RESOLUTION NO. 1693 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA APPROVING CONDITIONAL USE PERMIT NO. 03-004 & ADR 02-064 TO LOCATE A DRIVE" THRU PHARMACY WINDOW AT 745 W. NAOMI AVENUE (PAVILIONS SUPERMARKET) WHEREAS, on March 10. 2003, a conditional use permit application was filed by MCA Architects, Inc. to locate a drive-thru pharmacy window at Pavilions Supermarket (Development Services Department Case Nos. C.U.P. 03-004 & A.D.R. 02-064) at property commonly known as 745W. Duarte Road; and WHEREAS, a duly noticed public hearing was held on April 22, 2003, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This,&ommission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity because the initial study did not disclose any substantial adverse effects to the area affected by the proposed project. 2. That the use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other features including the shared parking with the neighboring business, are adequate to adjust said use with the land and uses in the neighborhood. The proposed project complies with all related zoning requirements as set forth in the Arcadia Municipal Code. 4. That the site abuts streets and hig~ways adequate in width and pavement type to carry the kind of traffic generated by ~osed use. . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan because the land use and current zoning are consistent with the General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 03-004 & ADR 02-064, to locate a drive-thru pharmacy window at Pavilions Supermarket, upon the following conditions: 1. The hours of operation for the drive-thru shall be as follows: Monday . through Friday - 9:00 AM to 9:00 PM, Saturday and Sunday - 9:00 AM to 6:00 PM. 2. Closed Circuit security cameras shall be installed to the satisfaction of the Police Department. . 3. The Fire lane adjacent to the drive-thru lane shall be constructed to the satisfaction of the Fire Department. This may result in a net loss of seven (7) parking spaces immediately adjacent to the proposed drive-thru lane. The redesign of the parking spaces in this area shall be subject to final review by the Fire Chief. 4. All onsite signage shall be in compliance with the City's sign ordinance (AMC Sec. 9262.4 to Sec. 9262.4.20). All sign age reviewed and approved by the Planning Division shall require appropriate permits from the Building Division. 5. Noncompliance with the plans, pr:ovisions and conditions of approval for CUP 03-004 & ADR 02-064 shall be grounds for immediate suspension and/or revocation of any approvals, which shall result in closing ofthe drive-thru. 6. Approval of CUP 03-004 & ADR 02-064 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. . 2 . 7. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its oWn attorney to represent the City, its officers, employees, and agents in the defense of the matter. SECTION 4, The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Naomi Avenue (Pavilions Supermarket). SUMMARY The Conditional Use Permit and Architectural Design Review applications were submitted by MCA Architects, Inc. to locate a drive-thru pharmacy window for Pavilions Supermarket located at 745 W. Naomi Avenue. The Development Services Department is recommending approval of this application, subject to the conditions listed in this report. GENERAL INFORMATION APPLICANT: MCA Architects, Inc. LOCATION: 745 W. Naomi Avenue (Pavilions Supermarket) REQUEST: A Conditional Use Permit and Architectural Design Review application for a drive-thru pharmacy lane and pick-up window located on the westerly elevation of the existing Pavilions Supermarket. The proposed business hours for the drive-thru are as follows: Monday through Friday - 9:00 AM to 9:00 PM, Saturday and Sunday - 9:00 AM to 6:00 PM. SITE AREA: 15.76 acres - this site includes the Pavilions Supermarket, the 20,180 square foot retail building to the west of the supermarket, and the Burlington Coat Factory-Ross shopping complex. FRONTAGES: Approximately 1,041 feet along W. Naomi Avenue CUP 03-004 & ADR 02-064 April 22. 2003 Page 1 . . . Approximately 675 feet along S. Baldwin Avenue Approximately 1,064 feet along W. Duarte Road EXISTING LAND USE & ZONING: The project site is a 64,872 square foot Vons Pavilions Supermarket. The entire site is developed with a shopping center (a.k.a., The Arcadia Hub) anchored by the Pavilions Supermarket, the Burlington Coat Factory and Ross clothing stores. The entire site is zoned C-2: General Commercial. SURROUNDING LAND USES & ZONING: North: 25-unit apartment building (c. 1961) - zoned C-2 South: Multiple-family residential complexes - zoned R-3 East: Parking structure for the Pavilions & adjacent Burlington Coats Factory - zoned C-2 West: Apartment complex - zoned C-2 GENERAL PLAN DESIGNATION: Commercial BACKGROUND Vons Pavilions Supermarket recently completed an interior remodeling project that included the addition of a new pharmacy. As part of the pharmacy addition, Pavilions is requesting to add a drive-thru lane atthe westerly elevation. Pursuant to AMC Section 9275.1.45, any drive-thru within the C-2 zone is requesting a conditional use permit. Design Review application No. ADR 02-064 was conceptually approved on December 19, 2002. Because a drive-thru is a conditionally permitted use within the C-2 zone, a Conditional Use Permit application must be approved concurrently with the Architectural Design Review. PROPOSAL AND ANALYSIS The proposed drive-thru lane will be located on the westerly elevation of the Pavilions building. The applicant proposes to dedicate 13 feet of the paved area adjacent to the westerly elevation of the building as a drive-thru. A 6-inch concrete curb will provide a barrier between the drive-thru lane and the westerly elevation of Pavilions. Architectural Desicn The proposed drive-thru window shall be framed by two vertical elements to match the column feature on the southwest corner of the Pavilions building. The proposed columns will also feature a comice element painted to match existing columns. The CUP 03-004 & ADR 02-064 April 22,2003 Page 2 . . . 16" by 16" slate base treatment featured on the front elevation shall be "wrapped around" and extended to the drive-thru window. Therefore, the design of the proposed drive-thru window is architecturally compatible with the design of the existing Pavilions building. A blue decorative canopy shall be mounted above the drive-thru window. Also, wall mounted signage shall be located above the window canopy. The signage is consistent with the City's Architectural Sign Design Guidelines. Safetv The Arcadia Police and Fire Departments reviewed this application. The Police Department recommended that a closed circuit television camera be installed as a security measure to capture license plate numbers of cars utilizing the drive-thru. The Police department also recommended that the drive-thru lane be adequately lighted for added nighttime security. The proposed drive-thru lane area is currently lighted and the lights shall remain. The Fire Department supports the proposed drive-thru and recommends that the fire lane areas should be properly marked, and that the existing fir sprinkler system be extended to the drive~thru canopy area. Also, the Fire Department recommends that the ten 90-degree parking spaces located opposite the drive-thru be removed, to accommodate the fire lane. Staff has worked with the Fire Department on this issue and has concluded that it will be acceptable to both the Fire Department and the Development Services Department if the ten spaces adjacent to the drive-thru are converted to parallel parking spaces. This will allow adequate space for a fire lane and will minimize the number of parking spaces to be removed. Circulation Primary access to the drive-thru will be from Duarte Road. Traffic exiting the drive- thru will be routed to the south, most likely to exit onto Naomi Avenue. The City's Traffic Engineer has reviewed the proposed site plan, and is in support of the application. ParkinQ There are 425 parking spaces on the portion of the site with Pavilions Supermarket and the 20,180 square-foot, one-story retail building situated at the westerly end of the center. Pavilions has been allotted 321 parking spaces, and the retail building is allotted 104 spaces. Of the 321 parking spaces allotted to Pavilions, only 312 parking spaces are required for the grocery store. Therefore, Pavilions has a surplus of nine parking spaces. The proposed drive-thru lane shall be located adjacent to the westerly elevation of the Pavilions building. As previously stated, the Fire Department is recommending CUP 03-004 & ADR 02-064 April 22,2003 Page 3 . . . removal of ten parking spaces adjacent to the drive-thru lane. Although the remaining drive aisle and back out space adjacent to the drive-thru is adequate for two-way access, the Fire Department wants to leave as much room as possible for a fire lane. The Fire Department and the Development Services Department support converting ten adjacent parking spaces to three parallel parking spaces. This shall result in a net loss of seven parking spaces, however Pavilions currently has a surplus of nine spaces. Also, based on staff observation, the parking spaces immediately to the north of the drive-thru lane are rarely utilized. Therefore, staff is in support of the loss of seven parking spaces. Hours of Ooeration The proposed hours of operation are Monday through Friday - 9:00 AM to 9:00 PM, Saturday and Sunday - 9:00 AM to 6:00 PM. Most businesses in the shopping center are open until midnight, however, Pavilions received approval of a conditional use permit to operate 24 hours a day. Because the proposed drive-thru is adjacent to an apartment building, staff is recommending the hours of operation for the drive- thru are limited to Monday through Friday - 9:00 AM to 9:00 PM, Saturday and Sunday - 9:00 AM to 6:00 PM, as proposed by the applicant. Code Reauirements All City requirements regarding disabled access and facilities, building safety, fire prevention, detection, and suppression, and site design shall be complied with to the satisfaction of the Building Official, Fire Marshall, a'nd Community Development Administrator. Compliance is to be determined by having fully detailed tenant improvement plans submitted for plan check review and approval. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed 'use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. CEQA The proposed use will not have a potential for causing a significant effect on the environment and is, therefore, categorically exempt from CEOA per Section 15332. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit Application No. CUP 03-004 & ADR 02-064 subject to the following conditions: 1. The hours of operation for the drive-thru shall be as follows: Monday through Friday - 9:00 AM to 9:00 PM, Saturday and Sunday - 9:00 AM to 6:00 PM. 2. PLANNING COMMISSION ACTION ADDroval The Planning Commission should move to approve CUP 03.004 & ADR 02.064 and adopt Resolution No. 1693 to locate a drive-thru pharmacy window at 745 W. Naomi Avenue. (Pavilions Supermarket) Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should move for denial and direct staff to prepare a resolution . incorporating the Commission's decision and specific findings. Environmental Settin2 The existing site is relatively flat with respect to Naomi Ave. and is approximately three feet higher than Duarte. The site contains several small shop buildings as well as major tenants including Pavilions and Burlington Coat Factory. These buildings compose the perimeter of the. site along Duarte and Baldwin Ave. as well as the adjacent residential to the west. The remainder of the site is composed of asphalt paving for parking and landscaped planters throughout. The site is bounded to the west with residential.housing (both single and multi-family), multi-family and office/retail to the north and site (across Duarte and Naomi resp.) and retail to the east (along Baldwin Ave.). The existing.retail uses on site, which bound, Baldwin Ave., are approximately 40' high, 2-story, buildings with little setback.
