HomeMy WebLinkAbout1700 . e I RESOLUTION NO. 17.0.0 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. .03-.01.0 AND ADR 2.0.03-.028 FOR A TUTORING CENTER AT 2.08-212 EAST DUARTE ROAD WHEREAS, on October 6, 2.0.03, the Conditional Use Permit application and architectural design review filed by Robert H. Daggett, on behalf of Stephen Hu for a tutoring center in an existing 5,.07.0 sq.ft. commercial building located at 2.08-212 E. Duarte Road was deemed complete, Development Services Department Case No. C.U.P. 03-010 and ADR 2003-028, at property commonly known as 208-212 East Duarte Road more particularly described as follows: and The Easterly 1.0.0 feet of Lot (2) 33 measured along the southerly line of said Lot, the westerly line thereof being parallel to the easterly line of said Lot of Tract No. 8.08, in the City of Arcadia, County of Los Angeles, State of office of the County Recorder of said County. Except the northerly 12 feet measured at right angles to the northerly lot line as deed to the City of Arcadia, a Municipal Corporation, for Street and Highway purposes, by deed recorded on July 13, 1995 in Book 48339 Page 92, Official Records. Also except that portion thereof lying southerly of the northwesterly line of that strip of land 2.0..00 feet wide as described in the deed to the City of Arcadia for street and Highway purposes, recorded in Book 01230 Page 50, Official Records said northwesterly line being more fully described as follows: Beginning at a point in the easterly line of said Lot 33 distant North 00 21' DO" west thereon 142..0.0 feet from the southwest corner thereof; thence South 660 51' 13" west a distance of 1.06.47 feet to the intersection of the northerly line of the southerly 100.00 feet of said Lot 33 with the said westerly line of the easterly 100.00 feet of said Lot 33. WHEREAS, on October 28, 2003, a public hearing was held before the Planning Commission on said matter at which time all interested persons were given full opportunity to be heard and to present evidence; and. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: -1- 1700 . e . SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use Is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 03-010 and Architectural Design Review 03-028 to operate a tuition center upon the following conditions: 1. That the number of students at anyone time shall not exceed the occupancy limits as set forth in the BUilding Code, or a maximum of 85 students whichever is less. 2. That the tutoring center shall be limited to students in grades one (1) through ten (10). 3. That the site shall be improved and maintained in accordance with the plans on file for CUP 03-010 and Architectural Design Review 03-028. 4. That all City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied with to the satisfaction of Building Services and the Fire Department. 5. That the applicant shall comply with the conditions of approval as set forth by the Engineering Division to the satisfaction of the City Engineer. 6. Because of the limited on-site parking, use of the rear unit shall be restricted to offices only. -2- 1700 I e I 7. Thc;lt if the applicant wishes to maintain the six (6) tandem spaces, these spaces shall be designated for "Employee parking only". 8. The parking area shall be resurfaced and improved per the plans on file including hairpin striping for the parking stalls. 9. That a modification shall be granted for 26 parking spaces in lieu of 41 spaces required for both the tutoring center and an office use. 10. Approval of CUP 03-010 shall not take effect until the property owner(s) and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptancE! of these conditions of approval. 11. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its offiCers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 12. Noncompliance with the provisions and conditions of this COnditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. SECTION 4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council ofthe City of Arcadia. -3- 1700 . e . U, Assistant Planner SUBJECT: Conditional Use Permit Application No. CUP 2003-010 and Architectural Design Review Application No. ADR 2003-028 for a tutoring center at 208- 212 E. Duarte Road e SUMMARY Conditional Use Permit 03-010 and Architectural Design Review 03-028 were submitted by Robert H. Daggett, on behalf of Stephen Hu for a tutoring center with 85 students in an existing 5,070 sq.ft. commercial building located at 208-212 E. Duarte Road. The Development Services Department is recommending approval of this application subject to the conditions in the staff report and adoption of Resolution 1700, a resolution granting Conditional Use Permit 03-010 for a tutoring center at 208-212 E. Duarte Road. GENERAL INFORMATION APPLICANT: Robert H. Daggett (Architect) LOCATION: 208-212 E. Duarte Road REQUEST: A Conditional Use Permit for a tutoring center with 85 students in an existing 5,070 sq.ft. commercial building. The proposed hours are 3:00 p.m.-6:30 p.m., Monday through Friday, and 9:00 a.m.-5:00 p.m. on Saturday. I LOT AREA: 21,000 sq.ft. (0.48 acre) I e I FRONTAGE: 101 feet along Duarte Road EXISTING LAND USE & ZONING: The subject property is improved with two commercial buildings; the front utilized as a liquor store and the rear building is vacant; the westerly portion of the site is zoned C-1, and the easterly portion is zoned R-2. SURROUNDING LAND USES & ZONING: North: Vacant buildings; zoned C-1. South: Single-family resi.dence; zoned R-2 East: Single-family residence; zoned R-2. West: Bank (Eastwest Bank); zoned C-1. GENERAL PLAN DESIGNATION: Commercial BACKGROUND There are three units in the existing two structures on the subject property that were constructed in 1961. The front unit is a liquor store that has been in operation since the 1970's. The two rear units have been vacant since 1999, previous uses in the rear units include bike sales and repair shop and a taxi dispatch center. The total square footage of the existing buildings is 6,570 sq.ft. 'PROPOSAL AND ANALYSIS The applicant is proposing to vacate the liquor store and remodel the buildings and combine the two front units for a 5,070sq.ft. tutoring center with a maximum of 85 students. There are no plans to occupy the rear unit at this time. There will be five classrooms, each with approximately 260 sq.ft. of floor area (for a total of 1,280 sq. ft. of classroom). The applicants have indicated in their application that they will have five (5) teachers and two (2) staff persons. The remainder of the building will be utilized as a lobby, parents waiting area, office, toilet, and kitchen and storage areas. Based on the maximum occupancy limits by the Building Code, each classroom could accommodate 10-12 students at anyone time. Therefore, with five classrooms, there could be 60 students at maximum occupancy. The tutoring program will be offered Monday through Friday at 3:00 p.m. to 6:00 p.m. The proposal also includes Saturday sessions from 9:00 a.m. to 5:00 p.m. This program would serve students in grades one through nine. A tutoring center is a permitted use in the C-1 zone with an approved conditional use permit. CUP 2003-010 October 28, 2003 Page 2 I e I Parkinq The current parking area is deteriorated and needs to be resurfaced. The applicant is proposing 32 parking spaces, six (6) of which are tandem spaces. The Arcadia Municipal Code does not permit tandem spaces and although the applicant may wish to keep the spaces, for code purposes there are only 26 legal parking spaces on site. Based on the current code requirements of one space per 35 sq. .ft. of classroom area, 37 parking spaces would be required for the tutoring center. In addition, the 1,500 sq.ft. building in the rear, if occupied with an office use would require an additional 6 spaces. This would result in an overall parking requirement of 41 spaces, and a parking deficiency of 15 spaces. Since the students are not of driving age, the parking would be utilized for teacher and office parking as well as the loading and unloading of students. In staffs opinion, there is both adequate parking and adequate circulation with access from Duarte Road to the front and an alley to the rear that accesses onto Second Avenue. With the parking deficiency, the rear unit should be restricted to office use only since office uses are generally less intensive than retail and requires less parking per code. An office use would also be more compatible with the proposed tutoring center. ARCHITECTURAL DESIGN REVIEW It does not appear that there have been any improvements to the site since the original construction of the building. The applicant is proposing to significantly remodel the existing buildings to a style described as "Institutional Simplified Federalism". A parapet cornice will be added to the top of the buildings along with enhancements to the building entrances. Planters will be added adjacent to the building as well as wire grids for climbing plants. A trash enclosure and additional landscaping will be included in the parking area. Planning Services conducted a design review and felt that the design is very attractive and would greatly enhance the buildings' appearance as well as the site. The' applicant a~so proposes to install new signs (to be reviewed under a separate Sign Design Review process). It is the Community Development Division's opinion that the proposed building redesign is consistent with the City's Architectural Design Review criteria. CODE REQUIREMENTS All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, parking and site design shall be complied with to the satisfaction of the Building Official, Community Development Administrator, Fire Marshall, and Public Works Services Director. CUP 2003-010 October 28, 2003 Page 3 I e I Any other exterior improvements, such as any new signs', sign face changes, and awnings shall be subject to architectural design review and approval by the Community Development Division. CEQA This project is categorically exempt from the requirements of the California Environmental Quality Act per Section 15322. FINDINGS Section 9275.1.2 of the Arcadia MunicipaJ Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit Application No. CUP 03-010 and Architectural Design Review 03-028, subject to the following conditions: 1. That the number of students at anyone time shall not exceed the occupancy limits as set forth in the Building Code, or a maximum of 85 students whichever is less. 2. PLANNING COMMISSION ACTION Approval The Planning Commission should move to approve Conditional Use Permit Application No. CUP 2003-010, Architectural Design Review Application No. ADR 03..Q28, and adopt Resolution No. 1700 approving CUP 2003..Q10 for a tutoring center at 208.212 E. Duarte Road. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should state the specific reCisons for denial and direct staff to prepare the appropriate resolution Incorporating the Commission's decision and specific findings. The existing parkway width on Duarte Road is ten feet. 2. According to record drawings, the subject property has an existing sewer lateral connecting to the sewer main fine on Duarte Road serving the subject project. Developer shall contact Public Works Services Department to verify if the existing sewer lateral is adequate for this development. The following items are General Conditions of Approval for the subject project: 1. Submit grading and drainage plan prepared by a registered civil engineer subject to the approval of the City Engineer. Provide calculations for both the gravity drainage system and the pump drainage system (if applicable).
