HomeMy WebLinkAbout1703 . , .' - e RESOLUTION NO. 1703 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 04-001 TO OPERATE A COFFEE HOUSE WITH 23 SEATS, INCLUDING INCIDENTAL OUTDOOR DINING AT 305 N. SANTA ANITA AVENUE, UNIT A WHEREAS, on January 13, 2004, a conditional use permit application was filed by John Vision Restaurant to open a coffee house with 23 seats (Development Services Department Case No. C.U.P. 04-001) at property commonly known as 305 N. Santa Anita Avenue, Unit A, and WHEREAS, a public hearing was held on January 13, 2004, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOLVES AS FOllOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or Vicinity because the initial study did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate seid use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The . . \ .tI proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and aJrrent zoning are consistent with the General Plan. S. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 04-001, to open a coffee house with 23 seats, upon the following conditions: 1. The use approved by CUP 04-001 is limited to a coffee house that sells specialty coffees and teas, sandwiches, salads, and rolls, prepared in the onsite kitchen. The use approved by this application is not a true restaurant or eating establishment. The coffee house shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 04-001, and any expansion upon the use approved shall require approval of a separate conditional use permit. 2. The applicant shall comply with the provisions of the City of Arcadia Incidental Outdoor Dining Regulations, as set forth in the Arcadia Municipal Code, prior to the placement of seating outside the building. 3. The maximum number of onsite seating allowed including computer terminals and incidental outdoor dining shall be limited to 23 seats. 4. A separate sign design review application shall be submitted for all new signs on the premises. 2 1703 . e ~ -- 5. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers. employees, and agents in the defense of the matter. 6. All conditions of approval shall be complied with prior to placement of seating at the coffee house. Noncompliance with the plans, provisions and conditions of approval for CUP 04-001 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the coffee house. 7. Approval of CUP 04-001 shall not take effect until the property owner(s), and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 13, 2004, and the following votes: 3 1703 . . SUMMARY This Conditional Use Permit application was submitted by John Vision Restaurant (Tri Truong), to allow seating for 23 patrons including incidental outdoor dining at an existing take-out only coffee house at 305 N. Santa Anita Avenue, Unit A The Development Services Department is recommending approval of this application. subject to the conditions listed in this report. GENERAL INFORMATION APPLICANT: John Vision Restaurant (lessee) LOCATION: 305 N. Santa Anita Avenue, Unit A REQUEST: A Conditional Use Permit to allow seating for 23 patrons including incidental outdoor dining at an existing take-out only coffee house in a 1,400 sq. ft unit within the C-MI CommerciaJ-Manufacturing zone. Proposed hours of operation are 7:00 a.m. to 11:00 p.m., seven days a week_ SITE AREA: 68,258 square feet (1.57 acre) FRONTAGES: 235 feet along Santa Anita Avenue 291 feet along St. Joseph Street 235 feet along Rolyn Place . I . EXISTING LAND USE & ZONING: The site is bounded by Santa Anita Avenue to the east, St. Joseph Street to the north, and Rolyn Place to the west. It is developed with a warehouse, climbing gym, a restaurant, two office buildings, and the existing John Vision takErOut coffee house, zoned C-MI Commercial- Manufacturing. SURROUNDING LAND USES & ZONING: North: Small Animal Hospital- zoned C-M South: Domenico's Restaurant - zoned C-M East: Building Materials Yard - zoned C-2 West: Jungle Gym Climbing Facility - zoned C-M GENERAL PLAN DESIGNATION: Mixed Use (Commercialllndustrial) BACKGROUND On September 18, 2003, a business license was issued to the applicant for a coffee house for take-out drinks and food only with no seating allowed. This license was approved subsequent to the applicant receiving a parking modification for a retail use in a unit historically used for office uses. The applicant proposes to add seating for 23 patrons onsite. Section 9275.1.45.1 of the Arcadia Municipal Code allows eating establishments in the CPD-1, C-2 or any less restrictive commercial or industrial zone, subject to a Conditional Use Permit. Although a coffee house is a unique use, the definition of an eating establishment most closely resembles the proposed use. PROPOSAL AND ANALYSIS The existing take-out establishment sells specialty coffees and teas, sandwiches, salads, and rolls, prepared in the onsite kitchen. It is similar to a .Start>ucks. coffee shop in that many customers are there to order only a specialty drink and perhaps get a snack. The applicant intends to better serve his customers by offering seating, as is common in many similar coffee shops. The eating establishment is a 1,400 sq.ft. unit located within an existing commercial building, and 790 sq.ft_ would be used for seating area. The remaining floor area consists of the kitchen, men's and women's restmoms, and an office area. The proposed hours of operation are 7:00 a.m. to 11 :00 p.m., seven days a week. CUP 04-001 January 13, 2004 1"'\_-- .., . I . Six of the proposed seats are located on the outside terrace directly adjacent to the front of the building. The Arcadia Municipal Code allows incidental outdoor dining at all eating establishments that have a valid conditional use permit. Three of the interior seats are equipped with computer terminals for patrons to utilize while onsite. The applicant intends to allow free computer use and internet access for patrons of the eating establishment. The computer terminals do not require special approval unless there are four or more computers located onsite. Parkina AJs an existing take-out only business, 8 parking spaces are required for the coffee house. The code does not specify a parking ratio for "coffee houses,. but staff generally uses the parking standards for restaurant uses, if the business offers food and has seating. Using this classification, a coffee house with tables and chairs is required to provide 10 parking spaces per 1,000 sq.ft. of floor area, requiring 15 spaces for the 1,400 sq.ft. establishment. Based on the code requirements, the existing uses require 237 parking spaces. There is an existing deficiency of 159 spaces. The proposed coffee house would increase the parking deficiency to 166 spaces, an increase of only seven spaces. The coffee house is already existing as a take out only business, and the only change to the use is the addition of 23 total seats, including outdoor seating and the three computer terminals. Although the proposed use is considered a restaurant for parking purposes, a coffee house is unlike a true restaurant or eating establishment. Many customers come in only for specialty drinks and are there for only a short time. Another unique aspect of the proposed use is that it serves the immediate neighborhood, which is a mixed-use commerciallindustrial area. The applicant currently experiences a high volume of walk-in business from neighboring commercial uses during business hours. Because of these circumstances, it is the opinion of staff that the proposed coffee house will not result in a significant impact upon the existing parking situation. Other Code ReQuirements The applicant is required to comply with all development requirements and policies determined to be necessary by the Building Official, Fire Marshall, and Community Development Administrator. CEQA Pursuant to the provIsIons of the California Environmental Quality Act, the Development Services Department prepared an Initial Study for the proposed project Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the phYSical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. . FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. . RECOMMENDATION CUP 04-001 January 13, 2004 "--- .. . Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should state the specific reasons for denial and direct staff to prepare the appropriate resolution incorporating the Commission's decision and specific findings. A few months ago you have helped to approve my request to open a "Sandwich and Coffee Shop" in the City of Arcadia, 305 N. Santa Anita A venue. I am grateful to your cooperation and wise decision to bring more businesses and clients into our city of Arcadia. Your staffs from Development Department are cooperative and creative workers.
