RESOLUTION NO. 1676
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO,
CUP 02-013 AND CONDITIONALLY APPROVING ARCHITECTURAL
DESIGN REVIEW NO, ADR 02-032 FOR A WIRELESS
COMMUNICATION FACILITY WITH A 50-FOOT TALL ANTENNA
STRUCTURE CAMOUFLAGED AS A PINE TREE AT 21 WEST SANTA,
CLARA STREET.
WHEREAS, on June 10, 2002, a Conditional Use Permit application was filed by
Cingular Wireless for a wireless communication facility with a 50-foot tall antenna
structure camouflaged as a pine tree; Development Services Department Case Nos.
CUP 02-013 and ADR 02-032, at 21 West Santa Clara Street, more particularly
described in the attached Exhibit "A"; and
WHEREAS, a, public hearing was held on July 23, 2002 at which time all
interested persons were given full opportunity to be heard and to present evidence,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the,attached report dated July 23, 2002 are true and correct,
SECTION 2, This Commission finds:
1, That the granting of the Conditional Use Permit will not be detrimental to
the public health or welfare, nor injurious to the property or improvements in the zone
or vicinity,
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3, That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, wails, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses in
the neighborhood,
4, That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use,

5. That the subject property is designated for commercial use in the General
Plan, that the proposed use is consistent with that designation, and that the granting of
the Conditional Use Permit will not adversely affect the comprehensive general plan.
6. That the evaluation of the environmental impacts as set forth in the Initial
Study is appropriate and that the project will have no significant effect upon the
environment within the meaning of the California Environmental Quality Act of 1970,
and, when considering the project as a whole, there was no evidence before the City
that the proposed project would have any potentially adverse effect on wildlife
resources or the habitat upon which wildlife depends, and therefore, a Negative
Declaration was adopted.
SECTION 3, That for the foregoing reasons this Commission grants
Conditic:mal Use Permit No, CUP 02-013 and conditionally approves Architectural
Design Review No, ADR 02-032 for a wireless communication facility with a 50-foot tall
antenna structure camouflaged as a pine tree at 21 West Santa Clara Street, subject to
the following conditions:
1. The wireless communication facility and the site shall be improved,
operated and maintained in manners that are consistent with the proposal and plans
submitted and conditionally approved for CUP 02-013 and/or ADR 02-032, including
compliance with all comments, recommendations, and requirements received from the
various City Departments, subject to the satisfaction of the Directors of said
Departments,
2. The equipment cabinets shall be painted to match the block wall, and all
the colors, materials and amounts of simulated foliage for the monopine shall be
subject to the approval of the Community Development Administrator,
3. The wireless communication facility shall comply with all development
requirements and policies determined to be necessary by the Building Official, City
Engineer, Community Development Administrator, Fire Marshall, Public Works
Services Director, and any service districts and utility providers that will serve the
proposed wireless communication facility,

4, The applicant shall defend, indemnify, and hold harmless the City of
Arcadia and its officers, employees, and agents from and against any claim, action, or
proceeding agaihst the City of Arcadia, its officers, employees or agents to attack, set
aside, void, or annul any approval or condition of approval of the City of Arcadia
concerning this project and/or land use decision, including but not limited to any
approval or condition of approval of the City Council, Planning Commission, or City
Staff, which action is brought within the time period provided for in Government Code
Section 66499.370t other provision of law applicable to this project or decision, The
City shall promptly notify the applicant of any claim, action, or proceeding concerning
the project and/or land use decision and the City shall cooperate fully in the defense of
the matter, The City reserves the right, at its own option, to choose its own attorney to
represent the City, its officers, employees, and agents in the defense of the matter.
5. Noncompliance with the plans, provisions, requirements of various City
departments, and the conditions of approval for CUP 02-013 and/or ADR 02-032 shall
be grounds for immediate suspension and/or revocation of any approvals, which shall
result in suspension of construction and/or removal of those improvements that are the
subjects of this Conditional Use Permit.
6, Approval of CUP 02-013 and/or ADR 02-032 shall not take effect until the
property owner, applicant and applicant's agent have executed and filed the
Acceptance Form available from the Development Services Department to indicate
awareness and acceptance of the conditions of approval, and all conditions of approval
shall be satisfied prior to final inspection sign-offs for the wireless communication
faci lity,
SECTION 4. The decision, findings, and conditions of approval contained
in this Resolution reflect the Planning Commission's action of July 23, 2002 to grant
Conditional Use Permit No, CUP 02-013; conditionally approve Architectural Design
Review No. ADR 02-032, and adopt Resolution No, 1676, The Secretary shall certify
to the adoption of this Resolution and shall cause a copy to be forwarded to the City
Council of the City of Arcadia,

SUBJECT: CUP 02-013 and ADR 02-032 for a wireless communication facility with
a 50-foot tall antenna structure camouflaged as a pine tree at
21 W. Santa Clara Street.
SUMMARY
Conditional Use Permit Application No, CUP 02-013 and Architectural Design
Review No, ADR 02-032 were submitted by Cingular Wireless to construct a
wireless communication facility consisting of four (4) ground mounted equipment
cabinets and a 50-foot tall antenna structure at 21 W, Santa Clara Street. The
Development Services Department is recommending approval of the proposed
facility subject to the conditions in this staff report,
GENERAL INFORMATION
APPLICANT: Cingular Wireless
LOCATION: 21 W. Santa Clara Street
REQUEST: A Conditional Use Permit and Architectural Design Review for a
wireless communication facility with a 50-foot tall antenna structure
camouflaged as a pine tree.
SITE AREA: 39,200 sq, ft. (0,89 acre)
FRONTAGES: Approximately 190 feet along W. Santa Clara Street
Approximately 220 feet along Rolyn Place

EXISTING LAND USE:
The site is developed with a one-story, 12,300 square-foot
telephone operations building with 45 on-site parking spaces.
ZONING CLASSIFICATION: C-2/General Commercial. ,

PROPOSAL AND ANALYSIS
Communications equipment facilities are permitted in any zone with a Conditional
Use Permit. The proposed location is a 320 square foot area at the northwest corner
of the parking lot of a telephone operations building, A wrought-iron fence and block
wall enclose the parking lot. The location for the antenna structure is adjacent to a
gated driveway off of Rolyn Place and is currently used to store two trash bins. The
trash bins will be relocated to a new trash enclosure toward the middle of the parking
lot. This will necessitate the elimination of two parking spaces.
The locating of cellular antennas depends primarily 01'1 technical criteria such as
system and network linkages, and utility accessibility, There are, however, other
considerations, which include land use compatibility, zoning regulations, site
availability, and maintenance and construction costs, The applicant has determined
that this proposal best serves the technical needs of their system, as well as
satisfying the other considerations,
Architectural Desian Review
Concurrent with the consideration of the Conditional Use Permit, the Planning
Commission may approve, conditionally approve, or disapprove the applicant's
architectural design concept plans,
In this case, the purpose of the Architectural Design Review of the antenna structure
is to have it blend in with the area around it as much as possible, There will be four
5'-3" tall equipment cabinets mounted on a concrete slab, These cabinets are to be
painted to match the existing block wall, There will be a total of 12 panel antennas
mounted in three arrays of four antennas each, The arrays will be mounted on a
monopole at a maximum height ,of 50 feet. The pole will be approximately 55 feet tall

and painted dark brown and coated with a simulated bark material. The antenna
arrays will be painted dark brown and dark green, Simulated pine branches and
needles will be attached to the pole to camouflage the pole and antennas, The
overall height of the "monopine" is not to exceed 50 feet A monopine was selected
for this location because there are several tall pine trees in the area,
Modifications
A Modification is necessary to accommodate the 50-foot height of the antennas, and
the overall 50-foot height of the monopine, The 50-foot height for the antennas is
necessary to maximize the level-of-service of this facility, and the overall 50-foot
height for the monopihe is to camouflage of the antennas, The C-2 zone allows a
maximum building height of 40 feet with an additional 10 feet allowed for accessory
structural items, and requires that SUCA items be adequately screened.
Camouflaging the antenna structure as a pine tree is a good way to screen it and the
additional height is appropriate for this purpose,
A Modification is also necessary for 43 parking spaces in lieu of 50 required for the
general office building. This is necessary because the new trash enclosure will
eliminate two parking spaces, The existing 12,300 square foot building would need
50 parking spaces if it were used for general offices, but for telephone operation
purposes, the proposed 43 spaces is adequate.
e Other Reauirements
The applicant is required to comply with all development requirements and policies
determined to be r:1ecessary by the Building Official, City Engineer, Community
Development Administrator, Fire Marshall, Public Works Services Director, and any
service districts and utility providers that will serve the proposed wireless
communication facility.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1, 'That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such
zone or vicinity,
2, That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized,

,3, That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,

5. That the granting of such Conditional Use permit will not adversely affect the
comprehensive General Plan,
CEQA
Pursuant to the provIsions of the California Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the proposed
project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance, When considering the record as a whole, there
is no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends, Therefore, a
Negative Declaration has been prepared for this project
e RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 02-013 and Architectural Design Review No, ADR 02-032, subject
to the following conditions:
1. The wireless communication facility and the site shall be improved, operated
and maintained in manners that are consistent with the proposal and plans
submitted and conditionally approved' for CUP 02-013 and/or ADR 02-032,
including compliance with all comments, recommendations, and requirements
received from the various City Departments, subject to the satisfaction of the

communication facility with a 50-foot tall antenna structure camouflaged as a
pine tree at 21 W. Santa Clara Street.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application
and/or the Architectural Design Review, the Commission should move for denial and
direct staff to prepare a resolution incorporating the Commission's decision and
specific findings,

The site is at the northeast corner of the intersection of W, Santa Clara Street and
Rolyn Place. The wireless communication facility will be in the rear parking lot of a
commercial/industrial building, To the north behind the site is the rear portion of a
restaurant and a parking lot. To the east is a drive-thru automatic bank teller
facility, To the south across Santa Clara Street is the rear of a warehouse that is
being used as a religious assembly hall, To the west is an office building that is
currently vacant, for which an application for an educational use is perJding; and a
maintenance yard for the school district.

The Development Services Department, and Public Works Services Department will
review the construction plans, and any off-site improvement plans for compliance

EVALUATION OF ENVIRONMENTAL IMPACTS:

Introduction
Clngular Wireless Is a registered public utility, licensed and regulated by the California Public
Utilities COmmission (CPUC) and the Federal Communications COmmission (FCC). As a public
utility, angular Wireless Is licensed by the FCC to provide personal communication services
throughout the County of Los Angeles area.
Efforts are currently underway in Los Angeles COunty to establish the required infrastructure.
Cingular Wireless has retained the services of The COnsulting Group, Inc., (TCG) to facilitate the
land use entitlement process. TCG is currently seeking approval of an Architectural Design ,
ReVieW/COnditional Use Permit for the establishment, use, and maintenance of a wireless
telecommunications facility at 21 W. Santa Clara Street, Arcadia, Callfomia. The project site Is
proposed to be located at the rear of the Pacific Bell Switching Facility on a proposed
freestanding palm at a height of 60'-0#.

highly mobile communications devices Including: portable telephones, computers and Personal
Digital Assistants (PDAs). Pes will provide voice, e-mail and Internet access capabilities for
customer's communications needs virtually anywhere and at any time.

The PCS network being developed by Clngular Wireless differs from typiC(l1 cellular networks in
that it uses state of the art digital technology Instead of analog systems, which have been In use
since the early 1980's. The benefits include call privacy and security, Improved voice quality, and
an expanded menu of affordable products and services for personal and professional
communications needs. The Cingular Wireless network will eventually feature a locator device
that will connect 911 calls to local police and fire .departments. In the event of an emergency,
specially equipped emergency vehicles will be able to identify a customer's location once a call is
received.
Project Overview
Clngular Wireless is propoSing to Install a total of twelve (12) antennae, divided equally Into three
(3) sectors oriented 0., 120., and 240. respectively, will be mounted on a proposed freestanding
monoplne and the equipment area will be located directly below the proposed structure. The
antennas measure a maximum of 5'-0" high x 9.0" wide x 4.0" deep. Furthennore, the
proposed facility will be compatible with the surrounding environment due to the existence of
numerous live pine trees along the front of the property. The project is further described on the
attached plans.
Operational Overview
The proposed communications facility wlJl transmit at a frequency range of between
1850 and 1990 MHz. A typical PCS site operates on standard telephone lines and commercial
electrical power. When operational, the transmitted signals from the site will consist of non.
Ionizing waves generated at less than 1 uW/an2, which is significantly lower than the maximum
allowable publiC exposure of 1000 uW/cm2 as set by the American National Standards Institute
(ANSI) and Institute of Electrical and Electronic Engineers (IEEE). The current ANSI/IEEE
standards for protection against radiofrequency/microwave (RF/MW) fields are set at 50 times
below a level that scientist believe may pose a health risk to human populations.
Once constructed and operational, the communications facility will provide 24-hour service to
customers seven (7) days a week. Apart from Initial construction activity, the facility will be
serviced by a Cinguiar Wireless technician on a periodic basis. It is reasonable to expect that
routine maintenance/Inspection of the facility will occur once a month during nonnal working
hours. Beyond this intennlttent service, angular Wireless requires 24-hour access to the facility
to ensure that technical support is Immediately available if and when warranted.
Overview of Coverage Objective(s)
The proposed facility to provide an Integral link in angular Wireless proposed Los County
network and designed to provide coverage along the Santa Anita, Huntington Drive, and
surrounding area. At present, angular Wireless is experiencing coverage and capacity problems
as well as in-building coverage within the residential/commercial community surrounding this
area. The proposed site will provide wireless telecommunications services to Clngular Wireless
customers who live, work and travel throughout the City of Arcadia and surrounding area.
Overview of Site Design/Location Criteria
The network of Clngular Wireless cell sites throughout the region Is "Iocationally dependent,'
meaning that there is a necessary and logical Interrelationship between each proposed site.
Eliminating or relocating a single cell site can lead to gaps in the system and prohibit Cingular
Wireless from providing uninterrupted or reliable service to customers in a defined coverage area.

Further, the elimination or relocation of a cell site will most often have a ~domlno. effect on other
cell site locations and necessitate Significant design changes or modifications to the network.
In Identifying the proposed PCS location, Clngular Wireless' network deployment personnel have
selected a site that not only meets the technical objectives of RF engineering, but concurrently
provides the best sitting option with regard to other key criteria that Include, but are not limited
to: accessibility, utility connections, zoning compatibility, liability and risk assessment, site
acquisition, maintenance and construction costs.
Compatibility with Other Site Development Standards and General Plan
The location, size, design, and operating characteristics of the proposed facility will not create
unusual noise, traffic or other conditions or situations that may be objectionable, detrimental or
Incompatible with the surrounding land uses. The proposed use is consistent with this finding in
that:
1. The proposed equipment associated with the telecommunication structure operates
quietly or virtually noise free.
2. The equipment does not emit fumes, smoke, or odors that could be considered
objectionable.
3. The telecommunications facility Is unmanned and only requires periodic maintenance,
which equates to approximately one trip per month. The proposed communication
facility will not result in conditions or circumstances contrary to the public health,
safety and the general welfare. The proposed use is consistent with this finding in
that:
1. The proposed communications facility will operate In full compliance with the U.S. standards
for radiofrequency emissions as published by the American National Standards Institute
(ANSI). The ANSI was developed by the committee composed of 125 scientists from
universities, non-profit laboratories and Federal Health Laboratories (FDA, NIOSH, EPA): 13:
are from the Industry and consultants to the industry: and 15% are from the military and
other federal agencies. In 1992, the ANSI established, as a publiC safety standard, a
maximum exposure level to radlofrequency emissions of 1000 mlcrowatts per centimeter
squared (1,000 uW/an2). The typical exposure level of a PCS facility Is less than 1
mlcrowatt per centimeter squared (<1 uW lan2).
2. The radlofrequency emissions emitted by the proposed Clngular Wireless facility will fall within
the portion of the electromagnetic spectrum which transmits non-Ionizing electromagnetic
emissions, at the low levels associated with this type of wireless technology, are not harmful
to living cells. Among the items which result In non-Ionizing electromagnetic emissions are
radios, television broadcasts, CB radios, microwave ovens, and a variety of common security
systems. Conversely, items which transmit Ionizing electromagnetic emissions Include
ultraviolet light, medical x-rays and gamma rays.
3. Data currently available on the effects of electromagnetic transmission on publiC health
Indicate that there Is no likelihood of negative Impacts to public health and safety.

Letter of Justification
1. The proposed conditiDnal use will not be detrimental to the public health, safety
or welfare, nor be materially injurious to property Dr Improvements in the vidnlty;
Unlike other land uses, which can be spatially determined through the General Plan or other
land use plans, the location of wireless telecommunications facilities are based on technical
requirements which Include service area, geographical elevations, alignment with neighboring
sites and customer demand components. Placement within the urban geography Is
dependent on these requirements. Accordingly, wireless telecommunication facilities have
been located adjacent to and within all major land use categories Including residential,
commercial, industrial, open space, etc. proving to be compatible In all locations. The
proposed fadlity at the subject location will not be detrimental to the character of
development In the neighborhood for the following reasons. It will be unstaffed, have no
impact on circulation systems, and generate no noise, odor, smoke, or any other adverse
Impacts to adjacent land uses. The proposed fadllty will allow lDmmuters and residents
within the coverage area wireless access to the rapidly expanding communications
Infrastructure by providing voice and data transmission services not currently available. The
Installation of antenna sectors and transmission equipment will not result In any material
changes to the character of the local community. This proposed wireless telecommunications
facility will operate In full compliance with all state and federal regulations induding the
Telecommunications Act of 1996.
2. The proposed conditional use is compatible with existing and future uses to the
extent those are known, and will comply With each of the applicable provisions of
the ZOning Ordinance...;
Since their Introduction, wireless telecommunications systems have proven to be an
Invaluable communications tool In the event of emergencies (traffic accidents, fires, etc.) and
natural disasters (earthquakes, floods, etc.) where normal land line communications are
often disrupted, overlooked, or inaccessible during and after an event has occurred. This
service and similar technology are utilized by numerous governmental and quasi-
governmental agendes that provide emergency service. Wireless telecommunications
systems, including cellular telephones, have also proven to be Invaluable tools In business
communications and everyday personal use. In this sense, wireless telecommunications
system networks are desirable In the interest of public convenience, health, safety. and
welfare, and thus are proper in relation to the development of the community. The proposed
project will/does not Incur automobile use nor pedestrian access.
