HomeMy WebLinkAbout1696 - RESOLUTION NO. 1696 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA APPROVING CONDITIONAL USE PERMIT NO. 03-008 & ADR 03-008 TO LOCATE A 24' BY 40' MODULAR CLASSROOM AND PERIMETER FENCING AT THE BARNHART SCHOOL, 240 W. COLORADO BLVD. WHEREAS, on. June 19, 2003, a conditional use permit application was filed by Barnhart School to locate a 24' by 40' modular classroom and perimeter fencing at the Barnhart School, 240 W. Colorado Blvd (Development Services Department Case Nos. C.U.P. 03-008 & A.D.R. 03-008) at property commonly known as 240 W. Colorado Blvd.; and WHEREAS, a duly noticed public hearing was held on August 12, 2003, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: __ SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. ? SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the initial study did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. _ 4. That the site abuts streets and highways adequate in width and pavement type W> carry the kind of traffic generated by the proposed use. tit 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 03-008 & ADR 03-008, to locate a 24' by 40' modular classroom and perimeter fencing at the Bamhart School, 240 W. Colorado Blvd., upon the following conditions: 1. The proposed modular classroom building and all temporary storage structures shall be removed by August 12, 2008. 2. The perimeter fencing materilal shall consist of wrought iron or tubular steel. All new fencing material shall not exceed a maximum of six (6) feet in height; and such ~ncing installed adjacent to a public street shall be setback no less than three (3) feet .om the property line. 3. Noncompliance with the plans, provisions and conditions of approval for CUP 03-008 & ADR 03-008 shall be grounds for immediate suspension and/or revocation of any approvals. 4. Approval of CUP 03-008&ADR 03-008 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. 5. That a modification is granted to provide 181 parking spaces in lieu of 184 required (Sec. 9269.5). 6. That the school enrollment shall not exceed 360 full-time students. 7. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and ." officers, employees, and agents from and against any claim, action, or proceeding ~gainst the City of Arcadia, its officers, employees or agents to attack, set aside, void, or 2 " v _nUl any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall 'cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 8. That the school/church's ten-year master plan shall be submitted to the Development Services Department no later than March 31, 2005. SECTION4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. CUP 03-008 & ADR 03-008: A Conditional Use Permit and Architectural Design Review Application to add a 24' by 40' modular classroom, and install perimeter fencing at the Barnhart School, 240 W. Colorado, Blvd. SUMMARY The subject applications were submitted by Bamhart School to add a 24' by 40' modular classroom and install perimeter fencing for security purposes at the Bamhart School located at 240 West Colorado Blvd. The proposed modular building shall serve as a temporary classroom facility for the Barnhart School. The Development Services Department is recommending approval of this application, subject to the conditions Iist.ed in this report. GENERAL INFORMATION APPLICANT: Bamhart School LOCATION: 240 West Colorado Boulevard REQUEST: A Conditional Use Permit and Architectural Design Review to add a 24' by 40' modular classroom, and install perimeter fencing along the northerly and southerly property lines and adjacent to Colorado Place. The applicant's proposal also requires a modification to provide 181 parking spaces in lieu of 184 required. SITE AREA: 267,352 square feet (6.14 acres) FRONTAGES: approximately 461 feet along Colorado Boulevard approximately 601 feet along COlorado Place e . e EXISTING LAND USE & ZONING: The project site is developed with the Santa Anita Church and Barnhart School. The entire site is zoned R-3: Multiple Family Residential. SURROUNDING LAND USES & ZONING: North: Developed with multiple family and single family dwellings; zoned R-3 and R-1 respectively South: Developed with a motel and race track parking; zoned R-3 and R-1 . East: Developed with single family dwellings and the Arcadia Wash; zoned R-1 West: Developed with an office and race track parking: zoned CoO and R-1 GENERAL PLAN DESIGNATION: Commercial BACKGROUND The church and school were constructed in 1959, and since that time five conditional use permits have been approved for the following site improvements: - CUP 68-44: To const(lJcta two-story classroom - CUP 77-13: For to temporary modular classrooms - CUP 79-13: To add two new classrooms to replace the modular classrooms - CUP 81-11: To constructfour new classrooms - CUP 83-04: To construct a resource building/bookstore - CUP 86-01: To construct a 14,636 square foot classroom Design Review application No. ADR 03-008 for the proposed modular classroom and fencing was conceptually approved by staff on June 20, 2003, and because the school and church are conditionally permitted uses within the R-3 zone, a new Conditional Use Permit application must be considered concurrently with the Architectural Design Review in this case, as it is an expansion of a conditionally approved use Le., the school. The proposed project is consistent with the General Plan Land use designation of the project site. PROPOSAL Modular Classroom The proposed modular building is 24' by 40' and shall be used as a temporary classroom building. However, the applicant will not be expanding the current enrollment of 360 students. The modular classroom will be used to alleviate crowding in existing classrooms. CUP 03-008 & ADR 03-008 August 12,2003 Page 2 e . e The proposed modular building location is adjacent to the southerly elevation of Fellowship Hall, toward the center of the property, which is currently a part of the parking lot. The on-site vehicular circulation will be modified to accommodate the modular building. The applicant has worked with staff to find an appropriate location for the modular building to minimize visual impacts associated with the proposed structure. The modular building will not be visible from Colorado Boulevard and will be minimally visible fOrm Colorado Place. The proposed modular building features a wood panel exterior that will be painted to match the existing buildings. The modular building will be fully skirted and will have the appearance of a permanent structure. Landscaping Will be provided around the modular building to further enhance the site. Fencina As part of the design review process, the applicant is requesting additional fencing around the perimeter of the site. The applicant is proposing 7-foot tall wrought iron or tubular steel fencing adjacent to Colorado Boulevard and Colorado Place, with sliding gates across each driveway. Because the project site is within a residential zone, staff is recommending a maximum height of 6 feet for the perimeter fencing adjacent to the street, which is more compatible with the maximum fence height allowed in residential zones. Staff is also recommending that the fencing be setback at least 3 feet from the front property line to be consistent with residential fencing r~gulations. The Barnhart School borders Motel 6 to the south. Along the entire shared property line is a masonry wall that is as low as 30n and transitions to a maximum height of approximately 6 feet. There is an existing 13-foot tall chain link fence atop part of the wall that shall remain. The applicant is requesting to continue a combination of chain link and wrought iron fencing extending to Colorado Place. The fencing proposed by the applicant would vary between 7 and 8 feet above the existing block wall, which staff feels is too excessive. The intent of this fencing is to provide additional security for the Barnhart School. Staff recommends allowing the applicant to construct a 6-foot high fence on top of the existing block wall. The total height of the wall/fence combination would vary depending on the height of the existing block wall. Staff is also recommending that the proposed fencing material be'wrought iron or tubular steel. It is the opinion of staff that 6-foot high wrought iron or tubular steel fencing would be more attractive than chain link, and the lower height would still provide adequate security for the school. Parkino Pursuant to the provisions of CUP 86-01, the project site is required to maintain 184 parking spaces. Because the enrollment of the school is not expanding, no CUP 03-008 & ADR 03-008 August 12, 2Q03 Page 3 e . e additional parking is needed. However, the placement of the modular building will eliminate approximately six parking spaces, but the applicant will re-stripe the parking lot to accommodate a total of 181 parking spaces. Therefore, the applicant is requesting a minor modification to provide 181 parking spaces in lieu of 184 required. All parking spaces meet the minimum dimensions set forth by the Arcadia Municipal Code. Master Plan The applicant has indicated that the school is working on a 1,0 year Master Plan. Incorporated in that Master Plan is the proposed expansion of the existing middle school building, which would take the place of the proposed modular classroom. The scheduled timeline for removal of the proposed modular building is five years, August of 2008. Therefore, staff has included a condition of approval that requires the proposed modular building to be removed in five years. There are also several temporary storage structures on the project site. In researching the property records, staff did not find approvals for the storage structures. Staff recommends that as part of the Master Plan, all temporary storage structures be removed from the site. Therefore, staff has included a condition of approval requiring removal of all temporary storage strudures by August 2008. Code Recuirements All City requirements regarding disabled access and facilities, building safety, fire prevention, detection, and suppression, and site design will be complied with to the satisfaction of the Building Official, Fire Marshall, and Community Development Administrator. ANALYSIS The proposed project conforms with all provisions of the Arcadia Municipal Code except for the minor modification issue discussed in this report. The church and school are permitted uses under the aforementioned conditional use permits, and the proposed project is a minor expansion of a previously approved school use. If is the opinion of staff that th~ proposed project, as conditioned, will be an appropriate improvement to the school. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. CUP 03-008 & ADR 03-008 August 12,2003 Page 4 e . e 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. CEQA The proposed use will not have a potential for causing a significant effect on the environment and is, therefore, categorically exempt from CEOA per Section 15305. RECOMMENDATION. The Development Services Department recommends approval of Conditional Use Permit Application No. CUP 03-008 & ADR 03-008 subjectto the following conditions: 1. The proposed modular classroom building and all temporary storage structures shall be removed by August 12, 2008. 2. The perimeter fencing material shall consist of wrought iron or tubular steel. All new fencing material shall not exceed a maximum of six (6) feet in height; and such fencing installed adjacent to a public street shall be setback no less than three (3) feet from the property line. 3. Noncompliance with the plans, provisions and conditions of approval for CUP 03-008 & ADR 03-008 shall be grounds for immediate suspension and/or revocation of any approvals. 4. The City shaff promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. PLANNING COMMISSION ACTION Approval The Planning Commission should move to approve CUP 03..008 & ADR 03..008 and adopt Resolution No. 1696 to locate a 24' by 40' modular classroQm and perimeter fencing adjacent to the northerly and southerly property lines and adjacent to Colorado Place and approve a modification to provide 181 parking spaces in lieu of 184 required at Barnhart School, 240 W. Colorado Blvd. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should move for denial and direct staff to prepare a resolution incorporating the Commission's decision and specific findings. The property was first developed in 1959, It is of a level elevatiop with the correct slope for water run oft: As to soil stability, the entire property bas ~ither a building. hardscape, or is landscaped. There are no bare undeveloped areas on this site. The project site currently has 11 buildings spread around the perimeter and center and a large parking area. Four of the buildings would be considered two story buildings; all the others would be considered one-story buildings. The buildings are used lis classrooms, assembly haIIs, offices. a sanctuary, and a chapel The buildings are bordered on the west side by a residential apartment bungalow style complex, owned by the same owner of the project site; on the north by a residential street; on the east by the East Branch of the Arcadia Wash; and on the south by a coIllIl1ercial property, a motel and a surfuce street. The parking area and driveways are asphalt. The landscape includes grass areas. planted areas of drought resistant bushes and perennials, many large trees, and two playgrounds. 36.
