LEGAL DESCRIPTION OF
401 EAST SANTA CLARA STREET, ARCADIA, CALIFORNIA
The land referred to herein is situated in the County of Los Angeles, State of California,
and is described as follows:
Those portions of Lots 5, 6, 7, 8 and II in Block 84 of Part of Santa Anita Tract, in the
City of Arcadia, as per map recorded in Book 34 Pages 41 and 42 of Miscellaneous
Records, in the Office of the County Recorder of Said County, together with those
portions of Lots I and 7 of Tract 13949, in Said City, as per Map recorded in Book 285
pages 25 and 26 of Maps, in the Office of the County Recorder of Said County, described
as a whole as follows:
Commencing at a point in the westerly line of said Tract 13949 distant along said
Westerly line, North 000 00' 28" West, 183.30 feet from the Southwest comer of said
Tract 13949, thence North 59011' 51" West, a distance, of 50.32 feet to the true point of
beginning; thence continuing North 590 11' 51" West, a distance of 671.25 feet to the
Southeasterly terminus of that certain course as recited in the deed to the Los Angeles
County Flood Control District, recorded August 28, 1969, as Instrument Number 1925 in
Book D4480, Page 710, Official Records, as having a bearing and length of South 600 17'
] 9" East 48.95 feet, said Southeasterly terminus also being a point in the Northeasterly
line of the land as described in the deed to the Los Angeles County Flood Control District,

SUBJECT:
SUMMARY
This Conditional Use Permit application was submitted by Extended Stay America, Inc. for a
three-story, 122 studio-room hotel at 401 E. Santa Clara Street. The Development Services
Department is recommending approval of this application,subject to the conditions in this report.

PROPOSAL
The applicant is proposing to build a 122 studio-room hotel. There will be one, three-story,
40 foot high, 52,428 square foot hotel building, a recreation area with a. barbecue and sports
court, and a satellite dish antenna. The rooms will include kitchenettes. A typical room layout is
attached. There will not be any food or beverage services on the premises.
Extended Stay America caters to customers that may require to be located in a particular area for
several weeks due to business necessities such as corporate relocation, travel, training or other
personal needs, Nevertheless, because the proposed project is intended to accommodate transient
customers, 24-hour, on-site management should be provided for the project.
The building will be set back on the site parallel to the freeway. A 20 foot, grass-crete
emergency access setback will be maintained around the back of the building. The structure will
be light gray with cream accenting and blue and white trim. Accessory stmctures will be painted
to match. Specifics ofthe perimeter fencing are not indicated.
SPECIALINFORMA TION
The property owner, EmKay Development Company, Inc. and the Arcadia Redevelopment
Agency have approved a Disposition and Development Agreement for the subject property, The
proposed hotel project has been designed in accordance with the provisions of the Agreement.
Because the subject property is within the Redevelopment Area, the architectural design of the
proposed project has been ,approved by the Redevelopment Agency.
ANALYSIS
The proposed project complies with the CPD-1 (Commercial Planned Development) zoning
regulations and the commercial criteria of the General Plan. Holels with rooms with kitchenettes
are an allowed use in the CPD-l zone with an approved Conditional Use Permit. The floor area
ratio for the proposed hotel is 50.65% (52,428 I 103,501) .and its 17,476 square foot footprint
covers 16.88% of the site.

The General Plan includes this site within a Land U,se Transition Area (Mixed Use Area along
Santa Clara Street and Huntington Drive) however, the site was not designated for mixed use.
Furthermore, State law defines transient occupancies as those that do not exceed a 30-day period.
Therefore, notwithstanding the extended stay aspect of the proposed project, it cannot be
considered, nor can it be used for residential purposes without a General Plan amendment, and
guest occupancy should be limited to 30,days,
Access ,to the site will be by a 30 foot wide driveway on Santa Clara Street. 146 on-site parking
spaces are proposed, Code requires 1.2 spaces per room (122 x 1.2 = 146.4), There will be 109
standard spaces, 29 compacl spaces (147 x 20% = 29.4) seven regular accessible spaces and one
van-accessible space. Exterior site lighting is not indicated on the plans. Lighting should be
provided for the parking areas, recreation area and emergency access setback, Code allows light
standards to have a maximum overall height of20'feet.
Three signs are included in the proposal. Two 45 square foot wall signs will be on the northeast
and northwest walls which ,face the freeway. A 25 foot tall, two-sided, 350 square foot (175
square feet per side) pylon sign will be, at the entrance. The area of the freestanding sign was
based on the 671.25 foot frontage along the freeway.
The proposed landscaping exceeds code requirements. In addition to landscaped curb overhangs,
and the ten foot street front setback landscaping, the code requires ten percent of the .site, and five
percent of the parking areas to be landscaped with one tree for every five parking spaces. Most
of the overall site landscaping is provided by the recreation area at the northwest portion of the
site. There will be at least 60'trees in the parking areas and the recreation area will, be abundantly
landscaped, The 20 foot wide grass-crete setback area behind the building has been calculated as
50 percent landscaped. The satellite dish antenna will probably be adequately screened by the
landscaping of the recreation area, However, the antellna should be secured by ai1 enclosure.
The proposal also includes landscaping of the perimeter of the one-acre remainder parcel.
The site is presently enclosed by chain-link fencing. The proposed plans do not indicate any
other perimeter fencing or enclosure, Chain-link fencing is not consistent with the City's
Architectural Design Review Criteria, Insofar as possible, the.same building materials should be
used on all structures on a site,
CEQA
Pursuant to the provlSlons of the California Environmental Quality Act, the Development
Services Department has prepared an initial study for the proposed project. Said initial study did
not disclose any substantlal or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land, air, water, minerals, flora,
fauna, ambient noise and objects of historical or aesthetic significance, When considering the
record as a whole, there is no evidence that the proposed project will have any potential for

adverse effect on wildlife resources or the habitat tlpOn which the wildlife depends, Therefore, a
. Negative Declaration has been prepared for this project.
RECOMMEND A nON
The Development Services Department recommends approval of CUP 97-002 subject to the
following conditions:
I. The hotel, accessory improvements, and. the site shall be maintained and operated in a
manner that is consistent with the proposal and plans submitted and approved for
CUP 97-002, and, shall include, but not be limited to, the following provisions:
a. 24-hour, on-site management shall be,provided;
b. Fencing and other enclosures on the property shall be wrought iron or masonry with a
decorative finish, except for the fencing along the freeway right-of-way.
c. A detailed landscaping and irrigation plan shall be prepared for both the project site and
the remainder parcel by a licensed landscape architect and shall be subject to approval by
the Development Services Department.

2, CUP 97-002 is specifically for a transient hotel use. Guest occupants shall re-register every
30-days in the event that their length of stay will exceed 30 consecutive days. And, for
disclosure purposes, for subsequent purchasers of the project, the applicant and property
owner shall execute and record a legal instmment precluding ,active and/or passive
conversion of the project into a residential use, This legal instrument shall be prepared by
and approved by the City Attorney,
3. The items listed in the attached August 28, 1996 memorandum from the Acting City
Engineer are to be complied with to the satisfaction of the Engineering Division including the
revisions indicated on the response dated February 25, 1997,
4. All local code requirements regarding accessibility, fire protection, occupancy, and safety
shall be complied with to the satisfaction of Building Services and the Fire Department.
5, Water services, as listed in the attached February 27, 1997 memorandum from the
Maintenance Services Division shall be complied with to the satisfaction of the Arcadia
Water Division,

6. Approval of CUP 97-002 shall not take effect until the property owner and applicant have
executed and filed the Acceptance Form available from the Development Services
Department to indicate. acceptance of the conditions of approval.

7. All conditions of approval shall be complied with prior to completion and occupancy of the
hotel. Noncompliance with the plans and conditions of CUP 97-002 shall constitute grounds
for immediate suspension and/or revocation of any approvals which could result in a
temporary and/or permanent closing of the hotel.
FINDINGS AND MOTIONS
Motion for Approval
If the Planning Commission intends to approve this application, the Commission should, based
upon the evidence presented. make the appropriate findings and move to approve and file the
Negative Declaration and direct staff to prepare a resolution which incorporates the
Commission's decision, specific findings and conditions of approval as set forth in .the staff
report, or as:modified by the Commission.

If the Planning Commission intends to deny this application, the Commission should specifically

state, based upon the evidence presented, the findings against the proposed project and move for
denial and direct staff to prepare a resolution which incorporates the Commission's decision and
supportive findings.

In response to your memorandum, the items which this division has
concern or special knowledge of are listed below:
1. The existing parkway width is 6' on the north side of Santa
ciara Str.eet.
2. Traffic volume may be increased, but there may be no major
impact.

The following conditions of approval are recommended:
1. Submit grading and drainage plan prepared by a registered
civil engineer subject to the approval of the Development
Services Director. Provide calculations for the gravity
drainage system. Computations should show hydrology,
hydraulics, elevations; and all the details.
