A RESOLUTION GRANTING CONDITIONAL USE PERMIT 88. 012 TO OPERATE A RESTAURANT AT 181 COLORADO PLACE: WHEREAS, on May 2, 1988 an application was filed by Ray F. Sibille to operate a restaurant, Planning Department Case NO. C.U.P. 88-012, on property commonly known as 181 Colorado Place, more particularly described as follows: SEE EXlllBIT "A" . WHEREAS, a public hearing was held on June 14, 1988, at which time all interested persons were given full opportunity t6 be heard. and to present evidence; NOW, THERFORE, THE PLANN:ING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit wiII not be detrimental to the pl,lblic health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with .the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. S. That the granting of such Conditional Use Permit wiII not adversely affect the comprehensive General Plan. . 1377 - 1 . \ 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit operate a restaurant subject to the following conditions: 1. Except for gratuity, valet parking shall be provided free to all patrons during all business hours. Signsshall be posted informing the public of free valet parking. The signs' number, location. size, color and print shall be subject to the approval of the Planning Department. Also. a tandem parking plan for the valet parking shall be submitted to the Planning Department for review and approval. 2. If free valet parking IS not possible per condition number I, the applicant shall provide 12 additional parking spaces per A.M.C. Section 9269.6. Before any parking spaces are used on a site other than 181 Colorado Place a revision to Conditional Use Permit 88-012 shall be filed to include the additional site. The appropriate plans, fees and application shaIl be filed. Note that either the free valet parking or the covenant per A.M.C. Section 9269.6.6 shaIl be completed prior to the opening of the restaurant. 3. The following conditions from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. A. Remove nonconforming curb, gutter and drive apron on Colorado Place adjacent to San Juan Drive. B. Construct P.C.C. curb, gutter and driveway apron according to Arcadia Standard Drawing No. S-Il. C Plant parkway trees at locations determined by the Director of Public Works per City of Arcadia Standard S-I3. D. Remove and replace deficient or damag~d curb. gutter or sidewalk. E. AII survey monuments, centerline ties and survey reference points shall be protected in place or re- established where disturbed. This work will be the 1377 . . . - 2- , . responsibility of the permittee and shaH be at the . , permittee s expense. 4. Fire protection shaH be provided to the satisfaction of the Fire Department. This shaH include upgrading the fire hydrant, a ,supervised central station fire alarm system and an automatic fire suppression system in the kitchen over cooking surfaces. Hydrant upgrade and fire alarm system may be omitted if building is fuIly fire sprinkled. 5. Water service shaIl conform to the Uniform Plumbing Code and new water service shaIl be instaHed by the Arcadia Water Division upon the request and payment of fees by the developer. 6. Design Review approval shaH be obtained from the Arcadia Redevelopment Agency prior to issuance of any building permits. 7. Any new walls or fences shall be of decorative block or finished with stucco. This shall be subject to the approval of the Planning Department. g, The entrance canopy along San Juan Drive shaH be eliminated unless approval can be obtained from the Public Works Department. 9. Final site plan shall be subject to the approval of the Planning Department. AH wheel stops of parking spaces adjacent to a landscaped area shaIl be eliminated and said landscaped area extended with 6" high continuous concrete curbing, parking spaces 1 through 5 shaIl be shortened to provide additional landscaping and paving materials that are textured and color shall be used at th.e entrance of each driveway and throughout the parking 101. 10. Final landscape plan shall be subject to the approval of the Planning Department. II. Architectural Design Review applications will be required for the entrance canopy and all signs. 12. Hours of operation for the restaurant and cocktail lounge shaH be limited to 11 :00 a.m. to 12:00 midnight. 13. That a modification be granted for 9 compact spaces in lieu fo 7 maximum. ~,- . . 1377 - 3 - '. i . 14. The subject site shall be maintained as per the plans on file in the Planning Department. 15. That C.U.P. 88-012 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 16. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 14, 1988 and the following vote: AYES: Commissioners NOES: None ABSENT: Commissioner Amato Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to .be forwarded to the City Council of the City of Arcadia.
