HomeMy WebLinkAbout1678 . . e RESOLUTION NO. 1678 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. CUP 02-016 FOR A 1,000 SQUARE FOOT MARTIAL ARTS STUDIO WITH A 480 SQUARE FOOT TRAINING FLOOR AREA AT 153 NORTH SANTA ANITA AVENUE. WHEREAS, on July 29, 2002, a Conditional Use Permit application was filed by Mr. Tommy Chavies for an existing martial arts studio with a 480 square foot training floor area in a 1,000 square foot commercial space; Development Services Department Case No. CUP 02-016, at 153 North Santa Anita Avenue; and WHEREAS, a public hearing was held on September 10, 2002 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report dated September 10, 2002 are true and correct. SECTION 2. This Commission finds: 1. That the granting of the Conditional Use Permit will not be detrimental to the public health or welfare, nor injurious to the property or improvements in the zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. e . . 5. That the subject property is designated for commercial use in the General Plan, that the proposed use is consistent with that designation, and that the granting of the Conditional Use Permit will not adversely affect the comprehensive general plan. 6. That the evaluation of the environmental impacts as set forth in the Initial Study is appropriate and that the project will have no significant effect upon the environment within the meaning of the California Environmental Quality Act of 1970, and, when considering the project as a whole, there was no evidence before the City that the proposed project would have any potentially adverse effect on wildlife resources or the habitat upon which wildlife depends, and therefore, a Negative Declaration was adopted. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 02-016 for a 1,000 square foot martial arts studio with a 480 square foot training floor area at 153 North Santa Anita Avenue, subject to the following conditions: 1. The subject martial arts studio shall be operated in a manner consistent with the plans and documents submitted for Conditional Use Permit Application No. CUP 02-016 to the satisfaction of the Community Development Administrator. 2. If the church at 21 Morlan Place holds services in the evenings per the schedule approved by CUP 77-27 and in the sole determination of the Community Development Administrator there arises a parking problem, the applicant shall adjust his class schedule to eliminate any conflicts with the church's schedule, subject to the approval of the Community Development Administrator. 3. The premises of the martial arts studio shall be inspected by Building Services and the Fire Prevention Bureau within 30 days, and the premises shall be brought into compliance with all building and safety measures required for the applicant's martial arts studio as determined to be necessary by the Building Official and Fire Marshall. Any and all building and safety deficiencies shall be resolved within 30 days of the respective inspections to the satisfaction of the Building Official and Fire Marshall. -2- 1678 . . . 4. Conditional Use Permit No. CUP 02-016 shall not be effective until the applicant secures an exemption from Redevelopment Agency Resolution No. ARA- 172. 5. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose Its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 6. Approval of CUP 02-016 sQall not take effect until the applicant and property owner have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of all the conditions of approval. 7. Noncompliance with the plans, provisions, and conditions of approval for CUP 02-016 shall be grounds for suspension and/or revocation of the CUP, which may result in the closing of the martial arts studio. SECTION 4. The decision, findings, and conditions of approval contained in this Resolution reflect the Planning Commission's action of September 10, 2002 to grant Conditional Use Permit No. CUP 02-016, by the following vote: AYES: Commissioners Baderian, Hsu, Wen and Olson NOES: None ABSENT: None ABSTAIN: Commissioner Lucas -3- 1678 e SECTION 5. Butler, Community Development Administrator By: James M. Kasama, Senior Planner SUBJECT: CUP 02-016 for an existing martial arts studio in a 1000 square foot commercial space at 153 N. Santa Anita Avenue. SUMMARY Conditional Use Permit Application No. CUP 02-016 was submitted by Mr. Tommy Chavies for his existing martial arts studio at 153 N. Santa Anita Avenue. The Development Services Department is recommending approval of the Conditional Use Permit. subject to the conditions in this staff report. GENERAL INFORMATION APPLICANT: Mr. Tommy Chavies LOCATION: 153 N. Santa Anita Avenue REQUEST: A Conditional Use Permit for an existing 1000 square foot martial arts studio SITE AREA: 20,550 sq. ft. (0.47 acre) FRONTAGES: 155 feet along N. Santa Anita Avenue Approximately 143 feet along Santa Clara Street EXISTING LAND USE: The site is developed with one-story commercial buildings totaling approximately 8,900 square feet with 21 on-site parking spaces. ZONING: CBD/Central Business District GENERAL PLAN DESIGNATION: Commercial SURROUNDING LAND USES AND ZONING; North: Drive-thru ATMs - zoned C-2 South: Mixed commercial - zoned CBD East: Bank and an 8-story office bldg. - zoned CBD West: Church assembly hall - zoned CBD . BACKGROUND Martial arts studios became an allowed use in the CBD/Central Business District Zone, subject to the Conditional Use Permit process in July 1998 when Ordinance No. 2085 became effective. However, martial arts studios are listed as "Inappropriate Uses in the Project Area" per Arcadia Redevelopment Agency Resolution No. ARA-172. Therefore, in addition to an approved Conditional Use Permit, a martial arts studio in the Central Redevelopment Project Area must be granted an exemption from Resolution No. ARA- 172 by the Redevelopment Agency/City Council. The applicant's martial arts studio is in a CBD Zone and is in ttle Central Redevelopment Project Area. The Redevelopment Agency staff has sent a letter to the applicant reminding him that in addition to a CUP, an exemption from Resolution No. ARA-172 is also required. The applicant began operating his martial arts studio at the subject location approximately five years ago (prior to Ord. No. 2085) without any City approvals. The applicant was infonmed on July 10, 1997 that martial arts studios were not allowed in the CBD Zone, and are prohibited by Arcadia Redevelopment Agency Resolution No. ARA- _ 172. The applicant submitted a letter dated July 16, 1997 to initiate Redevelopment - Agency consideration of having his martial arts studio allowed in the Central Redevelopment Project Area. In the letter the applicant cites as a hardship that he had already committed to a lease and expended over four thousand dollars ($4,000.00) to prepare the commercial space for martial arts instruction. Redevelopment Agency staff informed the applicant that this request would have to be considered in conjunction with a request for the City to determine that martial arts .studios are compatible with the purposes of theCBD Zone. The applicant was referred to the Community Development Division. On August 7, 1997 the applicant submitted a request for the City to determine that martial arts studios, subject to the Conditional Use Permit process, be deemed compatible with the purposes of the CBD Zone. The Planning Commission at its meeting on September 23, 1997 recommended to the City Council that martial arts studios be allowed in the CBD Zone, subject to a Conditional Use Permit. In 1997 the City was studying the CBD Zoning Regulations and the use "Martial arts studios" was being considered for inclusion subject to a Conditional Use Permit. It appears that because of this pending amendment to the CBD Zoning Regulations', the applicant's request for a determination was not considered by the City Council. CUP 02-016 September 10, 2002 Page 2 . . On December 1, 1997, the applicant prepared to submit another request for an exemption from the list of "Inappropriate Uses in the Project Area" per Redevelopment Agency Resolution No. ARA-172. However, the Redevelopment Agency staff has no record of receiving this exemption request. It may have been that this request was not submitted because of the pending amendments to the CBD Zoning Regulations. On December 16, 1997, the City Council directed staff to initiate Text Amendment No. T A 98-001. This text amendment, among other things, added the use "Martial arts studios" to the list, "Uses Subject to a Conditional Use Permit" in the CBD Zone. The text amendment was approved and adopted by Ordinance No. 2085, and became effective in July 1998. However, Resolution No. ARA-172 was not amended and the use, "Martial arts studios" remains on the list "Inappropriate Uses in the Project Area," A written notice, dated August 20, 1997 had informed the applicant that the lack of a business license was a violation of the Arcadia Municipal Code. Because of the applicant's financial investmeht and lease commitment, and the pending Ordinance No. 2085, the Business License Office worked with him. However, it was not until August 27, 2001 that the applicant submitted a business license application. That business license application was denied because of the Conditional Use Permit requirement. The applicant was informed of the denial by letter dated August 30, 2001. The applicant did not respond to this denial notice, and the Business License Office took the following enforcement actions: .. . On May 14, 2002, the applicant was re-notified that a business license and an approved CUP are necessary. A CUP application was included in that letter, and the applicant was given until May 29, 2002 to submit the CUP application. . On June 11, 2002, the Business License Office requested the City Attorney's assistance in bringing the applicant's business into compliance with the business license requirements, and the City Attorney sent a letter. to the applicant. The applicant was given until June 24, 2002 before the initiation of legal action. . On June 17, 2002, the applicant submitted an incomplete CUP application. The application was returned to the applicant with instructions on how to complete the application. . On July 3, 2002, the Business License Office informed the City Attorney that the applicant had not submitted a complete CUP application. . On July 17, 2002, the applicant was notified that the City Attorney was filing a complaint, and that unless a complete CUP application was submitted by July 29, 2002, the matter would go to court on August 6, 2002. . On July 29, 2002, the applicant submitted Conditional Use Permit Application No. CUP 02-016. - CUP 02-016 September 10, 2002 Page 3 PROPOSAL AND ANALYSIS The proposal is to continue operating the existing martial arts studio. The applicant conducts classes for adults, childr~n and families. Attached is a flyer describing the applicant's current class sc;hedule. . Parkinq The subject site has 21 on-site parking spaces, and there is a recorded parking agreement between the owners ofothe subject property and the adjacent church at 21 Morlan Place for shared parking, ingress and egress. This parking agreement provides for 37 of the church's parking spaces to be available for the businesses on the subject property from 7:00 a.m. to 7:00 p.m., Monday through Friday. The adjacent church was approved by CUP 77-27 (City Council Reso. No. 4720) which requires that 20 of the parking spaces behind the businesses at 121-159 N. Santa Anita Avenue (Le. the subject property) be available for the church's use after 7:00 p.m. on weekdays and all day on Sundays. This provision could conflict with the applicant's classes that are held on weekday evenings. CUP 77-27 also granted a modification of 63 spaces in lieu of 95 spaces for both the church and the then existing general office and retail businesses on the subject property. With the exception of the applicant's martial arts studio, the current tenancy of the subject property is a mix of general office and retail uses. Current regulations require .. four (4) spaces per 1,000 gross square feet for general office uses, and five (5) spaces per 1,000 gross square feet for retail uses. And, based on the applicant's floor plan, which shows 480 square feet of training floor area, 14 parking spaces are required for this business (1 space per 35 square feet of instructional area). CUP 02-016 September 10, 2002 Page 4 . . . . The general office and retail uses on the subject property are consistent with the types of uses that occupied the subject property at the time CUP 77-27 and the accompanying parking modification were approved for the church. Therefore, the existing general office and retail uses on the subject property are in compliance with the City's parking requirements. CUP 77-27 provides for the church to have use of almost all of the parking on both the subject property and the church property after 7:00 p.m. on weekdays and all day on Sundays. At that time, this was to accommodate the church's schedule, which based on CUP 77-27 was as follows: . Sundays 8:15 a.m. to 12:30 p.m. and 6:00 p.m. to 9:00 p.m. 7:30 p.m. to 10:00 p.m. . Thursdays and Fridays In the five (5) years that the applicant has been in operation, staff has not received any complaints and is not aware of any parking problems or conflicts between the church and the subject property. The applicant's neighboring businesses are in support of his CUP application and they have signed the attached petition. It appears that the parking agreement is satisfactorily providing for the required parking. Staff recommends, however, that if the church does hold services in the evenings per its approved CUP and a parking problem arises, that the applicant.be required to adjust his schedule to eliminate any conflicts with the church's schedule. Other Requirements The applicant is required to have the premises of his business inspected by Building Services and the Fire Prevention Bureau, and the premises must be brought into compliance with all building and safety measures required for his business as determined to be necessary by the Building Official and Fire Marshall. SPECIAL INFORMATION In addition to the aforementioned petition in support of this application, the applicant provided the attached copies of a letter from the City of San Gabriel Police Department and two newspaper articles citing the benefits of the applicant's business to the surrounding community. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: CUP 02-016 September 10, 2002 Page 5 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfClre or injurious to the property or improvements in such zone or . vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for-the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic.generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. CEQA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substant\aladverse change in any of the physical conditions within the area affected by the project including land, air. :\ water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic '. significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDA rlON The Development Services Department recommends approval of Conditional Use Permit No. CUP 02-016, subject to the folloWing conditions: 1. The subject martial arts studio shall be operated in a manner consistent with the plans and do.cuments submitted for Conditional Use Permit Application No. CUP 02-016 to the satisfaction of the Community Development Administrator. 2. PLANNING COMMISSION ACTION Approval The Planning Commission should move to adopt the Negative Declaration, state the supporting findings, and direct staff to prepare a resolution incorporating the Commission's decision, specific findings and any conditions of approval. Denial If the Planning Commission intends to deny this Conditional Use Permit-application, the Commission should move for denial and direct staff to prepare a resolution incorporating the Commission's decision and specific findings.
