CUP 01-028 FOR A 700 SQUARE FOOT COFFEE HOUSE AT 203 S. FIRST AVENUE. WHEREAS, on October 1, 2001, an application was filed by Ms. Helen Wang and Mr. Matt Vantuch for a coffee house with indoor and outdoor seating; Development Services Department Case No. CUP 01-028, at 203 S. First Avenue, more particularly described as follows: Lots 18, 19 & 20 in Block 66 of a part ofthe Arcadia Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 15, Pages 89 & 90 of Miscellaneous Records, in the Office of the County Recorder of Said County. WHEREAS, a public hearing was held on November 13, 2001 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF TI:iE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report dated November 13, 2001 is true and correct. SECTION 2. This Commission finds: 1. That the granting of the Conditional Use Permit will not be detrimental to the public health or welfare, nor injurious to the property or improvements in the zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, - .' e landscap(ng and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the subject property is designated for commercial use in the General Plan, that the proposed use is consistent with that designation, and that the granting of the Conditional Use Permit will not adversely affect the comprehensive general plan. 6. That the evaluation of the environmental impacts as set forth in the initial study are appropriate and that the project Will have no significant effect upon the environment within the meaning of the California Environmental Quality Act of 1970, and, when considering the project as a whole, there was no evidence before the City that the proposed project would have any potentially adverse effect on wildlife resources or the habitat upon which wildlife depends, and therefore, a Negative Declaration was approved. SECTION 3. That for the foregoing reasons this Commission grants Conditional Use Permit No. CUP 01-028 for a 700 square foot coffee house in the retail building at 203 S. First Avenue, subject to the following conditions: 1. The use approved by CUP 01-028 is limited to a 700 square foot coffee house with tables and chairs that shall be arranged in compliance with the Building and Fire Codes. The coffee house shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 01-028. This approval does not include the serving of any meals, nor any entertainment activities. Such activities may be considered an expansion of the coffee house use, which must be approved by the Planning Commission through an additional application and noticed public hearing. 2. The outdoor seating and tables shall be limited to the private property area in front of the building along First Avenue and shall comply with the City's Incidental Outdoor Dining Regulations, which allows seating for 12 patrons or less. -2- 1663 '. ~ . e " 3. This approval of CUP 01-028 does not include any use of the rear patio area. Use of the patio area may be considered an expansion oflhe coffee house, which must be approved by the Planning Commission through an additional application and noticed public hearing. 4. The hours of operation are limited to 6:00 a.m. to 10:00 p.m. on Sundays through Thursdays, and 6:00 a.m. to 12:00 midnight on Fridays and Saturdays. 5. The back door shall remain closed after 9:00 p.m, to reduce the potential for nuisances to the nearby residents. 6. This approval of CUP 01-028 includes a parking modification only for the 700 square foot coffee house and is not an approval of a general reduction of the parking requirements for the retail building or the site. 7. The rear parking area shall be striped in accordance with the City's parking regulations. 8. A trash enclosure shall be provided in accordance with the zoning regulations. 9. All conditions of approval shall be complied with prior to opening of the coffee house, Noncompliance with the plans, provisions and conditions of approval for CUP 01-028 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the coffee house. 10. Approval of CUP 01-028 shall not take effect until the property owner(s), and applicants have executed and filed the Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. SECTION 4. The decision, findings, and conditions of approval contained in this Resolution reflect the Planning Commission's action of November 13, 2001. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -3- 1663 ~ . e .'. SUMMARY I This Conditional Use Permit application was submitted by Ms. Helen Wang and Mr. Matt Vantuch to operate a 700 square foot coffee house with indoor seating for approximately 20 people and incidental outdoor seating at 203 S. First Avenue. The Development Services Department is recommending approval of this application, subject to the conditions listed in this report. GENERAL INFORMATION APPLICANTS: Ms. Helen Wang and Mr. Matt Vantuch LOCATION: REQUEST: 203 S. First Avenue SITE AREA: A Conditional Use Permit with a parking modification for a coffee house with indoor and outdoor seating. The proposed business hours are 6:00 a.m. to 10:00 p.m. on Monday through Thursday, and 6:00 a.m. to 12:00 midnight on Fridays and Saturdays. 22,670 square feet (0.52 acre) FRONTAGES: 160 feet along S. First Avenue 142 feet along Bonita Street e EXISTING LAND USE & ZONING: The site is located in the half-block on the west side of First Avenue that extends from Bonita Street, south to an alley. It is developed with five commercial buildings totaling approximately 10,075 square feet with an open parking area at the rear. The property is zoned CaD - Central Business District. ~ I e SURROUNDING LAND USES & ZONING: North: Retail - zoned CaD South: Mixed commercial - zoned CaD East: Mixed commercial - zoned CaD West: Ten-unit apartment building - zoned PR-3 GENERAL PLAN DESIGNATION: Mixed Use - Commercial/Multiple-Family PROPOSAL AND ANALYSIS , The proposal is to use a 700 square foot retail building for a coffee house with seating for approximately 20 people indoors and incidental outdoor seating (maximum 12 seats alloWed) in front of the building. Use of a 1,672 square foot patio area behind the builc:ting is not included in this application. The proposed hours of operation are 6:00 a.m. to 10:00 p.m. Monday through Thursday, and 6:00 a.m. to 12:00 midnight on Fridays and Saturdays. A coffee house requires a Conditional Use Permit, as do the hours of operation proposed for Fridays and Saturdays because they exceed 16 hours and the site of this coffee house is within 150 feet of residentially zoned property. The adjacent property to the west is zoned PR-3, and is improved with a ten-unit apartment building. Parkina A 700 square foot coffee house should have seven on-site parking spaces. The subject building, however, is one of five retail buildings on the site, and all of them are deficient in parking. A Modification (Me 01-023) was approved for this medical use in lieu of a retail use. CUP 01-028 NOvember 13,2001 Page 2 - I e The buildings front directly on First Avenue or Bonita Street, and staff has observed that customers do not use the parking area behind the buildings. This may be because the rear parking area is not striped, and is difficult to use. Staff estimates that 20 parking spaces could be provided in this rear parking area. These buildings are allowed to be occupied by retail uses, and if 20 on-site parking spaces were provided, there would be a deficiency of 31 spaces. The 900 square foot medical office, which was granted a parking modification (MC 01-023) increases this deficiency to 32 spaces, and the proposed coffee house requires an additional three spaces, which would bring the deficiency to 35 spaces. A parking survey was not requested as part of this application. The applicants explained that because the subject building and the building next door are vacant, there are always many parking spaces available on First Avenue and Bonita Street, near the proposed coffee house. Staff has visited the site several times and confirmed this situation. Because, a coffee house is a desirable business in this area, and is likely to promote pedestrian activity, it is staffs opinion that a parking deficiency should not be a reason to deny the proposed coffee house. However, the rear parking area should be striped in accordance with the City standards. Hours of Ooeration The proposed hours of operation are 6:00 a.m. to 10:00 p.m. Monday through Thursday, and 6:00 a.m. to 12:00 midnight on Fridays and Saturdays. Businesses located within 150 feet of residentially zoned property that are open for more than a total of 16 hours per day and/or are open between 12:00 midnight and 6:00 a.m. require a Conditional Use Permit. The reason for these limits is to prevent such businesses from being a nuisance to residents. The proposed hours of operation for Monday through Thursday are within the aforementioned limits. However, the hours proposed for Fridays and Saturdays exceed a total of-16 hours, although they are not between 12:00 midnight and 6:00 a.m. Since this application does not include the use of the patio area behind the building, the operation of this coffee house should not be a source of any nuisances to the nearby residents. Trash Bin and Enclosure There are three trash bins presently at this site. One trash bin is provided behind the subject building, and the other two are behind the clothing store and the party supplies shop. The one behind the subject building is usually located against the patio wall. It is staffs opinion that a trash enclosure should be provided for any food service use. Construction of a trash enclosure will avoid an unsightly and unsanitary accumulation of trash. . CUP 01-028 November 13, 2001 Page 3 - . e Staff recommends that a trash enclosure be provided behind the coffee house in accordance with the zoning regulations. The enclosure should not interfere with any parking spaCes, and should be large enough to contain the trash bin and provide ample space for the storing of recyclables. Code ReQuirements All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, parking and site design shall be complied with to the satisfaction of the Building Official, Community Development Administrator, Fire Marshall, and Public Works Services Director, and are to be determined by submitting fully detailed tenant improvement plans for, plan check review and approval. The Los Angeles County Health Department must also approve the tenant improvement plans before building permits will be issued. Any exterior improvements, such as any new signs, sign face changes, awnings and trash enclosures shall be subject to architectural design review and approval by the Community Development Administrator. Fire safety and occupancy limits shall be provided to the satisfaction of the Fire Marshall, and shall include at a minimum the following: . Minimum 6-inch high address numbers shall be provided on the front of the building facing First Avenue. · Commercial cooking operations shall be protected by a hood-and-duct system. · A Knox B.ox shall be provided for access to any restricted areas. . Approved lighted exit signs shall be provided above all exits. . A Class 'K' fire extinguisher shall be provided for the cooking area and a Class '2A: 1 OBC' fire extinguisher shall be provided at a location to be determined by the Fire Inspector. . A floor and seating plan approved by the Building Official and Fire Marshall shall be posted in a conspicuous location. An Industrial Waste Discharge Permit shall be obtained from the Public Works Services Department prior to opening of' the coffee house, and the tenant improvements shall include the Best Management Practices. (BMPs) of the Minimum Project Requirements for reducing the level of pollutants in storm water runoff. CEQA Pursuant to the prOVISions of the California Environmental Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial CUP 01-028 November 13, 2001 Page ,4 - . e adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise-and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Development Services Department recommends approval of CUP 01-028 subject to the following conditions: 1. The use approved by CUP 01-028 is limited to a 700 square foot coffee house with tables and chairs that shall be arranged in compliance with the BUilding and Fire Codes. The coffee house shall be operated and maintained in a manner that is consistent with the proposal and plans submitted'and approved for CUP 01-028. First Avenue. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should move for denial and direct staff to prepare a resolution incorporating the Commission's decision and specific; findings. Surrounding land uses and setting: (Briefly describe the project's surroundings.) The subject property is an 800 square foot commercial building with a 1,672 square foot open patio area at the rear. The property is on a strip commercial street that prOVides for neighborhood services. The street has one lane of traffic in each direction with angled parking against the curbs. There is a small parking area at the rear of the property. The surrounding area is zoned for and developed with multiple-family residences. A middle school is one block to the south. 10. The tenant improvements for the coffee shop will also be reviewed by the Los Angeles County Health Department for compliance with local health codes.
