CUP 01-026 FOR A PRE-SCHOOL AND DAYCARE CENTER AT 657 W. DUARTE ROAD. WHEREAS, on August 27, 2001, an application was filed by Carlos and Elizabeth Andrino for a pre-school and daycare center; Development Services Department Case No. CUP 01-026, at 657 W. Duarte Road, more particularly described as follows: The westerly 75.17 feet of the easterly 150.34 feet of Tract No. 3430, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Map Book 42, Page 32 in the Office of the County Recorder of Said County. WHEREAS, a public hearing was held on November 27,2001, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report dated November 27, 2001 is true and correct. SECTION 2. This Commission finds: A. That the granting of this Conditional Use Permit would be detrimental to the public health and welfare and injurious to the property and improvements in such zone or vicinity. 1. The proposed parking and loading facilities are inadequate and unsafe, particularly in the case where small children are to be dropped-off and picked-up in a parking area. 2. The potential traffic that could be generated by the proposed use would result in an unacceptable Level Of Service (LOS) on Duarte Road, at the intersection of Duarte Road and Baldwin Avenue, and on other surrounding streets and intersections, which would have negative effects upon the properties, businesses and residents that must use those public rights-of-way. - . ~ .\ ~. B. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized, however, the applicants did not satisfy the Special Regulations for the requested conditional use as specified in Sections 9275.3 et seq. of the Arcadia Municipal Code. 1. The required written proof from the State Department of Social Services verifying its approval of the site, the use of structures on the site and maximum number of children for which a license will be issued, had not been provided. 2. The applicants explained that it was anticipated that up to a maximum of 125 children would be accommodated at the proposed pre-school and daycare center throughout the day, and that they intended to provide after school programs for the children of the local elementary schools. However, it was not specified how many children of what ages, Would be accommodated at the pre-school and daycare center at what times of day, and how the elementary school students would be transported to the proposed facility. 3. The proposed site plan does not provide adequate off-street parking, nor does it provide adequate facilities for the safe loading and unloading of children. C. That the site for the proposed use is not adequate in size and shape to accommodate the proposed use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 1. The applicants' proposal to provide parking spaces for the pre-school and daycare employees by leasing eight parking spaces on the upper parking level of the Burlington Coats Factory shopping center at 1201 S. Baldwin Avenue is not acceptable for the following reasons: a. These parking spaces are at least 700 feet away and would necessitate that the employees cross both Duarte Road and Baldwin Avenue. b. The proposed off-site parking location exceeds the 500-foot maximum distance allowed by Arcadia Municipal Code Section 9269.6 for the use of off-site parking spaces to satisfy the parking requirement of a proposed use. c. The location of parking spaces is not included in the regulations authorized to be modified by Arcadia Municipal Code Section 9292.1.4. -2- 1660 - . ~ 2. That the proposed layout will not function adequately because of the following situations: a. It relies on a single 25-foot Wide driveway for both ingress and egress, which is less than 300 feet from the intersection of Duarte Road and Baldwin Avenue. This intersection has a Level Of Service (LOS) of 'D' and is one of the most congested intersections in the City, and the delays at that intersection often cause traffic to backup beyond the driveway on the subject property, which would block vehicles from entering and exiting the subject property. b. The proposed layout necessitates the use of parking spaces for the dropping-off and picking-up of children, which is both unsafe and inefficient. c. It will require that vehicles perform a multi-point turn to exit the site, which requires that arriving vehicles wait for the exiting vehicles to clear the parking area. Such delays could result in gridlock in the parking area, which could potentially back out onto Duarte Road and add to the already significant traffic delays and hazards. D. That the site abuts a street that is not adequate in width to carry the kind of traffic that would be generated by the proposed use. The proposed use could generate approximately 100 vehicle trips during both the morning and evening rush hours, which would result in further diminishing the Levels Of Service (LOS) on Duarte Road, at the intersection of Duarte Road and Baldwin Avenue, and on other surrounding streets and intersections. E. That the evaluation of the environmental impacts as set forth in the initial study is appropriate and that the project could have less than a significant effect upon the environment within the meaning of the California Environmental Quality Act of 1970, if appropriate mitigation measures were incorporated, but none were provided, and therefore, a Mitigated Negative Declaration could not be approved. SECTION 3. That for the foregoihg reasons this Commission denies Conditional Use Permit Application No. CUP 01-026 for a pre-school and daycare center at 657 W. Duarte Road. SECTION 4. The decision and findings contained in this Resolution reflect the Planning Commission's action of November 27, 2001 to deny Conditional Use Permit Application No. CUP 01-026, by the following vote: -3- 1660 - e- ~, AYES: Commissioners Baderian, Huang, Murphy and Olson NOES: None ABSENT: Commissioner Kalemkiarian SECTION 5. Duarte Road. SUMMARY .' This Conditional Use Permit application was submitted by Carlos and Elizabeth Andrino to operate a pre-school and daycare center for up to 125 children, ages 2 to 12 years old at 657 W. Duarte Road.' The Development Services Department is recommending denial of application no. CUP 01-026 because of inadequate parking and traffic facilities. GENERAL INFORMATION APPLICANTS: Carlos and Elizabeth Andrino LOCATION: 657 W. Duarte Road REQUEST: A Conditional Use Permit to allow a pre-school and daycare center for up to 125 children, ages 2 to 12 years old in a 7,000 square foot commercial building. The proposed hours of operation are from 6:30 a.m. to 6:30 p.m., Monday through Friday. SITE AREA: 18,672 sq. ft. (0.43 acre) FRONTAGE: Approximately 76 feet along W. Duarte Road ~ , EXISTING LAND USE & ZONING: The site is developed with a one-story, 7,000 square foot commercial building. There are 26 substandard on-site parking spaces. The property is zoned C-21General Commercial. SURROUNDING LAND USES & ZONING: Nor t h : Offices and retail - zoned C-2 South: Bank and offices - zoned C-2 E a s t : Retail - zoned C-2 W es t : Parking lot - zoned C-2 -- GENERAL PLAN DESIGNATION: Commercial BACKGROUND This case was initially scheduled to be heard at the October 9,. 2001 Planning Commission meeting. Staff's review identified numerous deficiencies and problems with the proposed site plan. The applicants requested a continuance to address staff's concerns. The Planning Commission continued the hearing on this application to the November 27,2001 meeting. PROPOSAL AND ANALYSIS The proposal is to operate a pre-school and daycare center in a 7,000 square foot commercial building at 657 W. Duarte Road. The children will be ages 2 years . through 12 years old, and the applicants anticipate that the State will approve their proposal for a total of up to 125 children. The proposed hours of operation are from 6:30a.m. to 6:30 p.m., Monday through Friday. The .interior of the. building will be remodeled to provide four large classroom/play areas, two offices with a lobby and waiting area, a computer learning room, and a pantrylkitchen room. There are al.so several restroom facilities and two large storage rooms. A 1,825 square foot outdoor play area is proposed to be provided adjacent to the rear ofthe building. The parking area will be re-striped to accommodate this outdoor play area, and the parallel parking spaces along the driveway will be eliminated to enable two-way traffic in the driveway. The new site configuration will provide 12 on-site parking spaces (the #8 was skipped on the proposed plot plan) and one parking space, #7 is designated for loading and unloading. The applicants also have an agreement with the owner of the Burlington Coats Factory shopping center, to lease eight parking spaces on the upper parking level for the pre-school and daycare employees. This would provide a total of 20 parking spaces. The application is requesting a daycare center with infant, pre-school, and before and after school care programs for approximately 125 children with approximately 12 adult employees. Based on this information, it must be assumed for the purposes of ~ CUP 01-026 November 27, 2001 Page 2 - . ~ analyzing traffic impacts, that all 125 children could be dropped-off and then picked up during the respective morning and evening commute hours. The impacts of such a scenario on Duarte Road would be unacceptable. The City's Traffic Engineer has provided research data that indicates that daycare centers generate 0.80 vehicle trips per child during rush hours (see the attached memorandum dated 11114101). This equals 100 vehicles arriving during the morning rush hours, and 100 vehicles arriving during the evening rush hours. . The applicants have explained that they anticipate their proposed facilities will accommodate up to a maximum of 125 children throuchout the day, and that they intend to provide after school programs for the children of the local elementary schools. However, it has not been specified how many children of what ages, will be at the facility at what times of the day, and it is not clear how the elementary school students will be transported from their schools to the applicants' facility. Staff is also concerned by the proposed plot plan. This layout is in response to the deficiencies and problems that staff identified prior to the October 9th meeting (e.g.; lack of a safe drop-off & pick-up area, substandard parking spaces, the need for a trash enclosure). Staff, however, still feels that the proposed layout will not function well for a daycare center. Because there is only one driveway, vehicles must turn around to exit the subject property, and the proposed layout necessitates the use of a parking space to perform drop-offs and pick-ups. The maneuvering necessary to exit the property will cause delays for those that are arriving. And, if there are too many vehicles arriving and leaving at one time, there could be gridlock in the parking area, and potentially a backup all the way out onto Duarte Road. Most daycare centers have an on-site circulation system that provides for efficient ingress and egress that minimizes maneuvering. Staff has prepared the attached rough sketch of a circular driveway that might work at the subject property. Staff thinks that the design of the proposed facility still needs to be worked on, and evaluated as recommended by the City's Traffic Engineer. Additionally, Section 9275.3.1 of the Arcadia Municipal Code requires that at the time a conditional use permit application is submitted for a nursery school, written proof of State approval of the site, the use of the structure and the maximum number of children shall be submitted. The applicants have not provided this documentation. CEQA Pursuant to the prOVISions of the California Environmental 'Quality Act, the Development Services Department has prepared an Initial Study for the proposed project. Said Initial Study did not disclose any substantial or potentially substantial CUP 01-026 November 27, 2001 Page 3 adverse change in any of the physical conditions within the area affected by the e project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance that could not be made less than significant with mitigation incorporation. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Mitigated Negative Declaration has been prepared for this project. The mitigation measures would be those that address the potential parking and traffic impacts. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. e 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind. of traffic, generated py the proposed use. 5. That the granting of such Conditional Use Permit will no.t adversely affect the comprehensive General Plan. . RECOMMENDATION The Development Services Department recommends denial of Conditional Use Permit Application No. CUP 01-026, because the proposed plans for the proposed use are not adequate to accommodate the necessary parking and the pick-up and drop-off of students. If the Planning Commission determines that based on the evidence presented this is an appropriate use at this site and moves to approve Conditional Use Permit .... Application No. CUP 01-026, staff recommends the following conditions of approval: i ", CUP 01-026 November 27, 2001 Page 4 - - - 1. The occupancy and tenant improvements for the pre-school and daycare center shall be in compliance with the Building and Fire Codes, which shall be determined by having detailed construction plans submitted for plan check review and approval. 2. Occupancy of the pre-school and daycare center shall not exceed 125 children, or less if required by the Building Official, Fire Marshal, or the State. The facility shall be operated and maintained in a manner that is consistent with the application materials and plans submitted and approved for CUP 01-026. 3. If off-site parking is included in the approval of CUP 01-026, a covenant per Section 9269.6, in a form approved by the City Attorney, must be executed by the property owner, recorded in the Office of the County Recorder, and shall be kept in effect for as long as the pre-school and daycare center is in operation. 4. There shall be no parking or stopping in the driveway. Signs prohibiting such shall be posted. on and along both sides of the driveway at a minimum of 25-foo.t intervals. 5. Before a City Business License will be issued, the applicants shall provide written proof of the State's approval of the site, the use of the structure, and the maximum number of children. 6. This approval of CUP 01-026 shall not take effect until the property owner and applicants have executed and filed an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of the conditions of approval. 7. Noncompliance with the plans, provisions and conditions of approval for CUP 01-026 shall be grounds for immediate suspension and/or revocation of any approvals and occupancies granted by CUP 01-026, which could result in the closing of the pre-school and daycare center. PLANNING COMMISSION ACTION Denial The Planning Commission should move to deny Conditional Use Permit Application No. CUP 01-026 because the proposal cannot satisfy all of the required prerequisite conditions for a Conditional Use Permit, and direct staff to prepare a resolution incorporating the Commission's decision and specific findings. CUP 01-026 November 27,2001 Page 5 Approval If the Planning Commission intends to approve Conditional Use Permit Application No. CUP 01-026, the Commission should move to adopt the Mitigated Negative Declaration, state the supporting findings, and direct staff to prepare a resolution incorporating the Commission's decision, specific findings, and any conditions of approval (i.e., mitigation measures). - If any Planning Commissioner, or other interested party has any questions or comments regarding this matter prior to the November 27th public hearing, please contact Senior Planner. Weare proud to live and participate in a community that recognizes the importance that our young have in the future of the world and the need to motivate and educate them accordingly. I la)ow my little ones. have truly been motivated in being recognized by the leaders of our I community. I also wanted to take this opportunity to let you know about future plans that we are contemplating.in doing, in the city of Arcadia. On November 13th we will be meeting again since we are applying for a conditional use permit to operate a Day Care Center in Arcadia. We wish to serve children from 2 years .. of age to 12 years or age. We wanted to write to you and let you know the reasons for .. wanting to open up a business in Arcadia and what our intentions are. Being parents ourselves we've seen the dilemma that young families face when both parents muSt work and extra curricular activities are not accessible. because of work schedules or economic reasons. We've recognized that there is a need not just in Arcadia but also in all cities for quality and reasonably priced Day Cares that will want to take accountability into their programs. Our plans for the day care center is to provide access to all children by providing an enrichment program in an after school setting. We want to implement art, music, civic responsibility knowing that .this will affect not just the children but everyone that they may come in contact with; as youngsters or as future adults. I created an enrichment program two years ago that was implemented at Pleasant View Elementary in Baldwin Park. It was a program that taught children the values, differences arid .similarities that all countries have, The children learned about art, culture and history that has contributed to the importance of our world as a whole. Among some of the artists studied have been Mozart, Picasso, Degas etc... Our studies have also included famous composers such as Bach, Vivaldi and my personal favorite Beethoven that despite his handicap as deaf adult was still able to compOse beautiful symphonies. It makes the soul stronger when you hear about adversities that others might have faced or had, and how 'they were able to overcome them. It's been a program that has impacted our young learners.. Now that we are part of this community and our children are attending Arcadia schools, we have started piloting the program after school at Hugo Reid Elemeiltary. It is a program that we will implement into our Day Care, facility as well. We truly believe in ilIA the strength and unity of a community and the impact this has on its citizens. That's why WI' we want to work where we live. This gives,you more reasons to try to be the best that you e e e can possibly be because you owe it to your neighbors, friends and family. We want to work closely with Arcadia's Unified School District agenda for they're young; being an extension for the school and their academic goals. We feel strongly that our community has so much to offer all children, not just academically but in terms of installing self- esteem and responsibility for themselves and their world. That's why it's important that our young get involved in positive and healthy activities so that they may represent our community proudly in the future; in whatever field they may choose to work in. ~t is unfortunate that some children that are in an after school setting cannot participate in enrichment programs. That's why we want to bridge the gap and make enrichment programs accessible to all children. It is a reality of life that most families have both parents working. These are issues that we must deal with in our contemporary world. I'm positive that we can have a strong impact in our community and their future citizens. I hope that you will consider our application for Ii conditional use permit as a valuable and needed service to our Arcadian community.
