional use pennitapplication Was filed by
Timothy Walsh on behalf of Anita Associates to operate a proposed 13,084 sq.ft.,
"Todai" restaurant, which includes a 3,905 sq.ft. outdoor dining area, within the Santa
Anita Fashion Park Mall complex, Development Services Department Case No. C.U.P.
97-008, on the property commonly known as Space D5, 400 South Baldwin Avenue,
more particularly described as follows:
Parcel 2 of Parcel Map No. 4626, in the City of Arcadia, County of
Los Angeles, State of Cali fomi a, as per Map recorded in Parcel Map
Book 89, Pages 76-77 of Maps, in.the office of said County Recorder.
WHEREAS, A public hearing was held on July 8, 1997, at which time all
. interested persons were given full opportunity to be heard and to present evidence;
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such conditional use pennit will notbe detrimental to the
public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That'the use applied for at the location indicated is a proper use for which a
conditional use pennit is authorized.
3. That the site for the proposed restaurant is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
. neighborhood.

4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use,
5. That the granting of such conditional use permit will not adversely affect the
comprehensive General Plan.
6. That the proposed exterior improvements to the subject building are in
accordance with the City's Architectural Design Review Regulations.
7. That the use applied for will not have a substantial adverse impact on the
environment.
SECTION 3. That for the foregoing reasons this Commission grants Condition
Use Permit 97-008 for the operation of a restaurant at space D5 within the Santa Anita
Fashion Park Mall complex upon the following conditions:

1. That all applicable code requirements regarding building occupancy, exiting,
fire protection, disabled access, safety features, etc., shall be complied with to the
satisfaction of Building Services and the Fire Department.
2. That the seating arrangement for the subject restaurant shall be maintained in
accordance with the plans on file inPlanning Services (Case No. C.U:P. 97-008).
3. That the color scheme for the proposed exterior improvements. shall be subject
to the review and approval of the Development Services Department.
4. C. V.P. 97-008 shall not take effect until the property owner and applicant
have executed and filed the Acceptance Form that is available from the Development
Services Department to indicate awareness and acceptance of the conditions of approval.
5. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action ofJuly 8, 1997, and the following vote:
AYES: Commissioners Bruckner, Huang, Kalemkiarian, MU'llhy, Sleeter,

Santa Anita Fashion Park Mall at 400 South Baldwin Avenue
. SUMMARY
The applicant is requesting a conditional use pennit to operate a proposed 13,084 sq. ft.
"Todai" restaurant, which includes a 3,905 sq.ft. outdoor dining area, within the Santa
Anita Fashion Park Mall complex. It would feature both Japanese aild Chinese food
items. The hours of operation would be from 10:00 a.m. to 9:00 p.m., Monday thru
Friday, 10:00 a.m. to 7:00 p.m. on Saturdays and 11:00 a,m. to 6:00 p.m. on Sundays.
Also, architectural design review is required for the proposed exterior building alterations
and the outdoor dining area. The Development Services Department is recommending
approval of the requested conditional use pennit subject to the conditions that are
outlined in this staff report.
GENERAL INFORMATION
APPLICANT: Anita Associates (contact person: Timothy Walsh)

REQUEST:
A conditional use permit to operate a proposed 13,084 sq.ft. "Todai"
restaurant which would feature both Japanese and Chinese food items
within the Santa Anita Fashion Park Mall complex, and architectural
design review.

LOT AREA: 79.12 acres
FR:ONTAGE: The site is located at the northeast intersection of Baldwin Avenue and
Huntington Drive (see the attached Land Use & Zoning Map).
EXISTING LAND USE & ZONING:
The site is developed with a regional shopping center mall (Santa Anita
Fashion Park) which is zoned C-2D & H8 and C-2.
GENERAL PLAN DESIGNATION:
The site is designated as Commercial.
PROPOSAL
The applicant is requesting a conditional use permit to operate a proposed 13,084 sq.ft.
"Todai" restaurant, which includes a 3,905 sq. ft. outdoor dining area, within the Santa
Anita Fashion Park Mall complex. It would feature both Japanese and Chinese food
items. The hours of operation would be from 10:00 a.m. to 9:00 p.m., Monday thru
Friday, 10:00 a.m. to 7:00 p.m. on Saturdays and 11:00 a.m. to 6:00 p.m. on Sundays.
Such hours of operation are consistent with the business hours of the mall.
A seating arrangement for 430 patrons is proposed. Interior seating will accommodate
314 people (includes 16 seats for the physically disabled), and the outdoor dining area
will provide seating for 116 people, as shown on. the submitted floor plan.
PARKING
On-site parking consist of 5,808 spaces which exceeds the current parking requirement of
5,327 spaces for the existing mall stores (4.75 spaces required per 1,000 sq.ft. of
modified floor area @ 1,121,455 sq.ft.). It has been staff's experience upon inspecting
the site that a substantial amount of available parking exists during business hours; and
therefore staff does not anticipate a parking problem. in reference to the proposed
restaurant.
EXTERIOR At TERATIONS
Exterior alterations will consist of the following improvements which are shown on the
submitted floor plan and building elevations:
1. A new "Todia" restaurant wall sign (approximately 120 sq.ft. in area), would be
added to further identify the location of the restaurant.

2. Secured doorways and a window would be added to the building's southeasterly
exterior wall to allow naturaIlight into the building and to provide direct access to
the outdoor dining area.
3. The proposed outdoor dining area would be partially shaded by a 10'-0" to
12' -0" high metal pergola structure, a 16'-0" high free-standing metal gazebo, and
landscaping. Also, a 0' -72" high clear glass wind screen atop a 2' -0" high masonry
planter will be provided to further enhance the outdoor dining area; and
4. A portion of the existing landscaped berm that is currently adjacent to the subject
building would be removed to accommodate the proposed configuration of the
outdoor dining area.
Concurrent with the consideration of the requested conditional use pennit the applicant is
also requesting architectural design review approval in reference to the above mentioned
improvements.
ANALYSIS
A restaurant with outdoor dining is a permitted use within the Santa Anita Fashion Park
Mall with an approved conditional use permit. It is staff's opinion that the site is more
than adequate to accommodate the applicant's proposal, and that the mall's shopping
environment would be enhanced by the diverse dining features of the proposed
restaurant. A1so,staff believes that the applicant's proposal meets the intent of the
design criteria set forth in the City's Architectural Design Review Regulations.
Specifically, the proposed exterior alterations would be visually hannonious with the
mall's commercial developments (see the attached building elevations).
Design review of the proposed exterior alterations will also be required before the City
Council in accordance with Resolution No. 4185.
CEOA
Pursuant to the provisions of the California Environmental Quality Act, the Development
Services Department has prepared an initial study for the proposed project. Said initial
study did not disclose any substantial or potentially substantial adverse change in any of
the physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance.
When considering the record as a whole, there is no evidence that the proposed project
will have any potential for an adverse effect on wildlife resources or the habitat upon
which the wildlife depends. Therefore,.a Negative Declaration has been prepared for this
project.

RECOMMENDATION
The Development Services Departmentrecommends approval of Conditional Use Permit
No. 97-008 subject to the following conditions:

FINDINGS AND MOTIONS
Aporoval
If the Planning Commission intends to approve this conditional use permit application,
the Commission should move to approve and file the Negative Declaration, and find that
the new design elements of the subject building are in compliance with the ADR criteria,
and direct staff to prepare a resolution which incorporates the Commission's decision,
specific findings and conditions of approval as set forth in the staff report, or as modified
by the Commission.
Denial
If the Planning Commission intends to deny this conditional use permit application, the
Commission should move for denial and direct staff to prepare a reSolution which
incorporates the Commission's decision and specific findings.
