RESOLUTION 1550 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT NO. 97-007 TO OPERATE A RESTAURANT WITHIN THE CENTER COURT AREAOF THE SANTA ANITAFASmON PARK MALL AT 400 SOUTH BALDWIN AVENUE. WHEREAS, on June 2, 1997, a conditional use permit application was filed by Timothy Walsh on behalf of Anita Associates to operate a proposed 1,015 sq.ft., "Johnny Rockets" classic fifties restaurant within the center court area of the Santa Anita Fashion Park Mall, Development Services Department Case No. C.D.P. 97-007, on the property commonly known as 400 South Baldwin Avenue, more particularly described as foIlows: Parcel 2 of Parcel Map No. 4626, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Parcel Map Book 89, Pages 76-77 of Maps, in the office of said County Recorder. WHEREAS, A public hearing was held on July 8, 1997, at which time all interested persons were given full opportunity to be heard and to present evidence; e NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Departmentin the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such conditional use permit will not be detrimental to the public health or welfare, or injurious to. the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a conditional use permit is authorized. 3. That the site for the proposed restaurant is adequate in size and shape to accommodate said use. AIl yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. (/. ~. - -- . 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such conditional use permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adv~ impact on the environment. SECTION 3. That for the foregoing reasons this Commission grants Condition Use Permit 97-007 for the operation of a restaurant within the center court area of the Santa Anita Fashion Park Mall upon the following conditions: 1. That all applicable code requirements regarding building occupancy, exiting, fire protection, disabled access, safety features, etc., shall be complied with to the satisfaction of Building Services and the Fire Department. 2. That the seating arrangement for the subject restaurant shall be maintained in . . accordance with the plans on file in Planning Services (Case No. C.D.P. 97-007). 3. C.U.P. 97-007 shall not take effect until the property owner and applicant have executed and f1led the Acceptance Fonn that is available from the Development Services Department to indicate awareness and acceptance of the conditions of approval. 4. Noncompliance with the provisions and conditions of this conditional use permit shall constitute grounds for its immediate suspension or revocation. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of July 8, 1997, and the following vote: AYES: Commissioners Bruckner, Huang, KaIemkiarian, Murphy, Sleeter, NOES: None ABSENT: Commissioner Bell 2 1550 . SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Nicholson, Planning Services Manager SUBJECT: Conditional Use Permit No. 97-007 Santa Anita Fashion ParkMall at 400 South Baldwin Avenue SUMMARY . The subject of this staff report is a request for a conditional use permit to operate a proposed 1, 015 sq.ft. "Johnny Rockets" classic fifties restaurant within the center court area of the Santa Anita Fashion Park Mall. The hours of operation would be from 10:00 a.m. to 9:00 p.m., Monday thru Friday, 10:00 a.m. to 7:00 p.m. on Saturdays and 11:00 a.m. to 6:00 p.m. on Sundays. The Development Services Department is recommending approval of the requested conditional use pennit subject to the conditions that are outlined in this staff rep.ort. GENERAL INFORMATION APPLICANT: Anita Associates (contact persom Timothy Walsh) LOCATION: Santa Anita Fashion Park Mall at 400 South Baldwin Avenue REQUEST: A conditional use permit to operate a proposed 1, 015 sq.ft. "Johnny Rockets" classic fifties restaurant within the center court of the Santa Anita Fashion Park Mall. LOT AREA: 79.12 acres FRONTAGE: The site is located at the northeast intersection of Baldwin Avenue and . Huntington Drive (see the attached Land Use & Zoning Map). . . . EXISTING LAND USE & ZONING: The site is developed with a regional shopping center mall (Santa Anita Fashion Park) which is zoned C-W & H8 and C-2. GENERAL PLAN DESIGNATION: The site is designated as Commercial. PROPOSAL The applicant is seeking a required conditional use permit to operate a proposed 1,015 sq.ft. "Johnny Rockets" classic fifties restaurant within the center court area of the Santa Anita Fashion Park Mall. The hours of operation would be from 10:00 a.m. to 9:00 p.m., Monday thru Friday, 10:00 a.m. to 7:00 p.m. on Saturdays and 11:00 a.m. to 6:00 p.m. on Sundays. Such hours of operation are consistent with the business hours of the mall. A seating ammgement for 71 patrons is proposed. Interior seating will consist of 14 counter stools, a space for the physically disabled, and four booths that will provide seating for 16 people. In addition, designated "patio" ~eating for approximately 40 people will be provided within the mall's common area (approximately 650 sq.ft.), as shown on the submitted floor plan. . PARKING On-site parking consist of 5,808 spaces which exceeds the current parking requirement of 5,327 spaces for the existing mall stores (4.75 spaces required per 1,000 sq.ft. of modified floor area @ 1,121,455 sq.ft.). It has been staff's experience upon inspecting the site that a substantial amount of available parking exists during business hours; and therefore staff does not anticipate a parking problem in reference to the proposed restaurant. DESIGN REVIEW The applicant's proposal does not require a design approval because the exterior of the existing mall complex will not be altered to accommodate the new restaurant. The proposed construction will consist of a new free-standing building within the mall's center court area, and its overall design theme would be that of a classic fifties diner, as shown on the submitted building elevations. ANALYSIS A restaurant is a permitted use within the Santa Anita Fashion Park Mall with an approved conditional use permit. It is staff's opinion that the site is more than adequate to accommodate such a use. Also, we feel that the proposed location of the new C.U.P.97-OO7 July 8. 1997 Page 2 restaurant would further benefit the mall by adding needed vitality to its center court . area. CEOA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit No. 97-007 subject to the following conditions: . 1. That all applicable code requirements regarding building occupancy, exiting, fire protection, disabled access, safety features, etc., shall be complied with to the satisfaction of Building Services and the Fire Department. 2. The hours of operation shall be from 10:00 a:m. to 9:00 p.m., Monday thru Friday, 10:00 a.m. to 7:00 p.m. on Saturdays and u:oo a.m. to 6:00 p.m. on Sundays. 3. That the seating arrangement for the subject restaurant shall be maintained in accordance with the plans on file in Planning Services (Case No. C.U.P. 97-007). 4. C.U.P. 97-007 shall nottake effect until the property owner and applicant have executed and fjledthe Acceptance Form that is available from the Development Services Department to indicate awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this conditional use permit shall constitute grounds for its immediate suspension or revocation. FINDINGS AND MOTIONS Approval . If the Planning Commission intends to approve this conditional use permit application, the Commission sh()uld move to approve and file the Negative Declaration, find that the project will not have a significant effect on the environment, and direct staff to prepare a C.U.P. 97-007 July S, 1997 Page 3 . . . resolution which incorporates the Commission's decision, specific findings and conditions of approval as set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to deny this conditional use permit application, the Commission should move for denial and direct staff to prepare a resolution which incorporates the Commission's decision and specific fmdings.
