CUP 02-020 FOR A TWO-STORY ADDITION TO THE NEW CAR SHOWROOM AND REVISIONS TO CERTAIN CONDITIONS OF APPROVAL OF CUP 01-010 (RESOLUTION NO. 1640) REGARDING SIGNS, FENCING AND LANDSCAPING FOR THE NEW AND USED CAR DEALERSHIP AND SERVICE CENTER AT 55 WEST HUNTINGTON DRIVE. WHEREAS, on October 29, 2002, a Conditional Use Permit application was filed by Rusnak/Arcadia for a 2,644 square foot, two-story addition to their new car showroom at 55 West Huntington Drive; Development Services Department Case No. CUP 02-020, and concurrent with that application they are requesting revisions to CUP 01-010 (Resolution No. 1640) for their new and used car dealership and service center at 55 West Huntington Drive, more particularly described in the attached Exhibit 'A'; and . WHEREAS, a public hearing was held on December 10, 2002 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE,. THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report dated December 10, 2002 are true and correct. SECTION 2. This Commission finds: 1. That the granting of Conditional Use Permit No. CUP 02-020 and revising Conditional Use Permit No. CUP 01-010 will not be detrimental to the public health or welfare, nor injurious to the property or improvements in the zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, . landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate .in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the subject property is designated for commercial use in the General Plan, that the proposed use is consistent with that designation, and that the granting and revising of the Conditional Use Permits will not adversely affect the comprehensive general plan. 6. That the evaluation of the environmental impacts as set forth in the Initial Study is appropriate and that the project Will have no significant effect upon the environment within the meaning of the California Environmental Quality Act of 1970, and, when considering the project as a whole, there was no evidence before the City that the proposed project would have any potentially adverse effect on wildlife resources or the habitat upon which wildlife depends, and therefore, a Negative Declaration was adopted. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 02-020 for a 2,644 square foot, two-story addition to the new car showroom at 55 West Huntington Drive, subject to the following conditions: 1. The showroom addition and the Site-shall be.improved and maintained in manne'rs that are consistent with the proposal and plans submitted and conditionally approved for CUP 02-020, subject to design review approval by the Arcadia Redevelopment Agency. 2. A sam pie of the black "Alucobond" metal shall be provided for consideration and approval by the Development Services Directorand/or the Deputy Executive Director of the Arcadia Redevelopment Agency prior to the issuance of a Building Permit for the showroom. 3. The construction plans for the showroom addition shall include detailed landscaping and irrigation plans, which shall be subject to review and approval by the Development Services Director and/or the Deputy Executive Director of the Arcadia Redevelopment Agency. -2- 1684 . -. . . . . 4. A decorative treatment shall be included in the new concrete walkway for the new main entrance, the design of which shall be subject to review and approval by the Development Services Director and/or the Deputy Executive Director of the Arcadia Redevelopment Agency. 5. The showroom addition and the new car sales portion of the site (i.e., the area east of the driveway on Huntington Drive and south of the service center driveway) shall comply with all building and safety measures determined to be necessary by the Building Official and Fire Marshall, and shall be subject to review for, and compliance with all applicable and necessary National Pollutant Discharge Elimination System (NPDES) provisions as determined by the Public Works Services Director. 6. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 7.' Approval of CUP 02-020 shall not take effect until the applicant and property owner have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of all the conditions of approval. 8. Noncompliance with the plans, exhibits, provisions, and conditions of approval for CUP 02-020 shall be grounds for suspension and/or revocation of the CUP. -3- 1684 SECTION 4. That for the foregoing reasons this Commission grants the following revisions to Conditional Use Permit No. CUP 01-010 (Resolution No. 1640) for the new and used car dealership and service center at 55 West Huntington Drive, subject to the conditions listed after the revisions: 1. Section 3.3.a of Resolution No. 1640 is revised (additions in bold italics and deletions in strikellmll,Jlll=ls) as follows: "a. Freestanding signs (the Code limits the site to 2 freestanding signs with a minimum distance of 200 feet between them) shall be limited to monument or pylon type signs with one to have a maximum height of 17'-6", and the other to have a maximum evemll height of 12 feet (I.e., including the sign area and any decorative base and/or cap) and their colors and materials shall be consistent with the architecture of the building. The final design and location of any freestanding sign shall be subject to approval by the Development Services Director and/or the Deputy Executive Director ofthe Arcadia Redevelopment Agency." 2. Section 3.3.c of Resolution No. 1640 is revised (additions in bold italics) as follows: "c. Any existing chain-link fencing and gates are to be replaced with wrought-iron fencing and gates, or thoroughly concealed (e.g., with landscaping material) from public view, or screening and/or slats may be added to the existing chain-link fencing and gates for a maximum period of two years from this revision (i.e., up until December 10, 2004). Any existing barbed wire and/or razor wire must be removed. Any new or replacement fencing to be installed shall be wrought iron. Compliance with these fence conditions is subject to Architectural Design Review and the final installations are subject to approval by the Development Services Director and/or the Deputy Executive Director of the Arcadia Redevelopment Agency." 3. The revised conditions of approval for CUP 01-010 (Resolution No. 1640) shall be satisfied within 90 days to the satisfaction of the Development Services Director and/or the Dep'uty Executive Director of the Arcadia Redevelopment Agency, except for the revisions to Section 3.3.d.i which shall be satisfied in conjunction with the showroom addition, or within two years, whichever is sooner, to the satisfaction of the Development Services Director and/or the Deputy Executive Director of the Arcadia Redevelopment Agency. -5- 1684 5. The new pylon sign shall be installed and maintained in a manner that is consistent with the proposal and plans submitted and conditionally approved for the revisions to CUP 01-010 (Resolution No. 1640) including the enhancing of the landscaping at the sign location, subject to design review approval by the Arcadia Redevelopment Agency, and to the satisfaction of the Development Services Director and/or the Deputy Executive Director of the Arcadia Redevelopment Agency. 6. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval' of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. Noncompliance with the plans, provisions, and conditions of approval for CUP 01..010 (Resolution No. 1640) as originally approved, as well as with the revisions to CUP 01-010 (Resolution No. 1640) shall be grounds for suspension and/or revocation of CUP 01-010. SECTION 5. The decision, findings, and conditions of approval contained in this Resolution reflect the Planning Commission's action of December 10, 2002 to grant Conditional Use Permit No. CUP 02-020, revise Conditional Use Permit No. -6- 1684 . . . . . . CUP 01-010 (Resolution No. 1640) and adopt this Resolution No. 1684. The Secretary shall certify to the adoption of this Resolution. Huntington Drive. SUMMARY . Conditional Use Permit Application' No. CUP 02-020 was submitted by Rusnak/Arcadia for a 2,644 square foot addition to the southeast corner of the automobile showroom at 55 W. Huntington Drive. The applicant is also requesting revisions to €:ondltional Use Permit No. CUP 01-010 regarding signs, fences, gates and landscaping for the existing automobile dealership and service center. The' Development Services Department is recommending approval of CUP 02-020 and limited approval of the revisions to CUP 01-010. GENERAL INFORMATION APPLICANT: Rusnak/Arcadia LOCATION: 55 W. Huntington Drive REQUESTS: 1) A Conditional Use Permit for a 2,644 square foot, two-story addition to an automobile sales showroom. 2) Revisions to certain conditions of approval of CUP 01-010 (Resolution No. 1640) regarding signs, fences, gates, and landscaping for the existing new and used car dealership and automobile service center. . Southwest: Cocktail Lounge - zoned C-2 West: Restaurant - zoned C-2 Nort~west: Single-family residences - zonedRc1 BACKGROUND The Planning Commission adopted Resolution No. 1640 (attached)'"oh May 22, 2001 to grant CUP 01-010 to Rusnak/Arcadia to operate a new and pre-owned automobile dealership and service center at 55 W. Huntington Drive. CUP 01-010 also allowed the addition of a new service reception canopy and automated car wash building. Rusnak/Arcadia recently completed the refurbishing of the existing new car showroom. However, they have determined that additional space is necessary for their new car sales and are proposing to add onto the showroom. The applicant would also like to revise some of the provisions of'CUP 01-010. PROPOSAL AND ANALYSIS - Showroom Addition The proposed addition to the new car showroom will be at the southeast comer of the subject property. The addition will be 25 feet tall with 1,828 square feet of ground floor . CUP 02-020 and Revision to CUP 01-010 December 10, 2002 Page 2 . . . space and an 816 square foot mezzanine. The front of the ground floor will be used to display new automobiles, and the rear portion wili be for offices.. The mezzanine will be for open offices. A Condi~ional Use Permit is necessary for this addition because it is an expansion of the automobile deall;lrship. Architectural Desion Review - Concurrent with th~,qQnsj\leration of,CUP 02-,020, the,Planning Commission is to review the applicant's architectural, landscaping and sign design concept plans. The subject properly is within tl:leCentral Redevelopment Project Area and the proposed showroom addition and freesta~ding sign are' sul;lject to design review approval by the Arcadia Redevelopment Agency (i.e., Arcadia City Council) therefore, the Planning Con:t!11ission~s comm_ents.and recommendations with regard to the design concept plans will be forwarded to the Agency. The showroom addition has been designed ,to fill in an open area at the southeast corner of the site. The addition is intended to be the main entrance for the new car dealership and as such will be, a focal point. The addition will be curved and oriented to the southeast. The ground floor will be fully glazed, except for the rear office area. The exterior will be finished with "A1ucobond" metal panels similar to th~ fayBde of the existing shawrpom, except that the color of the addition will be black, and a 36-inch high, brushed stainless steel "RUSNAK" sign will be above the southeast facing doorway. Staff has suggested that the addition match the existing showroom (i.e., "Champagne Metallic" colored panels) however, the architect explained that the' chrome-on-black color scheme matches the RUSNAK logo, and that a bold architectural statement is necessary because this comer of the site is not readily visible, especially to westbound traffic, because of the Arcadia Storage building and the extended roofline of Rod's Restaurant. ' Staff's opinion is that the proposed addition will provide a bold architectural statement, but that it will nQt be overly conspicuous provided that the black metal panels are not glossy or reflective. Staff recommends that a sample of the black "Alucobond" be provided for consi,deration and approval by the Redevelopment Agency, and that a decorative treatment be added to the new concrete walkway for the new main entrance. Other Reouirements The showroom addition and the new car sales portion of the site shall comply with all building and 13afety measures 'determined to be necessary by the Building Official and Fire Marshall, and shall be subject to review for, and compliance with all applicable and necessary National Pollutant Discharge Elimination System (NPDES) provisions as determined by the Public Works Services Director. The applicarit is requesting revisions to some of the conditions of approval of CUP 01-010 (Resolution No. 1640 - attached) that relate to the height of a 'freestanding sign, the perimeter fencing and gates, and the landscaping. , - · Freestanding Sign - Section '3.3.a of Resolution No. 1640 - This condition limits freestanding signs to monument types 'with -a maxirnum ove(all'h,eight of 12 feet' ' . The proposed freestanding sigri will be located at the southwest corner of the site, at the intersection of Huntington''[)rive and Santa Clara Street. The applicant's opinion is that the proposed sign is appropriate forthe'size of their site and for that intersection. . For the'subject site, the Code allows a maximum of two freestanding signs with a minimum distance of 200 feet between them; a maximum height of 25 feet,and a total freestanding sign area of 350 square feet. Staff's opinion is that the proposed sign is appropriate ,for the site; however the landscaping at tlie sign location Sh0Uld De larger to be proportionate with the proposed sign. .'.' At this time, a second freestanding sign is not being proposed. If a second freestanding sign is to be installed, staff's opinion is that the maximum 12~foot height limit stibuld be applied to that second sign. '. l' . Section 3.3.a of Resolution No. 1640 is proposed to be revised (bold italics) as follows: a. Fencing and gates - S.ection3.3.c of Resolution No. 1640 - This condition requires that any existing chain-link fencing and gates be replaced with wrought-iron fencing and gates, or thoroughly concealed. . There is chain-link fencing on the northem portion of the site that encloses the vehicle storage area, and chain~link gates enclose the service center. There are two chain-link gates Qn the property line along !VIorlan Place, and two chain,link gates facing Santa Clara Street. Also, chain..link gates enclose the trash enclosure, which faces Santa qi'lra Street. The southerly gate on Morlan Place,' which is the main customer entry to the service center, has been replaced with wrought iron. Silver wind screening has been added to the chain-link fencing and gate~ that face Santa Clara Street and Morlan Place, and slats are insta,lIed on the chain-link gates for the service center and trash enclosure. Photographs of these fences and gates are attached. The chain-link fence between the subject property and the. adjacent church property to the northeast is in compliance with CUP 01-010 because it is thoroughly screened by oleanaers, even though the oleanders are on the church property. The applicant contends that they are not sure if the current configuration of the vehicle storage. area will remain becauJ3e they are not sure of,their storage needs, and they are not sure if the service center will remain as, is. Staffs opinion is that the wind ~creening is not unsightly, but is concerned about its durability. Staff recommends that the wind screening be allowed for a period of two years, after which the above condition shall be fully complied with as stated in Resolution No. 1640. Staff does not think that the chain-link gates with slats are acceptable on the trash enclosure and at the south end of the Service Center. These two gates are unsightly and are readily visible from Santa Clara Street. The trash enclosure should be provided with solid metal gates as required by Code, and the southerly Service Center gate should also be a solid metal gate. These requirements should be satisfied within 90 days. Section 3.3.c of Resolution No. 1640 is proposed to be revised (bold italics) as follows: c. Any existing chain-link fencing and gates are to be replaced with wrought-iron fencing and gates, or thoroughly concealed (e.g., with landscaping material) from pUblic view, or screening may be added to the existing chain-lin,k fencing and gates for a maximum period of two years from this revision; (i.e., IJp until December 10, 2004) except for the trash en(:/osure and the southerly Service Center gate, which are to be provided with solid metal gates. Any existing barbed wire and/or razor wire must be removed. Any new or replacement fencing to be Installed shall be wrought iron. Resolution No. 1640 calls for a 42-inch,wide planting area, however it appears that only a 30-irich wide'planting area 'with a 6-inch curb along the back will fit between the vehicles being displayed in front of the showroom and the Huntington Drive property line. Resolution No. 1640 required that the on-site planters include trees. However, the applicant did not plant trees because there are mature street trees along Huntington Drive"at 20' to 25-foot intervals, and the applicant kept the mature Crape Myrtles along Santa Clara Street. That the granting (and revising) of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. ' 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces: walls, fen~s, parking, loading, landscaping, and other features required to adjust said lise with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width, and pavement type to carry the kind of traffic generated by thE:! proposed use. 5. That the granting (and revising) of such Conditional Use Permit will not adversely affect the comprehensive General Plan.' , CUP 02-020 and Revision to CUP 01-010 December 10, 2002 Page 7 CEQA - Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the projeCt'including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering, the record asa whole; there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which 'the, wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION A. The Development Services Department recommends approval of Conditional Use Permit No. ,cup 02-020, subject to the following conditions: 1. The showroom addition and the site shall be improved and maintained in manners that are consistent with the proposal and plans submitted ahd conditionally approved for CUP 02-020, subject to design review approval by the Arcadia Redevelopment Agency. 2. A sample of the black "Alucobond" FRetal shall be provided for consideration . and approval by the Development Services Director and/or the Deputy Executive Director of the Arcadia Redevelopment Agency prior to the issuance of a Building Permit for the showroom. ' 3. The construction plans for the showroom addition shall Include detailed landSCC!ping and Irrigation plans, which shall be subject to review and approval by the Development Services Director and/or the Deputy Executive Director of the Arcadia Redevelopment Agency. 4. A decorative treatment shall be included in the new eontrete walkway for the new main entrance, the design of which shall be subject to revi~w and approval by the Develoj:mi'ent Services Director ana/or the Deputy Executive Director of the Arcadia Redevelopment Agency." . 5. The showroom addition and the new car sales portion of the site (I.e., the area east of tt)e driveway on HUl)tlngton Drive and ~outh, of. the service center driveway) shall comply With all l;>uilding and s~fety meas.ur~ determined to be necessary by the Building Official and Fire Marshall, and shall be subject to review for, and compliance with all .applicable and necessary National Pollutant Discharge Elimination System (NPDES) provisions as determined by the Public Works Services Director. .' The applicant shall defend, Indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers,employees or agents to attack, set aside, void, or annu,l,any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of. approval of the City Council, Planning . Commission, or City Staff, which' action is brought within the time period provided for ir:1 Government Code Section 66499.37 or other provision of law applicable to this project or decision. . The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decisio[1 and the City shall cooperate fully in the defense Of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the m~tter. 7. Approval of CUP 02-020 shall not take effect until the applicant and property owner have. executed and filed the Acceptance. Form available from the Development Services Department to indicate awareness and acceptance of all the conditions of approval. 8. Noncompliance with the plans, exhibits, provisions, and conditions of approval for CUP 02-020 shall be grounds for suspension and/or revocation of the CUP. B. The Development Services Department recommends approval of the following revisions to, Conditional USEil, Permit No. CUP 01-010 (Resolution No. 1640) subject to the conditions listed after the revisions: 1. Section 3.3.a of Resolution No. 1640 is revised (bold italics) as follows: a.
